APPROVING A REVISED TENTATIVE
SU,BDIVISION - MAP FOR
NORTHSTAR SUBDLVI'SION
(Ely Blvd. North at. Capr=i Creek)
WHEREAS, the M°cBail Corp., .as., owner .and Subdivider; has filed
with. this Council a tentative map, proposing -to: subdivide land within
this. City to be . known as North 'Star Subd vi"sign;, and has paid all
required filing fees,;. and,
WHEREAS, . the; City Engineer', the Director, of Planning, the.
Sonoma County Wafer'- Agency, and the. Planning Commission. :have
examined and reviewed: ,the- .same as required by law and all reports,
recommendations, and .comments thereon have been - forwarded to and
considered by this Council at its meeting held on :August :16, 198'2.
NOW, THEREFORE,,. BE IT RESOLVED- that this Council hereby
finds as follows
1. The proposed, subdivision,, together with provisions for its
design- and improvement, is consistent with the 'General Plan,.
2.. The proposed ,subdivision is:, compatible with the objectives,
policies general land uses; and programs specified in said General Plan.:
3. The site is physically .su-itab'le for -tile; ` type` of development
proposed.
4. The siteis plyscally .suitable for: tithe proposed den`sify. ;of
development. ,
•5. The -design of the subdivision, and the proposed improvements
therefor- will, `not, cause 'substantial environmental 'damage, and. no
substantial or avoidable injury will occur to- fish or wildlife or their.:
habitat. o
6. The design, of the Subdivision and the type of improvements
will not cause serious; .pub`lic 'health problems.
? The design of the Subdivision and the type. of improvements
proposed will not conflict with easements; acquired by the public at

large, for access through or use of property within the proposed
subdivision.
8. The discharge of waste from the proposed subdivision into the
existing community sewer system will not result in violation of the
existing requirements prescribed by the Regional Water Quality Control
Board.
9. The design of the subdivision for which the tentative map is
required provides to the extent feasible, for future passive or natural
heating or cooling opportunities in the subdivision.
10. The tentative map provides reasonable public access from a
public road to that portion of the bank of the stream lying within the
proposed subdivision.
11. The tentative map provides for dedication of a public easement
along the portion of the bank of the stream lying within the proposed
subdivision.
BE IT FURTHER RESOLVED, based on the findings set forth
above, that the above referred to tentative map, be and the same is
hereby approved subject, to the conditions set forth below and
incorporated herein.
1. The applicant shall comply with all requirements of the City
Engineer outlined below:
A. Use, .of the flood storage basin shall be engineered so as to
detain the waters at a rate that is not to exceed the run-off of
undeveloped land fora 24-hour 100 -year event.
B. The subdivider shall be required to put up half the cost of
the culverts that may be required at Maria and at Ely.
C. The off-site channel improvements downstream of this property
should be required during the Phase III or IV construction,
whichever comes first.

D . The extension of sewer mains to serve the properties above
this particular property should be investigated.
2. All existing widths and grades of adjacent streets shall be
shown on the tentative map. The easternmost street that stubs into
Park Place IV shall line up with the planned Park Place street, and
given the same name. All other streets in the project shall be subject
to approval by the City Street Naming Committee. The curved section
of Maria Drive between Sunrise and Park Place Subdivisions shall be
straightened somewhat to reduce excess curves.
3. Lots shall contain a minimum area of 4.,, 0.00 square feet. No lot
shall have a minimum width less than. 30 feet at the building setback
lines. Front building setback lines shall vary between 20 and 25 feet
to prevent a row housing visual effect.
4. All grading and drainage design shall be consistent with the
requirements of the Sonoma County Water Agency.
5. The Capri Creek right-of-way shall be dedicated to the City.
Creek right-of-way landscaping shall be maintained by a Homeowner's
Association. However, the Sonoma County Water Agency shall be
required to provide for any necessary hydraulic maintenance.
6. Final subdivision map approval shall be consistent with the
phased housing allotment schedule established for the development, and
map approvals limited to portions of the project having full allotment
award.
7. Any proposed off-site improvements and easements shall be
subject to written consent by the affected property owner(s) .
8. A masonry wall of a minimum height of six (6) feet shall be
erected along the. Ely Blvd. frontage in the 'public right-of-way' design
and in the location is subject to approval of the City Planning Director.

BE IT FURTHER RESOLVED the City Council finds that the
requirements ,of .California Environmental Quality Act Guidelines, Section
15083 have' been . satisfie.d and hereby incorporates . by reference the
Negative -Declaration adopted by the . Planning Commission on January
11, 1982 gas its Item 11.680.
