S. ~°-~ ~ ` of the City of Petaluma, California A RESOLUTIO:N APPRUVING THE REVISED UNIT DEVELOPMENT PLAN FUR THE PARK PLACE III SUBDIVISION LOCATED A'I' MARIA D12IVE AND RATNIER AVENUE (QANTAS DEVELOPMENT) AND READOPTING CONDITIONS OF THE UNIT DEVELOPMENT PLAN AS ORIGINALLY ADOPTED BY ORDINANCE 1350 N.C.S. WHEREAS, Ordinance No. ~~ N.C.S. repealed Ordinance No. 1350 N. C. S. and deleted references to the Unit Development Plan and conditions thereon from the legislation readopting the PUD zone designation; and WHEREAS, by action taken on June 27, 1982 the Planning Commission recommended adoption of revisions to the Unit Development Plan more particularly described as follows: Substitution of one story, detached single family dwellings of approximately 1,076 square feet in size for previously approved two story, attached townhouse dwellings of approximately 1,420 square feet in size for the following lots: 816, 812, 712, 708, 632, 628, 612 and 608 Maria Drive NOW, THEREFORE, BE IT RESOLVED that the final unit development plan on file in the Office of Community Development and Planning is hereby approved as revised pursuant to Section 19A-504 of Zoning Ordinance No. 1072 N. C. S., as amended; and, BE IT FURTHER RESOLVED that the City Council hereby adopts the Findings of the Planning Commission as its findings as stated hereinafter: 1. Said plan clearly results in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of districts. Z, That the Planned Unit District is. proposed on property which has a suitable relationship to one (1) or more thorota ghfares; and that said thoroughfares are adequate to carry any additional traffic generatecl by the development. ~ Reso. That the plan for the proposed development presents a unified and organized arrangement of the buildings and service facilities, which are appropriate in relation to adjacent or nearby properties and that adequate landscaping and/or screening is included if necessary to insure compatibiiity. 4. That the natural and scenic qualities of the site are protected, with adequate available public and pr.ivate spaces designated on the Unit Development Plan. 5. That the development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be .in the best interests of the City and will be in keeping with the general intent and spirit of the zoning regulations of the City of Petaluma, with the Petaluma General Plan, and with any applicable Environmental Desi,gn Plans adopted by the City. BE IT FURTHER RESOLVED the City Council approves the revised development plan, subject to the condition"s of approval formerly included in Ordinance No. 1350 N.C.S. and hereinafter noted and the additional condition relating to the substitution of units for lots. listed above: l. All street trees on completed lots shall conform with the City Street Tree Ordinarice and shall be planted by the time 75 percent of the homes have received certificates of occupaney. The trees shall be maintained in healthy growing condition for a period of not. less than one (1) year from the date of occupancy as a con dition in the traet C. C. & R.. 2. A varied front yard setback progr.am shall be established for the 88 conventional lots. No front yard setbacks shall be less than twenty (2'0) feet. 3. At least two ( 2) of th'e .proposed housin~g tiaodels to be located on the 88 conventiona~l lots shall be~ replaced with different models to create greater visual diversity in the development . All exterior plywood used on dwellings shall measure at least 5/8 of an inch in thi'ckness. Not more than ten (1:0) dwellings plotted on the Development Plan may be changed without prior approval by the Architectural and Site Design Review Committee. All modifications to housing models sha11 be subject to review and approval by the Ar-chitectural and Site Design Rev~iew Committee at the time of change. 4. The 88 eonventional lots shall be irriproved with a minimum of one (1) street tree, six {6) shrubs, and a seeded lawn; and each quadraplot eluster shall be imp-roved with a minimum of fqur (4) street trees, four (4) private drive trees, and seeded front lawns along the public street and private driveways .
