A RES~C~L~iJI'ION APPR~7VING A REVISION TO 'THE DEVELpPMF~VVI' PLAN FOR
NO~rAR S'~JBDIVISION L/x'.~TFA AT ELY &~JLE~IARD AK~RTH AND CAPRI
~EE~ - ASSFSSOR'S PARGEI~S 1~InS. 136-110-O1, 136-110-23 and
137-060-20.
~EAS, by Clydinance No. 1502 N.C.S., the area represented by
Assessor's Parcel Nos. 136-110-01, 136,110-23 and 137-060-20 were
rezoned to Planned Unit Developnent; and,
WHII~EP,S, by action taken on August 10 1982, the Planning Comnission
recomnended revision of the revised final unit develop~nent plan in said
Planned Unit Zone;
I~QiN, THEREF~ORE, BE IT RESOLVID that the revised unit development
plan on file in the Office of the Cormnu~ity Development and Planning is
hereby approved as tYie final Unit Development Plan pursuant to Section
19A-504 of Zoning Ordinance No. 1072 N.C.S., as amended; and,
BE IT ~ RE~SOLVF.D that the City Council hereby adopts the
Findings of the Plann'ing Comnission as its findings as set out
hereinafter:
1, The Developtnent Plan clearly results in a more desirable use of
land and a better physical environment than would be possible under any
single district or comUination of zoning districts.
2. The P.U.D. District is proposed on property which has a
suitable relationship to a thoroughfare; and said thoroughfare is
adequate to carry any additional traffic generated by the development.
3. The plan for the proposed development presents a unified and
organized arrangement of buildings and service facilities which are
appropriate in relation to adjacent properties, and adequate landscaping
is included to insure cor~atibility
4. The natttral and scenic qualities of the site are protected with
adequate available public and private spaces designated on the Unit
Development Plan. ,
5. The developrnent of the subject property, in the manner proposed
by the applicant, will not be detrimental to the pizblic welfare, will be
in the best interssts of the City and will be i_n keeping with the
general intent and spirit of the zoning regu~l,ation of the City of
Petaltuna, with the Petaltur~a General Pl~an, and: with the Envirorunental
Design Plan. .

BE IT FCJ1~If-iER RE~90LVFD that the Ci ty Counci 1 hereby approves the
Develop~rnent Plan.subject to the conditions set out hereinafter:
l. Call out on development plan security fencing for Recreation
Area designed to the approval of the Site Plan and Architectural Review
Conmittee.
2. Appli,cant will establish permanent maintenance mechanism for
al l corrxnon areas„ and ineluding'the 'Ely Blvd. landscaped setback and
wall, cul-de-sac parking and t~raffic islands, creek"%urban separator area
and remainder parcel on Maria Drive.
3. Improv~nents in creek ar.ea shall be subject to final review by
the ~ity Development and Planning Director, City Engineer, Sonoma
County Water Ageney and:California Department of Fish and Game.
4. Project CJC&R!s and Haneowners Assoeiat:ion By-Laws shall be
submitted prior to final approval of any tentat,ive map for the project
and be subject to approval by theCity Attorney and Conmunity Develo~nent
and Planning Director prior to approval of any final map.
5. Development:landscape plan shall indicate lawns or mix of
ground cover, shrubs and trees for all units in all yard areas fronting
streets. A mix of landscaping ma:terials shall be required for each lot,
approved by Site Plan and Architectural Review C'.airnittee, and installed
prior tooccupancy of each dwelling unit. The density of planting
materials shall meet City landscaping standards and shall include street
trees as required by City Code.
6. The project shall be subject to design approval by the Site
Plan Architectura-T Review Corimittee in accordance with Section 2b-400 of
the Zoning Qrdinance. Appr.oval shall be accor~l:ished prior to approval
of a tentative ma.p. Conditions shall be incorporated as conditions of
the develo~nent plan.
7. 5pecific design of cul-de-sac parking areas shall be subject to
final approval by the Comriunity Development and Planning Director, City
Eng._ineer and Fire Ch"ief.
8. Minirraun setb.acks shall be consistent with R-1 6,500 Zoning
District except for those shown on the approved develop~nent plan.
9. All dwelling units shall be des-i,gned, to the approval of the
Comrnzn`ity Developtnen;t and Planning Director to insure interior sound
l.evels from exterior noise sources do not. exceed 45 DBA in habitable
rooms and 40 DBA~i~n bedroom areas.
10. Recreational vehicle parking and trailers shall be prohibited
in cul-de-sac par-king islands.
11, Landscaping of creek buffer/urban separator shall be
consistent with plans for irr~rovement5 to Sunrise area buffer.
