C: S. of the Gity of Petaluma, CaTifornia ' J'LS : ew 6-~1-82 RESOLUT`ION RATIFYING MEMORANDUM OF UND,E'RSTAND,I,NG EXECUTED BY THE DIJLY ' RUTHORIZED REP;RESENTATIUfS OF THE CITY OF PETALUC~A.AND THE INTERNATIONAL ASSOCIATION OF 'FIRE FIGHTERS, LOGAL 141.5 FQR}.EMP,LOY.EES TN UNIT 7 WHEREAS, The City, through its duly authori-zed representatives, . and the International ~Association of Fire Fighters, Local 1415, through its duly authorized repre'sen'~tatives, have concluded 'their mutual obligation to meet and confer in good faith with respect to terms and conditions of employment for employees in Unit 7, in accor.da`nce with the Meyers-Milias- Brown Act and the City's~Employer-Employee Relations Ru'les and Regulations (Resolution No. 5512:N'.C.S.); and, WHEREAS, th,e-dul,y au_thorized representataves of the City and International Associ.a;t'i~on~bf Fire Figh:ters,.Local 1415 have executed a. Memorandum of Understa~nd'i''ng (dated June 11, 1982) pur.suant to Section 15, ResoTution No. 5512 'N.G.S, and recommend its approval by the City Council; and, WHEREAS, the City Manager, pursuant,to Section 28, City of Petaluma City Charter, and as the City's Municipal Employees' Relations Officer (Resolutio~n No.~ 5375 N.C.S.) is required and,empowered to make a recommendation to the City Council on matters related to employees' compensation; and, WHEREAS, the City Manager has reviewed and concurs with said Memorandum of Understanding for Unit 7 and does reeommend that the City Gouncil ratify said Memorandum of Understanding. ~ NOW, THEREFORE:, BE IT RESOLVED that said Memorandum of Under- s.tanding being in tfie bes_t interest of the Gity,. is ratified and the terms and conditions of sai.d•Memorandum of Understan'ding (as attached) shall be e.ffective July 1, 1982.through June 30~, 1983.. Representatives of the C,ity and Unit 7 ac,knowle:dge tha,t they have fulfilled their mutual and respecti°ve obligations to Meet and Confer under the Meyer- Mili"as-Brown Act. As a result;: the parties have come to a mutual under- standing which the representativ;es of the City and Unit 7, who have the approval of their members, agree to recommend for aeceptance and approval to the City Council of th`e City of Petaluma: ~ The parties affix their signatures as consti~tuting mu,tual acceptance and recommendation of this Memo;randum of Unders,tandi_ng to become effective July l, 1982, Upon accep:tance `and approvaT of the Gity Council. Section 1. Term of Agreement This Mer~orandum of.llnd'er,standing shall be for a one (l) year term for this fiscal year commencing JuTy 1, 19~2, through June 30, T983. The parties will commence meeting and conferring for`1~983:-84 fiscal year not later than the end of April, 1983, and will endea.vor to 'reach an agreement, i~n a written Memorandum of lJnderstanding for submission.to the City Council for its Final Budget fo:r tlie subsequent fisc"al year. Section 2. Work Week' Duty Shifts: The fire on-duty 7 day.wor-k week shall be ~the.average of 56.0 hours per fire on-duty 7 day work week for all employees in this Unit. ~ Section 3. Living Re_striction The living restricti.on for members of the.City-'of Petaluma Fire Department shall be 'twenty (20} minu;tes. A map w~ll be prepared `and made available which illustrates the extremities of the res•tri'ct~on. Section 4. Section 7. Uniform Allowance All employees shall comply with the uniform/clothing :requirements and procedures as established and administered by the Fi`re.Chief. The Uniform/Clothing Allowance Program shall be paid i.n fiscal year 1982- 83, on or before Sept:ember 5, 1982, for.those employees in the classifi- cation of Firefighter and Fire Captain in the amount of 1% times the annual rate of pay of a Step V Firefighter, per year. This shall be paid on a separate check from the p;ayroll oheek. Employees hired on.or after August 31, 1982, and prior to July 1, 1983, shall be paid the full annual payment amount on or before July 5, 1983. An employee who terminates from City service or is rel.eas'ed from City service shall only receive a pro rata annual amoun.t. An employee who so separates from City service after any payment has been made shall return that portion of the all~owance determined by the last day in City service and the end of the fiscal:year. Any employee on le'ave of absence without pay or leave status in excess of thirty (30) calendar days shall receive a pro rata amount for'the fiscal year. Section 8. Health Tnsurance The City shall provi.de for a group medical-~liospital insurance coverage program for City empl~oyees~in this unit, The Gity shall pay, during 1982-83 the following insurance premium amounts toward the folTowing medical- hospital insurance coverage programs: Sonoma Coun`ty He"a9th Plan: Health Plan of the'Redwoods and Kai:ser. Dental `Insurance The City shall provi:de for a group dental insur;ance program for City employees and dependents in this u'nit. Tlie City shall pay, duri`ng 1982-83, th~e insuranee premium in the amount of $35.56 per employee, per month. Section 10. Life I,nsurance The City shall p.rovide, at no cost to the empl:oyee., group term life insurance coverage in the pri''ncipal amount of $7,500 per employee. Section 11. Long Term Disability Insurance The City shall pay during fiscal year 1982-83, the amount of $15.00 per month, per employee. A wr~itten~report of each deferred vacati,on signed, by the~appropriate department head and the P'e,rsonnel Offi,cer noting the detaiTs shall be kept on file with the Personnel Officer. ~ The times during the calendar year in which an`empl.oyee may take his vaca:tion shall be determined 6y the departriient head wi'tfi due respect for the wishes of the employee and particular r.egard for the needs of the service. If the requi`rements of the service are such~t'hat an employee cannot take pa'rt or all,of hi.s annual vacation in a part.icular calendar year, such vacati~on s:hal:l be taken during the following calendar year. New employees shall be allowed to ase the:ir ac:cumulated vaca.tion prior to December 31st'fo,r vacation in the succeeding calendar year. Section 19. Retirement The City will implement:its contract with PERS to provide the. 2% at 55 Retirement Plan without:changing the ourrent benefits. Section 20. Educa:tion The City shall reimburse employees of this unit for books and tuition upon the satisfactory completion of the course. To be..elig:ible for~reimbursement, the course must be (2) fire ser.vice related, (.b). approved by the Chief, and (c) completed at a Jun,ior Co.ll"ege or Indi.an Valley Col1ege.
