AND ACORN,~ DRI~IE WHEREAS, by Ordinance No. 1507 N.C.S., Asses;sor's Parcels Nos. 4'8-I41-42,: & 43 were ;rezoned~ to P U.D.', (P~lanned-;Unit~ pe~elopment) ; and ~ WHEREAS, by a'ction taken on January 12, 1982,.the Planning Commis'siori reeoinmended adoption o,f _ tfie f'inal unit~ development plan in said Planned Uri•it Zone, • ~ . ~ . NOW, THEREFORE, BE' IT~ RESOLVED~~ th'at ;firia'1 unit development plan on file in the Office of Community Development and Planning is hereby approved pursuant to 5ection_ 19 A-5Q4 of Zoning Ordinarice No. 1072 N.C.S., as.amended'; and, BE IT FURTHER RESOLVED tha•t the Gity Council hereby adopts the findings of the Planning Commis.sion as its find=irigs,as stated hereinafter: . l. Said.plan clearly results iri a more desirable use of land and a be"tter physica~l erivironment.th,am would be,possible under any single zoning district or combination of districts. ~ 2.. That the Planned U'nit District is proposed on p'roperty which has a suitable relationshi'p 'to one (1,) or..mor-e; th'oroughfares; and that said thoroughfares-ar-e:'adequate to carry ariy~additiorial traffic generated by the development. 3. That.the plan for •the~proposed~developinent presents a unified ~and o.rganized arrangement of the buildirigs' and,servi.ce faeilities which . ar-e~appropriate in relation'to adjacent or nearby~properties~and that adequate, laridseapirig ar-d/,'o "r screening is included' if necessary. to insure compatibility. 4. That the riatural and scenic qualities of'tYie site a~re protected ` - ,. with adequate.a~ailable:public and priyate spaces designated on the Unit Deve`lopment Plan. • ~ 5. That the developinent of the sub.~,eet property, in the manner proposed by the applicant, will not be detrimental to the public welfare; wi11 be iri the best in-terests of the City~.and will be in keeping witli the gener•al intent arid spirit of the .zoning regulations of the C'ity of,Petaluma,, with the Petaluma General Plan, and with any applicable Environmental Design Plans adopted'by the City: Reso. 9374 Page 1.~of 3 BE IT FURTHER RESOLVED THAT T-HE City Gouncil hereby approves the development plan, subj'ect. to,the hereinafter conditions: 1. Call out on development plan perzme:ter feneing desiqned to the . :, . approval of S.P.A.R,.C. (-Site Plan and Architeetural Review Committee). 2. P-roject CC & R''s and'. Homeowners. Associat"ion b,y,laws shall -be submitted prior to final appro~al of~ariy tentative map ,for the project and be subject to approval,by the>City Attorney'and Community Development and Planning~Director•prior to appro~al of any final map. . 3. The project shall.be subject to design approval by the S.P,•A.R.C,. Committ'ee in,aecordance witYi Section-26=400 of the Zoning Ordinanee. Approval "shal-1 be accomp'lYShed prior to approval of a tentative map. Conditions shall be incorporated as conditions of the development plan. . ' 4. Minimum setbacks for all buildirigs shall be consistent with R-1-6,.500 zoning district unle'ss,otherwise.shown^`on the.approved development plan. ~ , 5. All dwelling units shall be designed.to the approval of the Community Development and`Planning Di,rector •fo insure interior sound levels from.exterior noise sourees do not exceed'45`DBA in habitable rooms and 40 DBA in bedroom areas. The development plan shall indicate an,und'erground'drainage sy_stem to carry water from the fill slope which drains toward the ~ Kilbridge and,.Cincera properties. 10.
