APPROVAL OF MINUTES: (07:01 PM) March 26, 2013 Planning Commission Minutes. Motion: Approve the March 26, 2013 Planning Commission Minutes. Moved by Bill Wolpert, seconded by Melissa Abercrombie. The Planning Commission hereby finds that the Public Art Master Plan, Exhibit 1, is in general conformity with the Petaluma General Plan 2025 in that the Public Art Master Plan implements policy 6-P-29 by integrating public art into the public planning process. Be it further resolved by the Planning Commission that the Planning Commission Minutes of April 23, 2013 Page 6 Public Art Master Plan are hereby referred to the Petaluma City Council for consideration with the recommended change of "Petaluma River Trails" to "Petaluma River Waterways" on page 21 of the Draft Master Plan. Moved by Melissa Abercrombie, seconded by Kathy Miller. Vote: Motion carried 5-1. The Planning Commission hereby finds that the proposed amendments to the Implementing Zoning Ordinance, Exhibit 2, are in general conformity with the Petaluma General Plan 2025 in that the text amendments implement policy 6-P-29 by integrating public art into the public planning process. Be it further resolved by the Planning Commission that the proposed amendments to chapter 18 of the Implementing Zoning Ordinance are hereby referred to the Petaluma City Council for consideration and findings in accordance with Section 25.010 of the Implementing Zoning Ordinance with the following recommended modifications: Section 18.030.H. to specify that public art costs shall not include ongoing maintenance; Section 18.170.A. to specify that cost of the replacement public art shall be equivalent to the original cost of the public art requirement represented in present dollar value. Additionally, the Planning Commission encouraged the City Council to reconsider the policy that the public art requirements not apply to residential projects of 50 units or more (Section 18.080). Moved by Kathy Miller, seconded by Melissa Abercrombie. Vote: Motion carried 6-0. The Planning Commission Minutes of April 23, 2013 Page 7 Planning Commission hereby finds that the proposed modifications to the Petaluma Public Art Committee's enabling legislations, Exhibit 3, are in general conformity with the Petaluma General Plan 2025 in that the modified enabling legislation implements policy 6-P-29 by integrating public art into the public planning process. Be it further resolved by the Planning Commission that the proposed modifications to the Public Art Committee's enabling legislation and procedural guidelines are hereby referred to the Petaluma City Council for consideration. Moved by Dennis Elias, seconded by Alicia Kae Miller. Vote: Motion carried 6-0. ADJOURN: (08:53 PM) Adjourn to the next regularly scheduled Commission meeting. APPEAL STATEMENT: Within fourteen (14) days following the date of a decision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed with the City Clerk. Said appeal shall be accompanied by the appeal fee as specified by Resolution 2010-206-N.C.S. as adopted by the City Council. The appeal shall state specifically the grounds for the appeal and the relief sought by the appellant. (Zoning Ordinance §24.070) Eric Danly, City Attorney
