S. ~ of the City of Petaluma, California APPROVING THE TENTATIVE MAP FOR MAGNOLIA HILLS CONDOMINIUMS IN THE VICINITY OF PETALUMA BOULE:VARD NORTH (A.P. No'.s 6-450-04, 13 and 6-4"60-O1, O6) WHEREAS, Larry Nfartini as owner and subdivider, has filed wi.th' ~ this Council a ten.tative~ map to~ subdiviae land witliin this City to b.e known as Magnolia Hills Subdivision, and has paid all required filing fees; and, WHEREAS, the City Engineer, the Director . of Planning, the Sonoma County Water Agency, and the Planning Commission have examined and reviewed the same as required ~by law and . all reports, recommendations, and comments thereon have been forwarded to and considered by this Council at its meeting held on October 26, 1982 NOW, THEREFO'RE, BE IT RESDLVED that this Council hereby finds as follows: 1. The proposed subdivision, together with provisions for its design and improvement, is consistent with the General Plan . 2. The proposed subdivision is compatible with the objectives, policies, general larid uses, and programs specified in said General Plan . 3. The site is physically suitabie for the type of development proposed. 4. The site is physically suitable for the proposed density of development. 5. The design of the subdivision and the proposed improvements therefor will not cause substantial environmental damage, and no substantial or avoidable injury will occur to fish or wildlife or their habitat . 6. The design, of the Subdivision and the type of improvements will not cause serious public health problems . Reso. 9589 N.C.S. Page .l of 5 7. The design of the Subdivision and the type of improvements proposed will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision . 8. The discharge of waste from the proposed subdivision into the existing community sewer system will not result in violation of the existing requirements prescribed by the Regional Vlater Quality Control Board. 9. The design of the subdivision for which the tentative map is required provides to the extent feasible, for future passive or natural heating or cooling opportunities in the subdivision. BE IT FURTHER RESOLVED, based on the findings set forth above, that the above referred to tentative map, be and the same is hereby approved, subject to the conditions set forth below and incorporated herein as follows: l. The plan shall meet all requirements of the Fire Departrnent as foll_o~v~ : A. All buildings with three or more clwelling units shall be equipped with approved fire alarm systems . B. All trash areas within 5 feet of buildings or carports shall be protected by fire sprinklers. May be supplied by domestic system. C. Fire hydrants shall be located as marked on plan - fire flow 2500 GPM. From two hydrants 20 PS: Residual pressure. D. Submit an 8 Z X 11" site plan drawn to 100 scale marked with required Fire Department symbols . E. All roof covering shall be fire retardant. 2. On-site utility systems shall be revised to cross utility easements at right angles only. 3. Provide additional storm drain catch basins in the "picriic sandbox play area," at the toe of the bank west of the pool area, in additional locations along the street running parallel to the north property line, and where the storm drain line crosses Reso. 9589 N.C.S. Page 2 of 5 Magnolia Avenue. Drainage subject to review by the City Engineer . 4. Trees to be planted in public utility easements shall be species approved by the Public Works Superintendent and Director of Community Development and Planning. 5. Utilities proposed within 20 feet of tree trunks shall be relocated out of those areas or eliminated. 6. Each unit shall be provided with a lighted address easily distinguishable from the internal loop street or Magnolia Avenue. 7. The project shall meet the requirements of the City of Petaluma storm water mitigation policies. 8. Existing overhead utility lines on and adjacent to the site shall be placed underground. 9. The CC & R's, (conditions, covenants and restrictions) for the project shall be submitted in final, recordable form prior to approval of the final map and shall specifically define building setbacks, prohibition of on-site parking of recreational vehicles and maintenance of the access drive to the Liberati and Heifner properties . 10. Two eucalyptus trees, one located at unit #16 and the other in the roadway shall be removed and the 16" and 24" walnut trees shown for possible removal shall be saved and the project redesigned to the approval of the Community Development and Planning Director. 11. That the project shall meet all the requirements of the City Engineer as follows: A. The on-site sanitary sewer should be private sewer. These mains appear to be encroached upon, not only by building foundations, but trees and the proposed storm drain. B. The existing sanitary sewer and public water mains should not be crossed in the fashion shown on this map. This department would prefer ri~ht angle type crossings in lieu of the long skewed crossings shown. If water main is to be publicly maintained, it should not have retaining walls shown in its easement. Reso. 9589 N.C.S. Page 3 of 5 C. The dedication of right-of-way and public utility easements in front of the Heifner land should be made prior to the final map submittal. Full half street improvements at that location should also be provided. D. An access easement should be provided for Heifner and also for Liberati. E. We recommend that there be no retaining walls within the city right-of-way as shown along Magnolia Ave. F. As shown on Section AA, we recommend that the full half street improvements be made to include improvements past the centerline if necessary to make a proper conform. G. On 5ection BB we recommend that a 2" AC layer be placed over 5" of aggregate base and 5" of aggregate subbase. H. On Section CC it appears that storm water from this subdivision will cross the property line. This is not allowed by either the Engineering Department or the Building Inspection Department. I. The storm drain proposed to cross Magnolia Ave. would have to cross existing private property. Easements would have to be ~required for this type of crossing . J. No provision for reception of storm water along the north side of Magnolia is shown on the map and these improvements would be necessary. K. Section 20.16.030 of the Subdivision Ordinance requires that the engineer or surveyor certify the boundaries of the map . L. Section 20.16.050 of the Subdivision Ordinance requires that the vicinity sketch show existing subdivisions and outline of 0 acreage parcels of adjacent land. M. Section 20.16.110 of the Subdivision Ordinance requires that the map have a written scale. N. Section 20.16.130 of the Subdivision Ordinance requires that existing widths and grades of adjacent streets be shown. O. It appears that Lot #9 rriay encroach on the existing water main easement.
