RESOLUTION OF INTENTIQN TO.ORDER`IMPROUEMENT IN
SPECIAL ASSESSME_NT--DISTRICT 1O:NS; CITY OF P,ETALUMA
-~ The City Council of, the City of P:eta~luma resolves:
This Counci_l iritend:s- to order the.:foll'owing impro.vement under
. the. authority of the `Munic:ipal Improveine "nt Act of 1913 :
The constructi:on of streets, includi~ng clear,ing, grading,
~ s'ubbase, base;,, pa~einent, curbs.an-d .gutter.s, and driveways;
sidewalks., storm drainage f.ac'ilities; ssan-itary sewers and
~ appurtenances; ~a- s_ystem of dome'stic water s~upply includ`ing'
fire hydr.ants; st~reet liqhts a,nd under.grbund:electrical
' distribution facil,itie_ s; and a11 o'ther. imp:rovements and ---°.=
' appurtenarices. necessar,yw'f:or~~a .comp:le:te scheme of public
, improvements i.n the arsa bounded on tlie Southwest by the
Petaluma. River„ on the Northwe,st by, Re'tal'uma Boulevard North;

the State of California, and this City now in the performance of a
public function.
Where any disparity occurs in level or size between the improve-
ment and private property- this Council determines that it is in the
public~ interest and more economical to eliminate the disparity by doing
work an the private property instead of adjusting the work on public
property. Accordingly, work may be done on private property for this
purpose with the written consent of the landowner.
This Council intends to enter into an agreement with Pacific
Gas and Electric Company under the provisions of Section 10110 of the
Streets and Highways Code, inasmuch as certain facilities included in
the improvement are to be under its ownership,rmanagemerit and control.
Serial bonds representing unpaid assessments, and bearing
interest at a rate not to exceed ten percent (l~o) per annum, will be
issued in the manner provided by the Improvement Bond Act of 1915
(Division 10, Streets and Highways Code), and the last installment of
the bonds shall maturefourteen years from the second day of July next
succeeding ten (10) months from their date.
This Council f.inds that the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 (commencing with Section
2800, Streets and Highways Code) does not apply to these proceedings.
This Council appoints Burton Engineers as Engineer of Work for
this project, and directs the preparation of the report required b~:
Section 10204 of the Streets and Highways Code.
In the opinion of this Council, the public interest will not
be served by allowing owners of assessable lands to enter into a con-
