Resolution No. 9283 N. C. S. of the City of Petaluma, California A RESOLUTION OF THE'CITY OF PETALUMA MAkI`NG APPLICATION,TO THE SONOMA COUNTY LOCAL AGENCY FIORNIAT'hON .C`OMMISSION .REQUEST.ING INITIATION OF PROCEEDINGS FOR ANNEXATION.PURSUANT TO THE MUNICIPAL ORGANIZATION ACT (GOVERNMENT. CODE §§35000 et seq.) AND REPEALING RESOLUTION 9279 NCS_ WHEREAS, pursuant to the Municipal Organi.z'ation Act, commencing with Government Code §35000 et seq anaf f ec.ted ..-city , a: s _:there de- fined', may, upon resolution adopted by its legislative body, make a proposal for annexation and request initiation of proceedings therein: NOW, THEREFORE, BE IT.RESOLVED that the City Council hereby proposes, defines, declares and requests as follows: 1.1 Application for annexation is hereby made pursuant to Part 2, Division 2, Title 4 of the Government Code, more particularly described as the Municipal Organization Act (commencing with'Government Code § 35000). 2. The annexation shall consist of.the inclusion, addition, and annexation of the following Assessor's Parcels to the corporate boundaries of the City of Petaluma. 17-030-17 17-140-05 17-150-11 17-050-03 17-140-07 17-150-12 17,-050-04 17-140-08 17-150713 17-130-02 17-140-09 17-150-14 17-130-04 17-150-105. 3! A map containing a description of the affected territory is attached hereto as Exhibit "A" and incorporated by reference. 4 The City does hereby declare that the reasons for the proposed annexation., are as follows: (a) The project will.provide additional housing required to accommodate future planned growth. Subdivision �'�' � � - - lL a :EXE t a r41RIES 0. 928.3NCS, FINDINGS AND STATEMENT OF FACTS 11) Air The Old Adobe/Frates Ranch Final Environmental Impact Report identi- fied significant potential air quality effects resulting from the proposed project. These effects were considered in City Council Resolution No. 9265 N.C.S. dated August 24, 1981 wherein a statement of overriding considerations was in- cluded. 2) Water Effect - Increased Surface Runoff and Sedimentation. Site sedimentation characteristics, while not severe, are important because of the potential for a significant cumulative sediment discharge due to the large site area. Sedi- ments would be transported into the local and regional drainage nets, ultimate- ly entering San Francisco Bay via the Petaluma River. Effect - Potentials for Flooding and Degradation of Onsite Stream Channels. Increases in surface runoff from paved surfaces and buildings would increase flows in Adobe and Ellis creeks, thereby increasing potentials for sea- sonal flooding and stream channel erosion, and, as a result, increasing long-term sedimentation attributable to the project. Effect - Long -Term Water Quality Impacts. Local surface water quality would be influenced in the long-term by 2 factors: increased pollutant loads in run- off from added urban surfaces. Urban pollutant loadings originating from project urban sulfaces and golf course fertilization could increase the total Petaluma River loadings by about 5 percent. -1- I IT RESOLUTION 9283 NCS Page 1 of 3 Finding - Changes have been incorporated into the project which would mitigate the above mentioned significant environmental effects identified in the Environ- mental Impact Report. Statement of Fact - A surface water quality and sedimentation control plan is required as a condition of the Planned Community Development prezoning. Said plan must be reviewed and approved by key agencies having jurisdiction in these matters, prior to issuance of grading or building permits. 3) Land The Environmental Impact Report identified two unmitigatable significant potential land impacts resulting from the proposed project. City Council Resolution No. 9265 N.C.S., dated August 24, 1981 considered significant effects of urban area expansion and conversion . of productive agri- cultural land to non-agricultural uses and made appropriate findings and state- ments of facts regarding said effects. Effect -The Tolay fault, classified as "potentially active," appears to traverse the portion of this site proposed for golf course use. Potential impacts include surface rupture of golf course grounds. Effect - Anticipated.future earthquake activity from active faults in the region could cause severe groundshaking and localized failure of creek banks. Potentials for lateral spreading, compaction, lurching and liquefaction are considered low. Although it is possible that material suspectible to liquefaction or compaction is present within the alluvium beneath the site, there is no information available on conditions below 12 feet. Finding - Changes have been incorporated into the project which would mitigate the significant environmental effects identified in the Environmental Impact Statement of Facts - Additional investigation and modification of plans to re- flect findings of said investigations have been required as a condition of the Planned Community Development prezoning. Investigation and any.plan modifica- tion required would be completed prior to issuance of any grading or building permit. AM113 IT Fin RESOLUTION 9283 NCS Page 2 of 3 4) Minerals - No significant adverse effects. 5) Flora Effect - Limited realignment, to Ellis Creek and its tributary could result in significant effects on riparian vegetation and wildlife. Likely alternatives would be construction of localized channel protection devices, necessitating limited vegetation removal. The greatest amount of vegetation removal would occur at the junction of Ellis Creek and its tributary where a realignment of the channels is'proposed. Finding - Changes have been incorporated into the project which would mitigate the significant environmental effects identified in the Environmental Impact Report. Statement of Facts - Project plans have been altered to avoid realignment of Ellis Creek. A creek preservation and improvement plan has been required as a condition of the Planned Community Development prezoning. The plan will be reviewed by the State Fish and Game Department and approved by the Planning Commission. 6) Fauna No significant adverse effects. 7) Noise Significant adverse effects have been identified, however, only the resi- dential portion of this project will be affected. Specific effects, the requisite findings and facts will, therefore, be addressed at such time as the residential Planned Unit Development rezoning occurs. 8) Objects of Historical Significance. Effect - Location of the golf course near the Petaluma Adobe would en- hance recreation experiences for users of the golf course, but could detract from recreational experiences at the historical monument. Finding - Changes have been incorporated into the project which would mitigate the significant environmental effects identified in the Environmental Impact Report. Roads - Project applicants will construct road improvements to Frates, (Ely, Old Adobe and Lakeville within proposed annexation area. Improvements twill include traffic control devices as specified in traffic report. Drainage - Project applicants will construct major drainage improvements has part of development activity. This will include major reconstruction of a portion of.
