JLS:cw 6-1-82 ; . of the City of Petaluma, California RESOLUTION RATIF`YING MEMORANDUM OF UNDERSTANDTNG E~XECUTED BY THE DULY AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND THE PETl1LUMA PEACE OFFICERS' ASSOGIATION FOR EMPLOYEES IN UNIT 6 Ir1HEREAS, The City, through its duly au:thor,ized representatives, and the Petaluma Peace Officers' Association thrbugh its duly authorized representatives, have.concluded their mutual obTigation to meet and confer in good faith with re`spect to terms and conditions of employment for the employees in Unit 6, i;n accordance with the Meyers-=Milias Brown Act and the City's Employer-Employee Relations Rules and Regulations (Resolution No. 5512 N.C.S.); and; WHEREAS; the duly authorized representatives of the City and the Petaluma Peace Offic.ers' Association, have executed a Memorandum of Under- standing.(dated June 11, 1982) pursuant to Section 15, Resolution No. 5512 N.C.S. and recommend its approval by the C'ity~Council; and, WHEREAS, the City Manager, pursuant to Section 28, City of Petaluma City Charter, and as the City's Municipal Employees Relations Officer (Resolution yo. 5375 N.C.S.) is required and empowered to make a recommendation to the City Council on matters related to employees' compen- sation; and, WHEREAS, the City Manager has reviewed.and concurs with said i~lemorandum of Under.staading for Unit 6, and does recommend that the City Council ratify said Memorandum of Understanding. NOW, THEREFORE, BE IT RESOLVED that said Memorandum of Under- standing, being in the best~interest of .the City, ~.i:s ratified and the terms and conditions of said Memor.andum of Understanding (as attached) shall be effective July 1, 1982 through June 30, 1983. ''~. ;~y. ~ ~; ~' . . . ~ .- MEMORANDUM OF UNDERSTAND'ING ~ Between THE CITY OF PETRLUMA _ ~ And ~ PET,ALUMA PEACE OFFICERS' ASSOC'IATION ' This document represen,ts the final' and complete agreement resulting from Meet and Confer sess:ions between the Ci`ty of Petaluma and the Petaluma Peace Officers' ~ Association, Unit 6. ~ Representatives of the C'ity and Unit 6 acknowledge th'at they have fulfilled their mutaal and respective,obligations to Meet and Confer under the Meyers- Milias-Brown Act. As a result, the parties,;have c'ome to a mutual understanding which the representatives of the City and' Uni"t 6, who h"ave the approval of their members, agree to recommend for acceptance and~a:pprovaT of the City Council of the City of Petaluma. The parties affix their signatures as constitut:ing mutual acceptance and recommendation of this'Memorandum of Understanding to become effective July 1, 1982, upon acceptance and appro"val of the City Council. Section l. Term of Agreement This Memorandum o.f Understanding shall be for a one (l) year: term for the fiscal year commencing July l, 1982, throu,gh June 30, ]:983. Section 2. Servabili°ty The parties will commence`meeting and conferring for 1983-84 fiscal year not later than the end of April 1:983, and wiTl endeavor to reach,an agreement, in a written Memorandum of Und'erstanding for submi'~ssion to the City Council for its determination, prior to the adoption by the C'ity of its Final Budget for the subsequent Fiscal Year.. . Section 3. Workweek ~ ~ A work week shall consist of forty (4:0) hou,rs worked in o.ne week, based upon a fifty-two (52) week year. Aq on=duty work day may consist of eight_(8) hours per day in each of ~five (5) 24-hour days, or ten (10') hours per day in each of four (4) 24-hour days. The Gi~ty solely de:termines and administers all requirements, practices and procedures, relat~ed~to., f_or examp'le, scheduling, rescheduling, shifts, watches, assignments, ho.3idays and othe`r- matters related thereto. (a) Police Offie'ers in. the patrol di.visi.on shall be . placed onto a four (4) ten (10) hour work day July 1, 1982, through June 30,~~1983. ('b). Further, Police Sergeants i'n the patrol divisi~on. may be placed onto a four (4) ten (10) hour work day. (c) Upon t'he hiring of a ninth f,ull-ti_me regular Communications Dispatc<her-Clerk, the mana:gement of the po,lice department will reconsider the feasibility and desirabili;ty of a 