HomeMy WebLinkAboutResolution 2002-064 N.C.S. 04/15/2002 Ides®lution No..2002-064N.C.S. of the City of Petaluma, California 1 RESOLUTION ORDERING ABATEMENT OF NUISANCES 2 CONSISTING OF WEEDS GROWING UPON PUBLIC AND PRIVATE P12OPERTY 3 IN THE CIT'E' OF PETALUlVIA AND ORDERING THE FIRE CHIEF.TO REIVIOVE 4 SAID WEEDS, BY CONTRACT OR BY HIS OWN FORCES 5 6 WHEREAS, on the 1st day of April 2002, the Council of the City of Petaluma adopted 7 Resolution No. 2002-047 N.C.S., declaring weeds growing upon public and private 8 property referred to and described in said Resolution, constituted and were a public 9 nuisance and' fixed the 15th day of April 2002, at the hour of 7:00 p.m., or as soon 10 thereafter as can be heard, in the Council Chambers of the City Hall, 11 English Street, 11 Petaluma, California, as the time and place of hearing protests and objections to said 12 abatement proceedings; and, 13 14 WHEREAS, written notice of the April 15, 2002 hearing, substantially in the form 15 provided by Government Code Section 39566, was mailed to all owners of potentially 16 impacted property at least five days prior to said hearing pursuant to Government Code 17 Section 39567.1, as specified in Resolution No. 2'002-047 N.C.S.; and, 18 19 W~IEREAS, the City Council has held its hearing and considered all objections or 20 protests to the proposed removal of weeds and .has followed or overruled any or all 21 objections, as hereinafter set forth, and the City Council has now acquired jurisdiction to 22 proceed and perform the work of removal of said weeds; 23 24 NOW THEREFORE, BE IT RESOLVED that -the City Council does hereby order the 25 Fire Department of the City, through a contractor employed by this Council or its own 26 forces, to abate said nuisances by removing said weeds by means of mowing, disking 27 handwork, or blading using whichever means it deems to be the most appropriate after 28 considering the location and the terrain of said parcels of public and private property 29 referred to and described in said Resolution No. 2002-047 N.C.S. Said mowing, disking, Resolution No. 2002-064 N.C.S. 1 handwork, and blading shall be accomplished as many times as the Fire Department may 2 deem necessary to provide the best possible control of weeds. 3 4 NOW T>FIEREFORE, BE IT RESOLVED that to recover administrative costs for 5 managing the abatement program, the City Council authorizes the Fire Marshal to assess 6 a $100.00 administrative fee to every parcel or lot of private or public property that 7 requires abatement by the City. 8 9 BE IT FURT>FIER RESOLVED that said Fire Department shall keep an account of the 10 cost of this abatement of said nuisances on public and private property where the work is 11 done, and thereafter submit to this Council for confirmation, an itemized written report 12 showing such cost as required by Section. 39547 of the Government Code, and thereafter 13 such proceedings shall be had for special assessments against the respective parcels of 14 land to pay for the cost of said work, in the manner provided by Chapter 13, Part 2, 15 Division 3, of Title 4 of the Government Code. 16 17 h:\msoYfice\Sheila\weeds\weeds02\resolution\reso2 cm 4/2/2002 Under the power and authority conferred upon this Council by the Charter of said City.
