RESOLUTION NO. 2914' .N, C. S.
RESOLUTION: AUTHORIZING THE CITY ATTORNEY TO
COMMENCE PROCEEDINGS IN EMINENT DOMAIN TO
ACQUIRE CERTAIN PROPERTY DESCRIBED IN THE
BODY OF THIS RESOLUTION FOR HIGHWAY AND SMALL
BOAT'HARBOR PUJR'POSE

Regular Meeting of the City C6uncil of the City of`Peta a on the 5th day
of February . 1962,
BE IT RESOLVED by the Petaluma city Council that it finds and
determines, that:
The public interest and necessity requires the acquisition, construc-
tion, and completion by the City of Petaluma of a public: improvement, namely,.
small boat harbor and necessary rights of way and, access roads thereto, to be
located in the area hereinafter more specifically described.
Said proposed public improvement is planned and located in a
manner which will be most compatible with the greatest public good and the least
private injury;
BE IT FURTHER .RESOLVED by the'City Council that it is to
acquire in the name of the City of Petaluma, a fee simple estate, in and to the
said hereinafter described real property, or interests in real property, by
condemnation in accordance with the provisions of the Code of Civil Procedure
and of the Constitution of California relating to eminent domain;
BE IT FURTHER RESOLVED that the City Attorney, be, and he
is, hereby authorized to prepare:,and prosecute, in they name of the City of
Petaluma, such proceeding or proceedings in the proper court having jurisdiction
thereof as are necessary for such acquisition, and to make application to said
court'for an order, fixing the amount of such security in the way of money
deposits as said court may direct, and for an order permitting said City to

take immediate possession and use:of said .realproperty?' or interests in real
property for the rights of way and access roads as are necessary,
BE IT FURTHER RESOLVED that the City Auditor; be, and she is,
hereby authorized to make a. deposit of such security out of proper funds in such
amount as shall be fixed and determined to be appropriate, and in such manner
as said court in which such.`condemnation proceedings are pending may direct;
The real property or interests in real property, which the City of
Petaluma, California, a Municipal Corporation, by this Resolution is authorized
to acquire, situated in the County of Sonoma, State of California and more partic-
ularly described as follows:
Beginning at the southwest corner of that tract of
land conveyed to the City of Petaluma on February 8, 1.941,
and.described in Deed. recorded in Book 516 of Official
Records at Page 331, Sonoma County Records; thence
along that boundary line between said City of Petaluma and
the McNear Company 'S 54° 46' E 751. 80'feet to its south-
easterly terminus; thence S 35° 14' W along the southeast-
erly boundary 'line•of the McNear Company property 375,39
feet to the northeast bank of the Petaluma River; thence
along the northeast bank-of said River N 52° 59' 40" W
1252. 40 feet to a point on the boundary line between the
lands of the 1VIcNear Company and the lands of the County
of Sonoma as described in Deed recorded in Book 1189,
Page 305 of official, Records of Sonoma County, thence
along the aforementioned boundary line the following courses
and distances: N 50° 30' 49"E 370. 18 feet, N 67° 22° 59"
E 100. 44 feet; N 54° 31' 24" E 142', 34 feet, N 6° 56' 42"
E 130. 65; N 61 27' 44" W 248. 49 feet; N 9° 28' 49" W
127. 39 feet and N 9° 47' 35" E 126. 32.feet to a point;
thence leaving said boundary line and across said.McNear
Company property S 61 ° 27' 44" E-759. 75 feet to a point
on the boundary line between aforementioned City of
Petaluma and, the'McNear Company, thence along said
boundary line S 35° 14'W 619.11 feet to the point of beginning.
Containing 16. 393 acres,

I hereby certify, that the foregoing resolution was, duly
and regularly introduced and adopted by the Council of.
the City of Petaluma, on the 5th day?of February ,
1962, by the following vote.
