HomeMy WebLinkAboutResolution 2014-190 N.C.S. 12/01/2014Resolution No. 2014-190 N.C.S. of the City of Petaluma, California AMENDING THE CITY OF PETALUMA GENERAL PLAN 2025 TO UPDATE THE HOUSING ELEMENT TO INCLUDE THE 2015-2023 HOUSING ELEMENT WHEREAS, State law requires California cities to prepare and adopt a general plan to guide future development of the city, including a Housing Element as one of the mandatory elements in a eity's general plan; and WHEREAS, on May 19, 2008, the City Council approved Resolution No. 2008-085 N.C.S., adopting the General Plan 2025. which contained the City's then -existing housing element; and WHEREAS, on June 15, 200% the City Council approved Resolution No. 2009-094 N.C.S., adopting the Petaluma 2009-2014 Housing Element; and WHEREAS, State law requires that cities comprehensively update their Housing Elements to ensure their plans can accommodate future demand for housing; and WHEREAS, the proposed 2015-2023 Housing Element Update ("Housing Element") identifies and analyzes existing and projected housing needs and states goals, policies, quantified objectives and special programs for the preservation, improvement and development of housing in the City from 2015 through 2023; and WHEREAS, the proposed Housing Element has been prepared in conformance with the requirements of State law, including but not limited to Article 10.6 (Housing Elements) of the Government Code and was released for preliminary review as a draft to the State Department of Housing and Community Development; and WHEREAS, the State Department of Housing and Community Development reviewed the Draft Housing Element and determined that the draft element meets the statutory requirements of State housing element law; and WHEREAS, the proposed Housing Element is consistent with the Petaluma General Plan 2025, adopted by the City on May 19, 2008; and WHEREAS, an Initial Study and Negative Declaration was prepared pursuant to the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, notice of the City's intention to adopt a Negative Declaration and of the availability of the Negative Declaration for a thirty day public review and comment period was originally given on October 9, 2014 in accordance with CEQA; and WHEREAS, on October 28, 2014, the City of Petaluma Planning Commission conducted a duly noticed public hearing to consider and review the Housing Element and Negative Declaration for recommendation to the City Council; and Resolution No. 2014-190 N.C.S. Page I WHEREAS, after the conclusion of said public hearing, the Planning Commission adopted its Resolution No. 2014-39, unanimously recommending that the City Council adopt the 2015-2023 Housing Element as an amendment to the Petaluma General Plan 2025; and WHEREAS, on December 1, 2014, the City Council adopted Resolution No. 2014-189 N.C.S. approving a negative declaration of environmental impact, making findings and adopting a statement of overriding considerations in regard to the Housing Element, all in accordance with the requirements of Public Resources Code Sections 21000 el seq. ("CEQA"), Title 14, California Code of Regulations. Sections 15000 el seq. ("CEQA Guidelines") and the City of Petaluma Environmental Review Guidelines; and WHEREAS, on December 1, 2014, the City Council held a properly noticed public hearing, accepted comments from all interested parties on the proposed Negative Declaration and the Housing Element, considered the Housing Element, the Negative Declaration, and the supporting Initial Study. NOW, THEREFORE, BE IT RESOLVED: 1. Recitals. The above Recitals are true and correct and adopted as findings of the City Council. Adoption of Housing Element. Based on the findings and conclusions stated above, the City Council finds it in the public interest to, and hereby approves and adopts the City of Petaluma 2015-2023 Housing Element, incorporated herein by reference, as Chapter 11 to the General Plan 2025, which shall supersede and replace any previously adopted Housing Elements. 3. Effective Date. The Housing Element shall take effect thirty days from the date of the adoption of this Resolution pursuant to State law, including Midway Orchards v. County of Butte (1990) 220 Cal.App.3d 765, 778 and DeVita v. County of Napa (1995) 9 Cal. 4d' 763. 787, fm. 9.
