from July 9, 2013 meeting to be continued to a date uncertain). Application for a Tentative
Subdivision Map, Zoning Map Amendment, and associated environmental review to create 144

commercial, residential and open space land uses served by a network of predominately public
streets on 35.7 acres (39.4 acres including the riverfront park).

7. PUBLIC HEARING NEW BUSINESS -PLANNING COMMISSION: (07:13 PM) An application for a
General Plan Amendment, Zoning Map Amendment, Site Plan and Architectural Review and
associated environmental review for construction of a 144 -unit apartment complex on an
approximately 5.85 acre site located at 35 Maria Drive The requested General Plan Amendment
is to change the property's land use designation from Mixed Use to High Density Residential
and a Zoning Map Amendment to change the property's zoning classification from PUD to R5.

Motion: Approve Resolution recommending the City Council to approve a General Plan
Amendment to change the General Plan land use designation from Mixed Use to
High Density Residential and add 9. In the public interest associated with the
Planning Commission Minutes of August 13, 2013 Page 10
proposed General Plan Amendment, Planning Commission recommends that the
City Council seek agreement from the applicant to incorporate Maria Drive
Improvements, Washington Creek Trail enhancements, and greater Green
Building features to achieve a minimum of 100 points under the current Build It
Green Multi -Family Checklist.

8. ADJOURN: (10:31 PM) Adjourn to the next regularly scheduled Commission meeting.
APPEAL STATEMENT: Within fourteen (14) days following the date of a decision of the Planning
Commission, the decision may be appealed to the City Council by the applicant or by any other
interested party. If no appeal is made within that time, the decision shall be final. An appeal
shall be addressed to the Council in writing and shall be filed with the City Clerk. Said appeal
shall be accompanied by the appeal fee as specified by Resolution 2010-206-N.C.S. as adopted
by the City Council. The appeal shall state specifically the grounds for the appeal and the relief
sought by the appellant. (Zoning Ordinance §24.070)
