S. : of the City of Petaluma, California A RESOLUTION DENYING APPEAL FROM THE DECISION OF THE PLANNING COMMISSION GRANTING A VARIANCE . TO SUSAN DEHAAN AT 501 WEBSTER STREET WHEREAS, the Petaluma City Plann'ing Coinmission on December 14, 1982, did grant an application for a variance to allow a detached garage to be constructed at 501 Webster Street, with a three foot rear yard setback and a two foot side yard setback.; and, WHEREAS, Martiri Pozzi and Russell Kerbey made timely appeals to the City Council pursuant to the provisions of Ordinance No. 1072 N.C.S., as amended; and, WHEREAS, the matter was duly noticed and regularly heard and a hearing conducted on January 17, 1983; and, WHEREAS, at said hearing the City Council considered the record submitted by the Plannin'g Commission as well as. testimonial evidence by the appellant, the city staff and other interested parties; NOW, THEREFORE, BE IT RESOLVED that the Council does hereby find after considering all the evidence submitted in the case that the variance as granted meets the required findings, subject to any conditions imposed by the Planning Commission, denies the appeal' and upholds .the action of the Planning Commission granting the variance to Susan DeHaan to construct a garage on the property at 501 Webster Street with a three foot rear yard setback and a two foot side yard setback. ler the power and authority conferred upon this, Council' by the Charter of ~said ( I hereby certify;the foiegoing"; Resolution was introd"uced_ and- adopted by the Council of the City'of ~Petaluma at a(Regular) ~~~~~-~~ .meeting on the:.... 17t;h.--.. day of ...._...JanuarY. ;... ._...., I9g;3.., by the following vote: , ~ ~ AYES: BALSHAW/.BATTAGLIA/GAVANAGH/HARBER'SON/V~I%C'~E MAYOR PERRY/ / Mayor MATTEI ~ NOES: ~ . END O'F CONSENT CALENDAR * * * * * * * * * * * * * * * * * * * * * ~ * * * * * * * * * * * * * * * * * ` PUBLIC HEARING APREAL. 5U1 WEBSTER STREET Planning Director Freitas reviewed the proposal of Mrs. Dehaan . to reconstruct at tihe rear of her property a garage which ~vould access off Dana Street. On 'December 14, 1'982, the Planning Commission approved the variance to _ allow the detached garage to be built with a three foot rear yard setback aiid a two foot side yard setb~ck. This decision was appealed by a neighbor; Nlartin Pozai, of 307 D,ana Street. . The public hearing was opene'd. Susan Dehaan requested~ the Council support the variance whi'ch she. said would allow her ~ to maintain the same size of •_ play yard that currently exists behind her house. Mr. Martin Pozzi of 307 Dana, and Mr. Russell IKerbey, of 308' Dana, spoke against the variance. Mr' Pozzi's , o~position related to his feeling the driveway should be twenty feet long.~ ~1r. Kerbey''s o~position related to the possibility tlie riew garage roof would cut off light 'to his livin-g room window. Coneern was e'xpressed tfiat'. the drivewa~y should ~ be at least long enough to a`ccommodate the parking of one car without interfering the use.of the sidewalk. The hearing was c.losed.
