Transportation Program (STP) funding and committing the necessary non-federal match, and stating the assurance to complete the Sonoma Mountain Parkway Rehablitation.Project. BACKGROUND: Thei most recent federal transportation act called Safe; Accountable, Flexible, Efficient Transportation Equity Act {SAFETEA) ended on S,epfember 3.0; 2009.. In anticipation of the enactment of the new federal surface transportation act (New Act); the: Metropolitan Transportation Commission (MTC) adopted an overall .framework for the investment of roughly $1.4 billion of federal. funding over the six-year New Act period (MTC Resolution 3925). The New Act is in effect from FY 20Q9-10 through'FY 20-1.4-15. Out of the $1.4 billion six-year estimated revenues,:coming to the MTC region; the Commission has made firm funding commitments of $598 rriillion to programs and projects during'the first three years only (Cycle 1, FYs 2009-10 through 2012-1.3). The remaining funds will be committed in a future cycle. Cycle 1 policies. also established a Congestion Management Agency (CMA) Block Grant approach, which delegated' program management and project selection to the county congestion management agencies :for three programs, one of which is the Local Streets and Roads Shortfall (LS'RS) Program... 'The Sonoma County Transportation Authority (SCTA) is Petaluma's CMA and will be administering.the LSRS Program under the general policies and procedures laid out Agenda Revie Dept. Director City Attorney Finance Directory/~ City ManagC by MTC. After the grant application is approved, Caltrans Local Assistance will manage the project authorizations and funding. . . On April 1., 201'0, SCTA announced a call for projects for the LSRS Program. The deadline for submitting the application was April 30, 2010. The maximum amount of LSRS funds available to the City of Petaluma for the Cycle 1 Program -is expected to be $1,036,000. The funding has a required local match of l 1.47%. All project expenses that exceed $1;036,000 will be the responsibility of the City and will not be eligible for reimbursement. IDISCUSSION: Fora project to be eligible for the Local .Streets and Roads: Shortfall (LSRS) Program,. it must be for pavement rehabi itation and preventative maintenance located on the federal-aid system. Capacity-expansion projects, right of way purchases, channelization;.routine maintenance, spot application, seismic retrofit, and structural repair'on bridges are not eligible activities. Non- pavement enhancements, such as streetseape projects and new traff c calming features, are also not eligible for this program. Certain non-pavement activities such as replacement of features that currently exist on the roadway facility (i.e. ADA curb ramp upgrades, sidewalk repair, traffic striking, etc:) are eligible expenses for-reimbursement. Staff reviewed all streets on the federal system and, using its pavement management program software, made an initial selection of projects. that meet the grant :requirements. The next step in the selection process was to find a.project of proper size to,ful,ly expend the al ocated.amount, allowing-some flexibility to adjust to changes in construction costs from now until the project is constructed. It is less cost effective to pave small segments of streets at vacious locations than oneicontinuous project. Prior to recommending the project, staffconsulted with Water Resources and Conservation to determine the.condition of utilities within the proposed project limits, and considered potential environmental concerns, traffic volumes, community needs and requests. Staff proposes the rehabilitation of Sonoma Mountain Parkway, from Wyndham Way to Riesling Road. The scope of fhe proposed. construction work to complete the project will generally include grinding ofexisting-asphalt up to 6", to be replaced with new asphalt, dig-outs up to 12", placement of paving fabric, crack seal, :replacement of existing traffic loops,'traffic striping removal'; installation of"thermoplastic striping, installation of~ADA compliant ramps, replacement of damaged sidewalks,: traffic control, and manhole adjustments. Sonoma County Transportation Authority (SCTA) announced the LSRS Call for Projects on April 5; 2010, with a-.grant :application submittal deadline. of April 30, 20.10. Staff prepared the grant application and provided a draft resolution in order to meet the grant deadline.. The application was' scheduled to be reviewed by SCTA Transportation Advisory Committee on May 20`h, by -the County Bicycle .and Pedestrian Advisory Committee. on May 26`'' ,and by Metropolitan Transportation Commission (MTC) onJuly 30, 20.10. The attached resolution is required prior to the°1VITC meeting. Project.design and environmental is expected to be completed.inFY 10/1 1, with construction to take place in FY 11/12. 