HomeMy WebLinkAboutPCDC Resolution 2007-12 07/16/2007RES®LUTI®IV NO.2007-12 PETALUMA COMMUNITY DEVELOPMENT COMMISSION RESOLUTION APPROVING THE PROJECT BUDGET AND AUTHORIZING THE AWARD OF CONTRACT FOR THE PETALUMA RAILROAD DEPOT RENOVATION PHASE 4 -FREIGHT SHED WHEREAS, the Petaluma Community Development Commission ("PCDC") staff has worked diligently with Mary Dooley of MAD Architecture to prepare construction bid documents and advertise for construction of this Project; and, WHEREAS, in accordance with California Public Contract Code Section 20688.2 and other applicable law, PCDC staff solicited bids for the Project; and, WHEREAS, the Project was bid on June 26, 2007, and three (3) bids were received and opened in accordance with applicable law; and, WHEREAS, the lowest bid for the Project was from Vila Construction for $509,350.00; and, WHEREAS, staff has determined that Vila Construction's bid satisfies the bidding requirements for the Project; and, WHEREAS, staff has verified that Vila Construction possesses a valid California Contractor's License, Class B, number 300454 that qualifies Vila Construction to perform the Project; and, WHEREAS, the Project is exempt from the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project consists of repair, maintenance, and minor alteration of existing public structures and/or facilities involving negligible or no expansion of use beyond that existing at the time of the determination of exemption; including, but not limited to, restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety. PCDC Resolution 2007-12 Page 1 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City and the PCDC hereby: Approve the Construction Contract in the amount of $509,350 and a Construction Contingency of $50,935. 2. In accordance with California Public Contact Code Section 20688.2 and other applicable law, waive any and all non-conformance in the bid of Vila Construction for the Petaluma Railroad Depot Project, Phase 4, and find the bid of $509,350.00 to be the lowest, responsible bid. 3. Award the contract for the Petaluma Railroad Depot Project, Phase 4 to Vila Construction, in the amount of $509,350.00, the amount of the lowest responsible bid, conditioned on Vila Construction timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to Vila Construction. Authorizes and directs the Executive Director to execute the project contract on behalf of the PCDC upon timely submission by Vila Construction of the signed project contract and all other required documents, including but not limited. to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