4-10 plan for Communications D'i:spatcher-C1 e:rks. Police Officer Working In a Hiqher Glassification When a Police_Officer is assi:gned to perform t'he duties of a Sergeant for a period of four (4) hours or more by the Ch"ief of Poli:ce or a Lieutenant ~ or the Watch Sergeant of the preceeding shift when the C,hie.f or Lieutenant is no't on duty; he sha,ll be paid at Step I of the Sergeant salary classification. If the Watch Sergeant o.f th"e;preeeeding shift, the~Ch~ief, or Lieutenant is unavailable due to unforeseen cir'cumstances and it is necessary for an officer to perform the functions o,f a Sergeant, the Chief or Lieutenant may grant subsequent approval"during his next normal work s,hift. Any overtime performed by a Police Officer while he:or she is entitled to pay at the Sergeant rate,, s°hal~l.~be "compensated at one and one-half (1-1/2) times the applicable Sergean't rat'e of pay. Section 9. Field Trai.n;in,g Offi:cer Police Officers who are des`ignated Field Training Officers shall receive 5% above their normal sal:ary for any pay period.in which they sqend at least 40 compensable working hou'rs field training a new pol'ice officer assigned to them. Section 10. Sergea,nt_ Pr-omotions ~. Upon promotion to Sergeant;, Poli'ce Officers an Step V o,f the sal~ary scale shall be placed in~Step II of the Sergeant salary scale. A11 other Offi'cers promo`ted to Sergeant shall be'Placed in Step I of the Sergeant salary scale. . Section ll. Compensato_ry T;ime Off An employee may recei.ve, i;n lieu of being.paid for overti~me, compensatory time off at a mutually agreeable time_between the City and the employee. Such compensatory time off may be acerued uP .to a maxi~mum of thirty (30) hours for those employe'es in sworn classifications and twen.ty-four (24) hours for those employee's in non-`sworn classificati?ons.~Amounts earned in excess of that will be paid. ~Such compensa,tory ti'me off shall be used for personal activities. on'ly. ~ . Section 12. .Poli'ce Educati,onal Incentive Pay Program A. This Program encourages employees in specific classafications to acquire and to maintain educational achievement. B. Life Ins'urance The City shall Provid;e,~at no cost to the employee; group. term life insurance coverage in the pri•nci`pal amount of $7,500 per employee.~ Section 17. Long Term Disability Insura,nce - :: The City shall pay during `fisca.l year 1982=83, the mo;nth'ly premium for the PORAC Long Term Disability Plan for all Poli'ce 0;ffi~cer.s~and Sergeants; provided, however, th'at the total amount paid by the Ci~ty in connection with LTD.shall not exceed $18:20 per month for a'ny employ.ee. During fiscal year 1982-.&3, the City will pay $7.00 per month toward Long Term Disability coveraQe for non-sworn personnel in U,n'it 6. . Section 18. Holiday, General The City of Peta]uma sha'll grant a total of ten (l0); holidays to the emPloyees in Unit 6. The City shall pay for these hol,idays in the month of December, in lieu of giving time off. . If.an employee works only.,part of a.year., due to resi::gnation, terminat.ion, retirement, or disability,~he or she will be entitle'd to a prorata share~of the ten holiday payment based upo,n the portion of..the year t'he.employee worked. Section 19. Holiday, Floating 'The City will provide one (1) "Floating Holiday".of eight (8) hours per employee, per fiscal year for empToyees assi',gned;~to work eight (8) hours per day, which may 6e taken by the empl.oyee at a t.ime mu.tuall.y .agreed upon by the employee~and the Po;lice Chief, consistent with operati'onal needs. The City will provi.de one ,(1) "Floa'ting Holiday" of ten (10} hours per employee per fiscal year for employ,e:es assigned to~wo'rk ten (10>)`~hours per day, which may be taken by the empl~oyee at a time mutual`ly agreed upon by the employee and the Police Chief consistent with operational needs. The appropriate hour"s, ei:ght (8), or ten (10) will~be determined by the hours per~day.being worked at the time the "Floating Holiday" is taken. EmPloyees hared between Jul'y 1, 1982, and December 31, 1982, will be eligible . for a F1oating Holiday duri:ng the~course of the 1982-83 Fis:cal Year.
