City Attorney Donly tallied the votes and announced that Peter Ehrlich had
received 6 votes and was appointed to the Tree Advisory Committee to Serve a
Two -Year Term Expiring June 30, 2016 (Resolution 2014-107A N.C.S.). Matthew
Cory and David Powers had each received 4 votes.
Mayor Glass suggested that in lieu of the ballots being redistributed for a second
vote, Council vote "by the lights" using the electronic voting board.

Mayor Glass clarified that "yes" would be a vote for Matthew Cory; "no" would
be a vote for David Powers.
Council signaled their votes on the light board. Mayor Glass announced that
Council had voted to appoint Matthew Cory to the Tree Advisory Committee to
Complete a Two -Year Term Expiring June 30, 2014 (Resolution 2014-1078 N.C.S.)

Reggie Grant, Petaluma, asked for clarification about access to the subdivision
from Sonoma Mountain Parkway.
Armand Bascherini, Petaluma, spoke about flooding in his backyard from earlier
developments and asked that the developer find a way to prevent this problem
from becoming worse with this development. He also spoke about pest control
and "land grabbing."
Barbara Larson, Petaluma, told Council she was thrilled that the developer has
decided to keep tree #66.

1 Motion: Approve B. Resolution 2014-113 N.C.S. Adopting a Mitigated Negative
2 Declaration and Mitigation Monitoring and Reporting Program for the Avila Ranch
3 Subdivision, as amended to add the following:

5 BE IT FURTHER RESOLVED THAT:

1. Pursuant to CEQA Guidelines Section 15074. 1, and as a result of project
8
modifications to preserve Coastal Redwood Tree #66 and to the extend noise
9
barrier along Sonoma Mountain Parkway frontage, and as a result of the
10
public review process, the Mitigation Measures BI0-4 and N01- 1, as identified
11
in the Mitigated Negative Declaration (MND) shall be substituted as follows:

BIO -4 Prior to issuance of tree removal permit, replacement trees equaling a
14
total of 88 -inches of replacement trunk diameter (a total of 44 24 -inch box
15
tree with a 2 inch diameter or the equivalent pursuant to Zoning section
16
17.065 A.3.c.3) shall be shown on (TM -9).

NOI-I The project shall require a noise barrier with a height of 10 along the
19
projects' frontage to Sonoma Mountain Parkway. The noise barrier shall be
20
designed to limit impacts associated with visual resources, which can be
21
accomplished through the mounded berm and landscaping approach as set
22
forth on TM -6. Additionally, perpendicular noise barrier shall be developed
23
along the western edge of the site. The perpendicular noise barrier may
24
tapper from 10 feet to 5 feet. Should wood fencing be utilized as currently
25
proposed, the fence shall be double faced, with butted vertical fence board
26
on each side with a continuous layer of % inch plywood.

2. These substituted mitigation measures are an "equivalent or more effective"
29
means to avoid or reduce the significant effect than the original measure,
30
and will create no more adverse effects of their own then would have the
31
original measures.

3. No recirculation of the Mitigated Negative Declaration is required as these
34
substituted mitigation measures are incorporated herein and are conditions of
35
project approval.

Motion: Approve B. Resolution 2014-114 N.C.S. Approving a Tentative Subdivision
Map for the Avila Ranch Subdivision, amended as follows:
Add Condition of Approval (#25) from the City Council to read, "At least two
homes on lots 16-21 shall be of single -story design as reviewed during Site Plan
and Architectural Review."
Change the wording of the first sentence of Condition 452 (Condition #51 in
staff report) to read: "All existing wells and any existing septic systems shall be
properly abandoned per Sonoma County standards."
