HomeMy WebLinkAboutResolution 2014-139 N.C.S. 9/8/2014Resolution No. 2014-139 N.C.S. of the City of Petaluma, California EXTENDING THE SONOMA COUNTY AUTHORITY FOR ABATEMENT OF ABANDONED VEHICLES AND $1 VEHICLE REGISTRATION FEE TO FUND ABATEMENT, REMOVAL, AND DISPOSAL OF ABANDONED, WRECKED, DISMANTLED, OR INOPERATIVE VEHICLES OR PARTS OF VEHICLES FROM PRIVATE OR PUBLIC PROPERTY UNTIL APRIL 30, 2025 PURSUANT TO CALIFORNIA VEHICLE CODE SECTION 9250.7, SUBDIVISION (G) WHEREAS, California Vehicle Code section 22710 provides for formation of service authorities for the abatement of abandoned vehicles and imposition of a $1 vehicle registration fee to fund abatement, removal, and disposal of abandoned, wrecked, dismantled, or inoperative vehicles or parts of vehicles from private or public property; and, WHEREAS, formation of an authority for abatement of abandoned vehicles pursuant to Section 22710 requires adoption of resolutions providing for establishment of the authority and imposition of the fee by a 2/3 vote of the board of supervisors of the county in which the authority is to be created, and a majority of the cities having a majority of the incorporated population within the county; and, WHEREAS, in 1995 the Sonoma County Abandoned Vehicle Abatement Service Authority was formed pursuant to California Vehicle Code section 22710; and, WHEREAS, the City of Petaluma Police Department has been a member of the Sonoma County Abandoned Vehicle Abatement Service Authority since 1995; and, WHEREAS, the City of Petaluma's participation in the Sonoma County Abandoned Vehicle Abatement Service Program has resulted in essential annual funding enabling the Petaluma Police Department to adequately manage the ongoing and significant problems associated with abandoned vehicles within the City of Petaluma; and, WHEREAS, the Sonoma County Abandoned Vehicle Abatement Service Program contributed $69,272 during FY 13/14 and allowed for the abatement of 989 vehicles during the same period of time; and, WHEREAS, pursuant to California Vehicle Code section 9250.7, subdivision (g), fees imposed by service authorities under Section 22710 only remain in effect for a period of 10 years from the date that the actual collection of the fee commenced, and the Sonoma County Abandoned Vehicle Abatement Service Program fee is set to expire in 2015; and, WHEREAS, Section 9250.7, subdivision (g) allows for extension of fees imposed pursuant to Section 22710 for 10 year periods, if the board of supervisors of the county, by a two-thirds vote, and a majority of the cities having a majority of the incorporate population within the county, adopt resolutions providing for the extension of the fee; and, Resolution No. 2014-139 N.C.S. Page 1 WHEREAS, it is beneficial for the City of Petaluma for the Sonoma County Abandoned Vehicle Abatement Service Program and the $1 vehicle registration fee to fund abatement, removal, and disposal of abandoned, wrecked, dismantled, or inoperative vehicles or parts of vehicles from private or public property to continue in effect for another 10 -year period. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The Petaluma City Council hereby approves extending the Sonoma County Abandoned Vehicle Abatement Service Program and the $1 vehicle registration fee to fund abatement, removal, and disposal of abandoned, wrecked, dismantled, or inoperative vehicles or parts of vehicles from private or public property originally established in 1995 pursuant to California Vehicle Code section 22710 for another 10 -year period in accordance with California Vehicle Code Section 9250.7, subdivision (b), until April 30, 2025.
