C.,S, -~ of the Gity of Petalurna, California RESOLUTION APPROVING TENTAT~IVE SUBDIUISION MAP FOR MADISON MANOR' SUBDIVISION' '(Vicirii~ty~ Madison Street and Burli:rigton Drive) ' WHEREAS, Paul Hillesheim as owner and Subdivider had filed with this Council a tentati~e map:proposing to subd:ivide land within this City to be known as Mad=i'son Manor Subdivision,, an'd has pa'id all required • filing fees; and, _ , , ~ ~ - ~ WHEREAS, the City' Engineer, the Direc'tor of Planning, the Sonoma County Water Agency;'.'and.the;P~Lanning Commission ha:ve examined andf ~ . . ; , .. . revieiaed the same as required by law and all reports, recommendations, . , and _commeiats therebn have been forwarded to.`and.considered by the Council at i'ts meetirig held on Ee,bruary 22;; 1982; ' • '. . . , • . . . _ . NOW, THEREFORE., BE IT RESOLUED that th~i"s Council hereby finds as f'ollows: ' l. The,proposed subdivision; together with provisions for its design and imp"ro~ements;, is consistent with~th'e General Plan. 2. The proposed subdivision is c,ompatible'with the objectives, policies, general-.Yand uses, and programs speeified in sa'id General Plan. ... ~3_. The.site is physically suitable for the type of development ~ proposed. 4. TYie ;site is physically sui.table for the proposed density of deve l opme n~t;. . _ 5. The design of. the Subdivision and the propos.ed improvements therefor- will not cau'se substantial environmental damage', and rio . Res o. 9386' substantial or avoidable injury will occur to fish or wildlife or their habitat. 6. The design.of the Subdivision and the type of.improvements will not cause serious public health problems. 7. The design of the Subdivision and the ty:pe of improvements proposed will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. ~ ~ 8. The discharge of waste from the proposed subdivision into the existing community sewer system w:ill not result in violation of the existing requirements prescribed by the Regional Water Quality Control Board. 9. Tfie design of the subdivision for which the tentative map is required provides to the extent feasible, for future passive or natural heating or cooling opportunities in the subdivision. BE IT FURT-HER RESOLUED, based on the findings set forth above, that the above referred to tentative map, be and the same is hereby approved subject to the conditions set forth below and incorporated herein. 1. In order to receive a housing allotment exemption for the project, "not more than fifteen (15) housing units may be cons:tructed in any one (1) construction year, 2. The project shall be subject to the site plan and architectural review in accordance with Section 26-400 of the 'Zoning Ordinarice prior to Final Map approvaT. 3. Any required relocation of the P.G. & E. overhe:ad 12 Kv primary and 6'0-Kv transmission pole line along Madison Street shall be done at the developer's expense. 4. Grading and drainage design shall be subje'ct to approval by the Sonoma County Water Agency. 5. The right side property line of Lot l2 shall be increased in length to mea5ure ninety-five (95) feet. - ~ Reso. 9~386 Page 2 o.f 4 6. Six (6)• foot high decorative, view obscuring; wood fencing shall be provided on all lots to enclose yard areas~behi.nd.the building 'front walls in accordance with the setback requirements specified in the Zoning Ordinance. Wherever fencing already exists, the Community DeveTopment Department shalT determine which_ measures should be taken. 7. The CC'& R's (Conditions,. Cpvenants a~nd.Restrictions) prepared for the project sha11 be sul~ject to approval by the City Attorney prio"r to Final S'ubd~ivisiori Map approval. 8. Parcels-shall.be correctTy numbered, AlI f-ront'yard setback ~ ~ lines shall be shown;on pl.ans. Gross density, £igures shown on the : °Planimetric'Calculations" ehart shall..be correct'ed.
