PETALUMA COMMUNITY DEVELOPMENT COMMISSION
ACCEPTING COMPLETION OF THE NORTH BAY CONSTRUCTION, INC.
STREET REHABILITATION PROJECT REDEVELOPMENT AREA ARTERIALS/COLLECTORS,
PROJECT NO. C201104-2
WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter
Section 20162 of the California Public Contract Code and other applicable law, the Petaluma
Community Development Commission (PCDC) solicited bids for the Street Rehabilitation Project
Redevelopment Area Arterials/Collectors project ("Project"); and,
WHEREAS, bids for the Project were opened on July 7, 2004 in accordance with California
Public Contract Code Section 4105.5 and other applicable law; and,
WHEREAS, the apparent low bid for the Project was the bid of North Bay Construction,
Inc. in the amount of $2,917,734.23; and,
WHEREAS, by Resolution No. 2004-135 N.C.S. adopted July 19, 2004, the PCDC found the
bid. of $2,917,734.23 for the Project to be the lowest responsive bid and awarded the Project to
North Bay Construction, Inc. in the amount of $2,917,734.23 conditioned on North Bay
Construction's timely executing the Project contract and submitting all required documents, and
authorized and directed the Executive Manager to sign the Project contract on behalf of the
PCDC upon such timely submission and to execute on behalf of the PCDC any change. orders
and other amendments to the Project contract that are necessary to effectively complete the
project and/or to realize the Project and/or cost benefits for the PCDC, so long as such change
orders or amendments do not result in an increase in excess of 3.7 percent of the total Project
amount; and,
WHEREAS, on December 19, 2005, The PCDC approved increasing the project budget
including contingency to $4,364,544.00; and,
WHEREAS, the final contract amount including all approved contract change orders is
$4,222,807.01; and,
WHEREAS, Petaluma Community Development Commission staff have inspected the
Project and determined that it has been completed in accordance with the contract
requirements subject to the Contractor's continuing warranty and other obligations pursuant to
the contract; and,
WHEREAS, based on the foregoing, staff recommends acceptance of the Project on
behalf of the Petaluma Community Development Commission.
NOW, THEREFORE, BE IT RESOLVED by the Petaluma Community Development Commission
that:
The final total construction contract of $4,222,807.01 is approved and that the
City Clerk/Recording Secretary is hereby authorized to sign the Notice of
Completion.
2. Administrative Services is hereby authorized to release to North Bay Construction,
Inc. all undisputed retention not subject to pending change orders, within forty
five (45) days after the recordation of the Notice of Completion and in
PCDC Resolution 2007-07 Page 1
accordance with the terms of the Project contract, California Public Contract
Code Section 7107 and applicable law.