2 FINANCIAL IiVIPACTS: The .Local Streets and Roads Shortfall (I,SRS) distribution share for the City is a maximum of $1,036,000. The grant reimbursement is 88.53% and the local. match is 11.47%. Funds have been set aside within the Street .Maintenance :Fund specifically for grant matches and miscellaneous projects. AUTI=IORIZING TI=IE FILING O,F AN APPLICATION FOR FEDERAL SURFACE TRANSPORTATION PROGRAM; (STP) FUNDING AND COMMITTING THE NECESSARY NON-FEDERAL MATCI~,.AND STATING THE ASSURANCE TO COMPLETE THE SONOMA MOUNTAIN;.,PARKWAY REI~ABILITATION PROJECT WHEREAS, City of Petaluma (herein referred to as APPLICANT) is submitting an application to the Metropolitan Transportation Commission (MTC) for $1,036,000 in funding from the federal Surface Transportation Program, (STP) program for the Sonoma. Mountain Parkway Rehabilitation Project (herein referred to as PROJECT) for the MTC Resolution, No. 392'5, New Federal Surface Transportation Act (FY 20.09-:1Q FY 2010-11 and FY 2011-12) Cycle 1 STP/CMAQ Program: Project. Selection Criteria, Policy, Procedures and Programmin; (herein referred to as PROGRAM); and WHEREAS, the Safe, Accountable, Flexible; Efficient Transportation Equity Act: A Legacy for Users (SAFETEA) (Public Law 109-59, August.l0, 2005) authorized the Surface Transportation Program (STP) (23~U.S.C. § 133) through .September 30, 2009; and WHEREAS, SAFETEA has been extended through December 3.1, 2010 pursuant to Public Law 111-147, March -18, 2010 and may be subsequently extended pending enactment of successor legislation for continued funding; and WIIEREA5, pursuant to,SAFETEA, and the regulations promulgated thereunder, eligible project sponsorswshin'g`to receive federal Surface Transportation Program (STP) funds for a:project shall submit ar application first with the appropriate Metropolitan Planning Organization (MPO), for review and. in.cl"usion in the: MPO's Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the nine counties of the San Francisco Bay region; and WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC Resolution No. 3506, revised) that sets out procedures governing the application and use of .STP funds; and WIIEREAS;_APPLICANT is an eligible. project sponsor for STP funds; and W~IEREAS, as part of the application for STP funding, MTC requires a resolution adopted by the responsible. implementing agency stating the following: 1) the commitment of necessary local matching funds of at least 11.47%; and 2) that the sponsor understands that the STP funding is fixed at the programmed amount, 4 •and therefore, any ,cost increase cannot be expected to be funded with additional STP .funds; and 3) that the project will comply with the procedures specified in Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised); and 4) the assurance of the sponsor to complete the project. as described in the application, and if approved, as included in MTC's TIP; and 'S) that the project will comply with all the project-specific requirements as set forth in the PROGRAM. NOW, THEREFORE,; BE IT RESOLVED that the APPLICANT is authorized to execute and file an application for funding for the PROJECT under the Surface Transportation Program (STP) of SAFETEA, any extensions of SAFETEA or any successor legislation for continued funding ;and BE IT FURTHER RESOLVED that the APPLICANT by adopting-this resolution does hereby state that: 1. APPLICANT will, provide. $134,225 in non-federal. matching funds; and 2. APPLICANT understands that the STP funding; for the project is fixed at the MTC approved. programmed amount, and that any cost increases must be funded by the APPLICANT from other funds, and that-APPLICANT does not expect any cost increases to be funded with additional STP funding; and 3. APPLICANT understands the funding deadlines' associated with these funds and will comply with the provisions and requirements of the Regional Project Funding Delivery Policy (MTC Resolution No. 3.606, as revised); and 4. PROJECT will be implemented as described in the complete application and in this resolution and, if approved, for the amount programmed in the MTC federal TIP; .and 5. APPLICANT and the PROJECT will comply with the -requirements as set forth in the program; and BE IT FURTHER RESOLVED that APPLICANT is an eligible sponsor of STP funded projects; and BE IT FURTHER R SOLVED that APPLICANT is authorized to submit an application for'STP funds for the PROJECT; and ~.
