INITIATION OF PROC~DINGS FOR AI~EXATION P.URSITANT TO THE MUNI-
CIPAL ORGANIZATION ACT (GOVE'l~~ENT CODE ~§~A35000 et seq. )
Wf~REAS, pursuant to the l~7unicipal Organization Act, c~ncing with
Government Code §35000 et seq.:an affected city, as;there defined, may,
upon resolution adopted by its legislative body, make a proposal for annexa-
tion and request initiation qf proceedings therein:
NOW, THEREF'ORE, BE IT RESOLVED that the City council hereby proposes,
defines, declares and requests as follaws: ~
l. Application for anne~ation is hereby made pursuant to Part 2,
Division 2, Title 4 of t'ne Government Code, more particularly described as
the Municipal Organizatiori Act (c~ncing with Government Code ~ 35000).
2. The annexation shall consist of the inclusion, addition, and
annexation of the following Assessor's Parcels to the cor~orate boundaries
of the City of Petaltuna.

FINDINGS AND STATIIKII~T OF FACTS
~l) Air
The Old Adobe/Frates Ranch Final Environmerital Impact Report identi-
fied significant potenti:al air quaiity effects resul:ting fram the proposed
project.
These effects were considered in City Council Resolution No. 9265 N.C.S.
dated August 24, 1981 wherein a statement of overriding considerations was in-
cluded.
2 ) Water
Effect - Increased Surface Runoff and Sedainentation. Site sed~mentation
characteristics, while not severe, are im~ortant because of the potential for
a significant c~nnulative sediment discharge due to the large site area. Sedi-
ments would be transported into t:he local and regional drainage nets, ultimate-
ly entering San Erancisco Bay via the Petaltmia River.
Effect - Potentials for Flooding arid Degradation of Onsite Stream
Channels. Increases in surface runoff from paved surfaces and buildings would
increase :Elows in Adobe and Ellis creeks, thereby increasi,ng potentials for sea-
sonal flooding and stream channel erosion, and,. as a result, increasing long-tezrn
sedi.meaztation attributable to the project.
Effect - Long-Term Water,Quality I~acts. Local surface water quality would
be influenced in the long-term by 2 factors: increased pollutarit loads in run-
off from added urban surfaces. Urban pollutant loadings originating from
project urban_su~aces and golf course fertilization could increase the tota:l
Petaltuna River loadings by about 5 percent.

Finding - Changes have been incorporated into the project which would mitigate
the above mentioned significant environmental effects identified in the Environ-
mental Impact Report.
Statemerit of Fact - A surface water quality and sedimentation control plan is
r-equired as a condition of the Planned Co~nunity Development prezoning. Said
plan must be reviewed and~approved by key agencies having jurisdiction in these
matters, prior to issuance of gracling or building perniits..
3) Land
The Environmental Impact Report identified two unmitigatable significant
potential land impacts resulting from the proposed project.
City Couricil Resolution No. 9265 N.C.S., dated August 24, 1981 considered
significant effects of urban area expansion and conversion. of productive agri-
cultural Iand to non-agricultural uses and made appropriate findings and state-
ments of faets regarding said effects.
Effect-The Tolay tault, classified.as "pot~-ntially active," appears to
traverse the portion of'this site proposed for golf course use. Potential
.u~acts include surfaee rupture of golf course grounds. ~
Effect - Anticipated future earthquake activity from active faults in
the region could cause severe groundshaking and localized failure of creek
lx~nks. Potentials for lateral spreading, compaction, lurehi.ng and liquefaction
are considered law. Although it is possible that material suspectible to
liquefaction or compaction is present within the a.lluviLUn beneath the site,
there is no information available on conditions below 12.feet.
Fincling - Changes have been incorporated into the.project which would
mitigate `the significant environmental effects identified in the Environmental Iinpact
Report.
Statesr~n.t of Facts - Additional investigation and modification of plans to re-
flect findings'of said investigations have been required as a condition of the
Planned Community Development prezoning. Investigation~and any plan modifica-
tion reqiuired would be completed prior to issuance of any grading or building
permit.

'4) Minerals - No significant adverse effects..
5) Flora
Effect - Limited realignment, to Ellis Creek and it"s tributary could
result in significant effeets on riparian vegetation and wildlife. Likely
alternatives would be corist:xuction of localized channel grotection devices,
necessitating limited vegetation removal. The greatest amount of vegetation
removal would occur at tlie junction of E11is Creek and its tributary where
a realignment of the channels is proposed.
Finding - Changes have been incorporated irito the project which would ~
mitigate the significant envirorimental effects identified in the Environmentai
I~act Report.
Statement of Facts -
Project plans have been altered to avoid realigrunent of Ellis Creek. A
creek preservatian and improvement plan has been required as a eondition of the
Planned Co~rnuzity Development prezoning. The plan will be reviewed by the State
Fish arid C'~ame Departsnent arid approved by the Planning' Commission.
6) Fauna No significant adverse effects. •
7) Noise
Significant adverse effects have been ideritified, however, only the resi-
dential port.ion of this project will be affected. Specific effects, tYie rec~uisite
findings and facts will, therefore, be addressed,at such time as the residential
Planned Uriit Development rezoning occurs. ~
8) Objects of Histor-ical.Significance.
Effect - Location of`the golf course near the Petait:una Adobe would en-
hance recreation experiences for users of the golf course, but could detract
from recreational experiences at tlie historical mpnwnent.

Statemerit of Facts - As a condition of the Planned Corrnrnznity Develo~xnent
prezoning, special review will be conducted by the Planning Departinent to
evaluate landscape bufferirig along the perimeter.of the golf course in the
vicinity of the Petal~na Ad~be State Park.

develop storage,' pumping and distribution system to serve developed areas

Sewer - Project applicants will construct additional major sewer col~ection
system to serve a~11 areas of proposed development with major trunk line
south of Lakeville Highway.
Roads - Project applicants wil.l construct road improvements to Frates„
Ely, Old Adobe and Lakevil.le within proposed annexation area. Improvements
will include tra~ffic control devices as specified in traffic report.
Drainage - Projec't applicants will construct major drainage improvements
as part of development activity. This will include major reconstruction
of a portion of Adobe Creek.
Transit - Project applicants will provide transit stops as part of road
improvement program within af.fected territory.
