BACKGI2OITND The Waste Activated Sludge (WAS) Pump Station Improvements project. installed two new chopper pumps at the Ellis Creek Water Recycling Facility to alleviate the ,problem of clogged pumps and assoiciated daily maintence due to the increased use and flushing of wipes. i Bids were opened on October 7, 2009. On November 2, 2009, the City Council awarded the construction contract to Cats 4 U, Inc. of Healdsburg, CA. Construction was successfully completed on June 25, 2010. DISC~IJSSI®N l Following the acceptance of the project, the City Clerk will file a Notice of Completion with the Sonoma County Recorder and the Finance Department will release the retention money to the contractor within 60 days. WASTE ACTIVATED ~SLIJDGE PUMP STATI®N IIVIPItOVE1VI'ENTS P12®,TECT NiT1VIBER 066401004 W>FIEREAS., in accordance with .Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Sewer Outfall Replacement Project ("Project"); and I WIIEItEAS, bids for the Project were opened on October 7, 2009 in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WIIEI2EAS, the apparent low bid for the Project was the bid of Cats 4 U, Inc. in the amount of $139,992; and W>EIEREAS, by Resolution No. 2009-179 N.C.S. adopted November 2,.2009, the City Council of the City of Petaluma found the bid of $1.39,992 for the Project to be the lowest responsive bid and awarded the Project to Cats•4 U, Inc.. in the amount of $139,992 conditioned on Cats 4 U, Inc.'s timely executing the Project contract and submitting all required documents and authorized and directed the City'Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any amendments to the Project contract that are necessary to effectively complete the:project andlor to realize the Project and/or cost benefits for the. City so long as such amendments do not increase the original contract not- to-exceed amount by more than $25,000; and WIIE1tEAS, the following change orders (CO) affecting the Project amount have been approved: CO No. 1: Modifications to :electrical panel and supports; add additional valves $ 5,620.13 CO No. 2: Modifications to piping, hose bib and rnagmeter' $ 2,348.00 CO No. 3: Modifications to painting, gauges, rotometers and drains $16,736.96 Total Change Orders: $24,705.09; and WI-IEI2EAS,, the final contract amount as amended including all change orders is $164,697.09; and W>EIEI2EAS, City staff has inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other~obligations pursuant°to the contract; and WIIE'REAS, based on'the foregoing, staff recommends acceptance ofthe Project on behalf of the City; 3 NOW, TI~E1[~>FORE, >BE IT I~SOLV>ED by the City Council of the City of Petaluma as follows: The contract entitled WAS Pump Station Improvements, City Project Number 066401,004. with a final contract amount of$164,697.09, is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project. withthe Sonoma County Clerk's Office within ten (10) days ofthe date ofthis'Resolution. 3.
