A RESOF~UTION APP.RO.VING A REVISION'T0, THE DEVELOBMEN,T PLAN"FOR
COUNT:RY .CLUB ES,TATES UNIT NO..l (~UNI~T lA) SUBDIUISION LOCATED
IN THE VICINITY OF MCNEAR AVE. &'GOUNTRY CLUB DRIVE.
WHEREAS, by Ordinance No. 1330 N.;C.S., the area represented by
Ass2ssor's Parcel Nos. 008-540-01 througti 63 .were rezoned,to Planned
Unit Development; and.;
WHEREAS, by aetion •taken on April 1'3, _1982, the Planning Commission
recommended revision of the final unit development plan in said Planned
Unit Zorie; ~
NOW,`THEREEORE; BE IT RESOLVED that the' r-,evised unit development
plan~ on fil~e .in the Office of the Community Development and Planning is
hereby approved as~the final Unit~Development Plan pursuant to Section
~ 1-9A-SO4 of Zoning Orclinanee No. 1072 N.C.S., as amended; and,
, BE IT,`FURTHER RESOLUED that the City Council hereby adopts the
•F'indings o~f' the Planning ~Commis:sion as its findings -as ~ set out
hereinafter: . '
l: The De~e•lopment.Plan c•learly resuT_ts,iri a;more desirable_use of
~ land and a better.physieal environment than would:be:possible uride:r any
single district.or combination of ,zoning distriets.
~ 2:_ The P:U.D. Distri.ct-i.s' proposed on property which has, a
suitable relationship to a thoroughfare; and sa~id.thoroughfare is
adequate to carry any additional traffic gerierated by the de~elopment.
3. The plan.for the proposed development presents a unified and
organized arrangement~of buildings and~.ser~ice,facilities which are
appropriate in reTation to~adjacent proper-ties; and_adequate lands.caping
is~included to iriswr-e compatibility
4.. The natural and scenic, q.uaTi'ties of' the si.te are.protected with
adequ'ate available public and pri~ate spaces designated on the Unit

BE IT FURTHER.RESOLUED that tlie C'itg Council hereby approves the

1. Site,de;sign xeview of laridscaping.arid architectur-al details of
the subdivision:sliaT`1 be~completed priror to, final map approval. Site
design review o'f :the ind'ividual custom homes shall occur.on a lot by lot

basis prior to buiTding permit issuance'and.may be referred to SPARC at
' the diseretion of 'the Community Development:Department. Conditions of

2. Construction of ~the pool, recreati:on building and parking
" faeilities shall be coinpl`e;ted to Gity sa:ti.sfaction.prior to occupancy of
50~; of the approved~dwelTing units or issuance of'the•40th building
permit, whichever• comes first. Jo'int use of "all facilities by the

3. AT1 of Winding~Ridge Drive should be dedieated as a public

4. Final utility.'Tine'locations and public `improvement plans will
be subj°ect to Community Development:Director and.Ci`-ty Engineer approval

5. The following condition of unit devel9pment approval in 1978
shall also.apply to this pian:

6. In brder for this project to be found~consistent with the
Petaluma General Plan, a.riotice will be~re.cord'ed on the remaining 50±
acres to be deveLoped (A:.P. Nos: 008-472.=;03; 04 and 05) stating that a
density transfer:of 20;dwelling units has oecu•rred from those
properties. Terms:of th'is notice shall be approved by the City Attorney
and Community Development and Planning Department prior to a recor'dation
in conjunction.with the final map.
7. The Corid`itiqns, Co~;eriants and Rest"rictioris for• the

single-family lobs shall include tfie follow,irig requirements:
a. Roofing: Materials should be restricted to fire resistant
materials and approved,by SPARC.
b. •Colors:: Limit colors to earth tone varieties.
c. Lot Gradin:g: Exclusive of the-.grading approved in
conjunctiori with tlie subdi"vision improvement plans, cut and fill
. associated ~witfi'- uni;t ;coristruc`tion` should' ,be ~ held to the miriimum
~ necessary to me"e"t°d'riveway'and'foundation requirements. Hillside
grades should be kept as natural.as possible, w,ith the unit

~ Country Club Drive,.. Lots with property.lines along_the southerly
and northerly perimeters'o'f~the site (Lots 2=10:, 23, 29, 30 and 3.2)

h. Provisions o`f maintenance of on-site common areas, paths,
turf block and private street areas.
i. Limitations on,the parking and type of iandscaping allowed
in the turf blo:ck areas. ,
The adequacy of the details and language of the above items as reflected
• in the Conditioms, Covenants~and Restrictions shall be suk~ject to tYie
review and approval of the•Community Development Department and the City
Attorney. • ~
8. No parking signs shall be placed along the .street right-of ways
throughout the.subdivision except on the westerly (downhill) side of
~ Winding Ridge Driye.. .All street sign details shall be satisfactory to
the C'ity Public Works Department. .
. BE IT FURTHER RESOLVED that the City Council finds that the
reguir_ements of California.Environmental Q.uali,ty Acf Guidelines, Section
15083 have been satisfi.ed and hereby incorporates by reference~the
Negative Declaration adopted by Council..Resolution 9441 N.C.S. on May
3, 1982. .
