December 31, 2018 to December 31, 2025', To Be Submitted to the Voters. at the November 2, 2010 General Election and Determining the Order of Signatures on the Argument. RECOMIVIENDATION: It is recommended that the Gity Council adopt the attached Resolution Approving Draft Argument for a Ballot Measure Extending the Urban Growth Boundary (UGB) Expiration from December 31., 2018 to December 31, 2025, To Be ,Submitted to the Voters at the November 2, 2010 General Election and Determining the Order of Signatures on the. Argument. BACKGROUND: At the June 21., 2010 meeting, the City Council voted to have asub-committee of Council comprised of Mayor Torliatt and Council Members .Harris and Babbitt compose the argument in support of the Ballot Measure Extending the Urban Growth Boundary (UGB) Expiration from December 31, 2018 to December 3..1,.2025 as well as a rebuttal to the argument.against the measure, should one be filed.. Staffwas directed to present a draft argument in favor of the measure to Council for approval at a public meeting. Any Council Members authorized by the City Council to sign the argument in favor of the measure may do so. At the June 2.1, 2010 meeting, all Council Members expressed a desire to sign the argument. In accordance with Election. Code §9283, only the names of the first five Council Members to sign the ballot argument will be printed in tl"e .ballot pamphlet with the argument. It is recommended that Council determine the .order in -which they`will sign the argument. Additionally,,, should .an, argument against, the measure be filed, -Mayor Torliatt and Council Members Harris ancl:Rabbtt will author a:rebuttal to that.argument. Council agreed at the June 21, 2010 meeting that tfie order of'signatures on any rebuttal argument would be reversed from the order of signatures on fhe argument in favor, thereby allowing every Council Member's name to appear at least once in~ the printed ballot pamphlet. An approved argument must be submitted to the City Clerk's Office. before 5:00 p.rri. on Monday, August 16, 2010, accompanied by the printed names and signatures of those Council Members signing the argument. Director ~%`/ City .Attorney Finance Director ~ .City Man The City Clerk will provide copies of the argument in favor to the authors of the argument against (should one be filed) and vice versa.. The argument will then be sent to the Sonoma County Registrar of Voters for inclusion in the ballot pamphlet. I FINANCIAL IMPACTS: The cost of placing this item on the November 2010 ballot is estimated between approximately $10,000 and $17,800. These estimates include approximately $1,400 in legal support, $700 in City Clerk time, and County election charges ranging from $7,900 to $15,700. Monies are budgeted in the City Clerk's budget to support this cost. Estimated City costs are related to procedural aspects of complying, with Elections Code provisions and actions to place the measure on the ballot. They do not include any use of. City resources for preparation of the ballot argument, which has been prepared by a subcommittee of the City Council, for the rebuttal argument if one is needed, or for advocacy in favor of or against the measure.. APPROVING DRAFT ARGUMENT FOR A BALLOT MEASURE EXTENDING T>EIE URBAN GROWTI~ BOUNDARY (UGB) EXPIRATION FROM. DECEMBER 31, 2018 TO DECEMBER 31, 2025, TO BE SUBMITTED TO THE VOTERS AT THE NOVEMBER 2, 2010 GENERAL ELECTION AND DETERMINING THE ORDER OF SIGNATURES ON THE ARGUMENT WHEREAS, on December 21,.2009, the City Council adopted Resolution 2009-204 N.C.S. Ordering Submission to the Qualified Electors of the•City of an Ordinance to Extend the Urban Growth Boundary Expiration Date to December 31, 2025 at the General Municipal Election to Be Held on Tuesday, November 2, 2010; and, WHEREAS, on June 21, 2010, the City Council. directed asub-committee of the City Council comprised of Mayor Pamela Torliatt and Council Members Mike Harris and David Rabbitt to compose an argument in support of the Ballot Measure Extending the Urban Growth Boundary (UGB) Expiration from December 31,:2018 to December 31,.2025 as well as a rebuttal to any argument against the measure, should one be filed; and, WHEREAS, the City Council has reviewed the draft argument prepared by Mayor Torliatt and Council Members Harris and Rabbitt. NOW, THEREFORE, BE IT RESOLVED that the City Council approves the draft argument in support of the Ballot Measure Extending the Urban Growth Boundary (UGB) Expiration from December 31, 2018 to December 31, 2025 attached as Exhibit A to this Resolution, and directs the City Clerk to submit the argument to the .Sonoma County Registrar of Voters for .inclusion in the November 2, 2010 General Municipal Election ballot pamphlet.
