C..S- ~ ~ of the City of Petaluma, California RESOLUTION P;PPROVIIVG THE 'DEVELOPMENT, PLAN FOR WINDMII;L (NIZIBIAN) SUBDIVISION IN THE VICINITY OF CANYON' DRIV~E -OF;F MT. VIEW AVENUE ' WHEREAS, by Ordinance No. 1506 N.G'.5.,. Assessor's Parcels Nos. 19-232-06,16,19,20, were rezoned to P.U.D., (Planned Unit Dev- elopment); and WHEREAS, by action taken on March 9, 1982, the Planning Commission reccommended adoption of the final unit dev.elopment plan in said Planned Unit Zorie. NOW, THEREFORE, BE IT RESOLVED that the -final unit development plan on file in the Office of Community Development and P.lanning is hereby.approved pursuant.to Sect'on 19•A-504 of Zoning Ordinance No. 1072 N.C.S.., as amended; and, ~~ BE IT FURTHER RESOL~IED that the City Council hereby'finds and declares as follows: 1. Said plan e:learly results in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination ;of districts. . 2. The Pl`anned Unit District is proposed on property°which has a suitable relationship to;a thoroughfare; ~and~sa`id"thoroughfare is `, adequate to carry any, additional~traffic generated~by the d.eyelopment: '' , , y, : . , y , . 1 . - _ p .1' '. The -plan;~ for the 'proposed ;development ,presents a unified and . organized arrangement of the buildings and 'service facilities which are appropriate in relation to adj,acent prope'rties,,. and adequate landscaping is included to insure compatibility. , . . 4. The natural:and scenic?"qualities of~the.s~ite are protected with.adequate available public and,,priyate space"s designated on the Unit Development Plan. 5.: The.de~elopment of the subject property,,in the manner proposed by:the applicant, will not be detrimental to the public ~ • - RES~O 9394 NCS 1 of 4 welfare, will be in the best interests of the City and wi:ll be in keeping with the general intent and spirit of `the~zoning regulations of the City of Petaluma, with fhe Petaluma General Plan, and with the Environmental Design Plan. BE IT FURTHER RESOLVED THAT THE City Council hereby approved the development plan subject to the conditions set out hereinafter: 1.~ Project CC & R's shall be submitted prior to final approval of any tentative map for the project and be subject to approval by the City Attorney and Community Development and.Planning Director prior to approval of any final map. 2. Development landscape plan shall-indicate lawns or mix of ground cover, shrubs and trees for all units in al1 yard areas fronting streets. A mix of landscaping materials shall be required for each lot, approved by SPARC, and installed prior to occupancy of each dwelling unit. The density of planting materials sha-11 meet City landscaping standards and shall include street trees as required by City Code. 3. The project shall be subject to design approval by the S.P.A.R.C. Committee in accordance with Section 26-400 of the Zoning Ordinance. Approval; shall be accomplished pr.ior to approval of a tentative map. Conditions shall be incorporated as conditions of the development plan. 4. A permanent maintenance mechanism shall be established for the ` proposed stone walls at the Mt. View Road entry and any other common improvemen'ts. The walls shall be relocated out of the public right-of-way. 5. An erosion control and soils report pian shall be deveToped and approved prior to the tentative map submittal and be subject to approval of the Community Development and Planning Department and Planning Commis s ion . 6. A drainage study shall be condueted to determine if the Mt. View Road drainage system will be.overtaxed as a result of this project. Necessary improvements shall be reflected on the ten~tative map. Study to be completed p.rior to tentative map ,submittal and be subject to approval by the Communify Development and Plannirig Department and Planning Commissi:on. _ 7. The development plan shall clearly specify building env.elopes and setbacks for each lot. 8, If the existing house and,barn are not removed, the development plan should be revised to make sure they do not straddle the proposed lot lines. 9. As a custom lot subdivision, floor plans and exterior elevations shall not be repeated. The development plan and applicable CC & R's shall include all architectural design parameters proposed by RES0;9394 NCS 2 of 4 • BE IT FURTHER,RESOLUED .that the.City Council finds that the requirements of California Environmental Quality Act Guidelines, Section '15083 have been satisfied and hereby in'corpor"ated by reference the Negati~e Declaration adopted by'Council Resolutiqn'No:9365 N.C.S., on February •1, 1982. _ _ ~ , ~ _ ^ : _ . . .
