RECOMMENDATION It is recommended that the City Council adopt an Ordinance to Establish Radar Enforceable Speed Limits on Certain Streets Within the City of Petaluma. BACKGROUND On December 1, 2015, the City Council unanimously approved the first reading of an ordinance to establish radar enforceable speed limits on certain streets within the City of Petaluma. The recommended action provides for second reading and adoption of the ordinance. The staff report for the first reading of this item at the December 1, 2014 Council meeting is provided for further background information. Seconded by AN ORDINANCE TO ESTABLISH RADAR ENFORCEABLE SPEED LIMITS ON CERTAIN STREETS WITHIN THE CITY OF PETALUMA Whereas, in September and October of 2014, the City conducted Engineering and Traffic Surveys in accordance with section 627 of the California Vehicle Code ("Survey") to establish radar enforceable speed limits on each of the street segments identified in this ordinance and; Whereas, California Vehicle Code sections 22357, 22358, 22358.3 and section 28.13 of the California Manual on Unified Traffic Control Devices allows for the City to set a radar enforceable speed limit on local roads; and Whereas, the City desires to set radar enforceable speed limit on local roads consistent with the Survey as set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The speed limits set in Section 1 supersede any previously adopted speed limits for the specific segments of road identified in Section 1. Section 3. Previously established radar enforceable speed limits not re-established or modified in this ordinance shall remain approved as previously adopted for the streets to which they apply. Section 4. If any section, subsection, sentence, clause or phrase or word of this Ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this Ordinance and each and all provisions thereof, irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid. Section 5. RECOMMENDATION It is recommended that the City Council introduce an Ordinance to Establish Radar Enforceable Speed Limits on Certain Streets Within the City of Petaluma. BACKGROUND The City must conduct engineering and traffic surveys prior to establishing radar enforceable speed limits on an existing street in accordance with State regulations. Most of the City's engineering and traffic surveys will expire on February 4, 2015. The Traffic Engineering Division ofthe Public Works and Utilities Department, as well as the Petaluma Police Department, have conducted new studies to re-establish speed limits on various Petaluma City streets. Existing speed zones do not change if there is no significant change to existing traffic conditions. DISCUSSION The California Vehicle Code (CVC) and California Manual on Uniform Traffic Control Devices (MUTCD) require that an engineering and traffic survey be performed to determine and establish prevailing speeds on street segments 40 -foot in width or greater and requires agencies to set posted limits at the 85°i percentile of speeds obtained during the speed survey (i.e. 15 percent of surveyed vehicles went faster and 85 percent went slower). The Traffic Engineering Division ofthe Public Works and Utilities Department and the Traffic Enforcement and Safety Division ofthe Police Department coordinate on a regular basis to make certain speed surveys exist and are updated as necessary in accordance with State law and local regulations. The various speed zones, citywide, are illustrated in the attached Speed Zone Map. There are three street segments, shown in bold letters, in which speed limit changes are proposed. Two street segments are proposed to be increased by 5 miles per hour (MPH) and the remaining street segment is proposed to be reduced by 10 MPH. Changed condition flags will be 14 placed at speed limit signs that have been changed, for a period of two weeks, to notify the driver of modified speed limits. The Police Department will provide a grace period for issuing citations for approximately thirty days after the new speed limit signs and been posted. In all other cases, the speed limit does not change, but the surveys are still required to revalidate existing posted speed limits. The following table summarizes the various speed zones surveyed. Individual street segments for the speed surveys are available for review upon request.
