BLUD,. WHEREAS, by Ordiiiarice No. 1263 N.C.S. ,',Asse_ssor's ParceTs No. 007-510-38 was rezoned.to P:U.D., (P~lanned Unit District).; and, wHEREAS, by actiom~"taken on February ;9, 1-982, th.e.Planning Commission recommended adopti:on of a revised final unit de~e.lopment plan for ~said Planned Unit 'Zorie,' . NOW, THEREFORE, BE-IT. RESOLVED that the revised final unit deveTopment plan on ~fi,le_ in~~'tYie. ' BE IT FURTHER RESOLVED THAT THE City Coun,cil hereby approves the development plan, subject to the hereinafter 'conditions: P.U.D. REZONING RECOMMENDED CONDITIONS C3.176) 1. All buildings on the subject.site (Parcel A) shall be setback at least forty (40) feet from adjoining single-family residential lot lines and at least twenty(20) feet from the future Washirigton Creek Channel right-of-way. 2. The developer must_ meet the requirements of the City Water Department for providing water for domestic, landscaping and fire protection purposes. 3. All mechanical equipment,.either on the roofs or adjacent to or near the buildings shall be fully screened. The screening shall be approved by SPARC prior to issuance of building permits. 4. The applicant must submit a detailed irrigation plan and , landscaping plan which is prepared by a licensed landseape architect identifying the number, type, location and size of all plants and trees to be used. These plans must be approved by SPARC prior to issuance of building permits. All trees will be a minimum of fifteen (15) gallons as per City standards. The landscaping at the co.rners of intersectioris must b.e of a height no greater than three and one-half feet to provide adequate sight distance. 5. The developer shall provide a six-foot high fence along the property line that wi11 separate the housing development from the St. James Church property and adjoining residences. Fencing shall be required along the access way off of 'Ely B1vd. North where it does not abut Parcel B. The proposed fencing plan must be~approved by SPARC. 6. An additional 13 on-site parking spaces sha11 be provided, designed to the approval of the Planning Department and shown on the development plan. Tfii~s.number of additional spaces will pr-ovide the same ratio as the nearby V,alley Orchards project at .64 spaces per unit. 7. Prior to insta'lling any signs, the applicant must obtain sign permits. 8. The developer shall make on'e-half street improvements to Ely Blvd. North £rom the western side of the private access' street to East Washington Street to the specifications of the C'ity Engineering Department. Improvements are to be shown on the deveTopment plan. Reso. 9438 Page 2 of 7 9. Four on-site fire hydrants shall be 'required per Fire Department specifications. 10. Fire warning detectors must be instalTed per Fire Department specifications. ll. A fire sprinkler sy.stem shall be installed in the Petaluma Gardens (elderly citizens apartment buildings) per Fire Department specifications. 12. Emergency vehicular access shall be provided to the south side of Petaluma Gardens (elderly citizens apartment building), per Planning and Fire Department specifications, and be clearly.shown on the development plan. 13. The access way to the senior citizen (Petaluma Gardens) portion of the project shall be des'igned; including road section, landscaping, irrigation, curbing, etc. to the approval of the Plann,irig, Engineering and Fire Departments, and shown on the development plan. 14. The developer must make improvements to Washington Creek from Ely Blvd. North to the southern_ property line of the subject site. The improyements shall be designed to Sonoma County Water Agency specifications. Dedication of channel right-of-way to Sonoma County Water Agency shall also be required. Improvements shall be shown on the development plan. 15. The fencing along the washington Creek Ch_a.nnel shall.be designed and installed subject to the review and appr.oval'by SPARC and the•Sonoma County Water Agency. 16. Revised si-te layout plans and architectural ele~ations (;showing all views of the buildings and materials and colors to be used) must be submitted for SPARC approval prior to issuance of building permits. 17. To insure that this use of the Petaluma Gardens (elderly citizens' housing complex) is restricted to housing for low income elderly, the applicant must record a deed restriction to this effect prior to issuance of any building permit•for the project. Change in the use of this pro..ject shall be subj'ect to an amendment to the PUD zoning prior to any change in occupancy. 18. A direct pedestrian path or walkway must be provided from the elderly citizens complex to the Ely Blvd. N,orth and East Washington Street intersection eitfier in the Sorioma County Water Agency right-of-way or across the church property. The path.shall be shown on the development plan. 19. A drainage easemerit must be provided over the Petaluma Gardens property for the adjoining Parcel B. 20. Two turn-around areas along the driveway must be provided; one at the dog-leg of the_ driveway and one at the property line which will separate Area A(Petaluma Gardens) from Area B.
