HomeMy WebLinkAboutResolution 2010-093 N.C.S. 06/21/2010Resolution No. 2010-093 N.C.S. of the City of Petaluma, California ACCEPTING BIDS AND AWARDING CONTRACTS TO THE LOWEST RESPONSIBLE BIDDERS FOR FURNISHING CHEMICALS FOR WASTEWATER TREATMENT FOR FISCAL YEAR 2010/11 AND AUTHORIZING THE CITY MANAGER TO SIGN THE CONTRACTS ON BEHALF OF THE CITY WHEREAS, the City of Petaluma uses bulk chemicals in its operation of the Ellis Creek Water Recycling Facility; and, WHEREAS, the City of Petaluma joined the North Bay Agency Chemical Pool (NBACP) in the spring of 2009 to provide the best possible pricing for the rate payers reducing costs by $26,585 over the private company that operated the Hopper Street Plant the first year the pool was utilized; and, WHEREAS, NBACP member Vallejo Sanitation & Flood Control District conducted a competitive bid process for bulk purchase of numerous chemicals for the Fiscal Year 2010/2011; and, WHEREAS, NBACP bid the chemicals on May 20, 2010, and thirteen (13) bids were received and opened in accordance with applicable law; and, WHEREAS, the lowest responsive bids for the chemicals to be purchased through NBACP by the City of Petaluma were: A. Brenntag Pacific, Inc. for Sodium Bisulfate B. General Chemical Company for Aluminum Sulfate C_ Sierra Chemical Company for Sodium Hypochlorite D. Kemira Water, Inc. for Ferric Chloride WHEREAS, as a member of NBACP, the City of Petaluma is entitled to purchase bulk chemicals for the NBACP low bidders at the bid price stated; and, WHEREAS, the bulk chemical purchases contemplated by this resolution are exempt from other competitive bid requirements of Petaluma Municipal Code Chapter 4.04 pursuant to Petaluma Municipal Code Section 4.04.100, "Cooperative Purchasing Programs." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The bids for chemicals listed above are hereby accepted. Contracts are awarded to the following vendors for the following bulk chemicals, in conformance with the NBACP lowest responsive bids, conditioned on timely execution by each vendor of the Standard Agreement contained in the NBACP Chemical Requirements for 2010-2011 bid package ("Standard Agreement") and Addendum No. 1 to add information for technical specification wording and submission of all required documents: Resolution No. 20]0-093 N.C.S. Page 1 a. Brenntag Pacific, Inc., sodium bisulfate, $0.739/gal and not to exceed $59,120, plus applicable sales tax. b. General Chemical Company, aluminum Sulfate, $319/dry ton, and not to exceed $5,104, plus applicable sales tax. c. Sierra Chemical Company, Sodium Hypochlorite (12.5%), $0.5995/gal and not to exceed $101,915, plus applicable sales tax. d. Kemira Water, Inc. for Ferric Chloride (43%), $640/dry ton and not to exceed $89,600, plus applicable sales tax. 3. The City Manager is authorized to execute agreements and/or purchase orders which incorporate the Standard Agreement with each named supplier for bulk chemical purchases for Fiscal Year 2010/11. Under the power and authority conferred upon this Council by the Charter of said City.
