NOW., THEREEORE,, B;E IT RESOLVED that the final unit
development plan. on. file ~ in the office .of Community Development and
Plarin.ing is hereby ap.proved pursuan,t ;to S:ection 19A--504 of Zoning
Ordinance No. ~ 107Z N. C:. S. ,. as amended.;.- and,
BE .IT FURTH.ER. R_ESOI,VED t-hat t~he City :C:ou:ncil' hereby adopted
the findings of . the ~Planning Commission as its findirigs as stated
hereinafter : '
. 1. 'Phe 'Development Plan ^:clea'rly results in a more desirable
use. of land and ~a better ph,ysical environment than would be
possible und'er any sing-le . d:istrict or combination of zoning
di~strie:ts .~ '
2. T,he ,P'. U.-D,. District is p'roposed on property which has a
suitable: relationship to `a thoroughfare; and said
thoroughfare is adequate to car"ry any additional traffic
generated ~by the development.
• 3. The plan for the propo_sed developmerit presents a unified

a~nd organized, arrang;ement of buil_dings arid service~ facilities
,~ which are appropriate in rela.'tion to adjacent properties ,, and

. 5. The de~elopment of, tlie subject property, in the manner
proposed by the applicant; will not be detrimental to the
public wel'fare, will be in the liest= interests of the City and
will be in keeping with the general intent and ;spirit of the
zoning regulations of the City of PetaTuma, with the Petaluma
General Plan, and the Environmental Design Plan.
BE I.T FURTHER RESOLVED that said apprqval is made subject to
the conditions set out hereinafter:
1. If any subsurface archaeological materials are encountered
within the rezone area, all work shall be immediately halted and a
qualified archaeological consultant eontac'ted in order to evaluate
the materials and formulate appropriate strategies for their
preservation and protection.
2. All noise 'mitigation measures reeommerided in the Noise Study
prepared 'for the~ project shall be integrated into design plans.
3. All traffic mitig,ation measures recommended in the Traffic
Rep.ort shall be iritegrated into design plans :
a. Sidewalks within the Oak Cr.eek development should be
shown on fhe plan to assure that logical connections are made
to the. existing sidewalks along Graylauvn Avenue as well as to
building .and activity centers within the complex.
b. H~andicapped and guest parkin'g should be clearly
identified to avoid confusion by user-s,.
c. A"YIELD" sign and marking. to eontrol westbound drivers
on Jess Avenue approaching the intersection at Graylawn
A-venue shall be installed.

d. All major accesses to future deveTopments in the
remaining, vacant property` in the vic'inity of the project shall
be from the Rairiier Avenue extension or other new public
street rather- than to streets to the .south, such as Graylawn
Avenue and Burlington Drive.
4. The proposed apartment units shall not be oceupied by persons
younger than 5'5 years of age until su .ch time as at least 38
additional on-site. parking spaces are approved by the City and
developed on-site.. Any addition of parking spaces shall constitute
a required change to the development plan.
5. The existing .natural rock outcropping on the site shall be

preserved. All existing on-site Oak trees shall be permanently
preserved in healthy growing condition. Any future modifications
to the Petaluma Creek Floodway area shall be subject to prior
approval by the. PYanning Comrnission.
6. The project shall be subject to site plan and architectural
approval in aceordance with Section 26-4U~0 of the Zoning Ordinance
prior to the issuance of any on-site development permits .
7. Use of the 11.73 acre vacant portion of the site shall be
limited to uses permitted in the Agricultural .District as specified in
the Zoning Ordinan¢e.
8. The northe~rnmost street turn-around shall be fully landseaped.:

9: A creekside pedestrian path shall be developed along the full
length of the 17.56 acre site.
10. Development rig.hts to the full strip of land located to the
east of the 17:56 acre developrnent in the Floodway shall be
dedicated to the C'ify for the purpose of creating permanent open
space, prior to the issuance of any bu.ilding permits for the
project .
11. The off-site existing Payran sewage pump station will have to
be enlarged at the developer's expense to provide the increased
capacity to carry the waste discharge from this development. The
pump station was originally sized and constructed to serve only
the Linda del Mar Subdivision.
12. The island in the center of the entrance be situated so that
contraflow movements by people exiting the parking areas would be
prevented.
13. A looped water system shall be provided so that adequate fire
protection may be provided as well as minimum delays iri the event
of a main shutdown.
14. An on-site flood storage basin shall be engineered and
constructed so as to detain the storm .waters generated from the
developed portion of tfie site at or b'elow the rate of runoff of
undeveloped land for a 24-hour, 10;0-=year event, subject to
approval of the City Engineer. A mechanism ,s.ha11 be developed to
insure ongoing hydraulic maintenance of the proposed detention.

system. The mechanism must bind a11 future owners of the
property and provide for enforcement:,,,.by the City, including
reimb.ursement for costs, in the event that the basin system is not
properly maintained. ~ The mechanism shall be subject to app'roval
by the City Attorney and be s`et in :place;prior to issuance of the
first building permit for the project.
15. Recreational vehicle parking: shall not be allowed on-site.
BE IT FURTHER RESOLVED that the City Council finds that the
requirements of Caii,for.nia ~nvironmental Quality Act Guidelines Section
15083 have been satisfied and hereby incorporates by reference the
Negative Declarafion adopted by Resolution No. 9483 N.C.S. on June
21, 1982.
