HomeMy WebLinkAboutPCDC Resolution 2006-19 10/16/2006RESOLUTION NO. 2006-19 PETALUMA COMMUNITY DEVELOPMENT COMMISSION RESOLUTION ACCEPTING COMPLETION OF THE CONTRACTING SERVICES CONTRACT FOR THE PETALUMA WAYFINDING SIGNS PROJECT # C200603 WHEREAS, Petaluma Community Development Commission (PCDC) in accordance with Public Contract Code, Section 20688.2 and other applicable law, the City of Petaluma solicited bids for the Petaluma Wayfinding Signs project ("Project"); and, WHEREAS, bids for the Project were opened on October 29, 2004, in accordance with California Public Contract Code Section 4105.5 and other applicable law; and, WHEREAS, the lowest bid for the Projecf was the bid of Contracting Services in the amount of $302,565.12; and, WHEREAS, by PCDC Resolution No. 2005-01 adopted February 7, 2005, the PCDC found the bid of $302,565.12 for the Project to be the lowest responsive bid and awarded the Project to Contracting Services in the amount $302,565.12 conditioned on Contracting Services timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the PCDC upon such timely submission and to execute on behalf of the PCDC any change orders and other amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the PCDC so long as such change orders or amendments did not result in an increase in excess of 20 percent of the total Project amount; and, WHEREAS, staff determined that Contracting Services bid satisfied the bidding requirements for the Project; and, WHEREAS, the following change orders affecting the Project amount have been approved: ~~CCO #~, C~CO A~mount._~ New~Contract~A~`mount~~°w 1 ($130,200.24) $ 1.72,364.88 2 $ 5,100.00 $ 177,464.88 3 $ 4,900.00 $ 182,364.88 4 $ 6,980.00 $ 189,344.88 5 ($27,057.42) $ 162,287.46 6 $ 15,290.00 $ 177,577.46 7 $ 1 1,890.80 $ 189,468.26 Total Change Orders: $(113,097.86); and PCDC Resolution 2006-19 Page 1 WHEREAS, the final contract amount as amended including all change orders is $189,468.26; and, WHEREAS, Contracting Services has completed the work to the satisfaction of the Director of Economic Development and Redevelopment and the Redevelopment inspection team; and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and, WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the Petaluma Community Development Commission (PCDC). NOW, THEREFORE, BE IT RESOLVED by the PCDC of the City of Petaluma as follows: The contract entitled Petaluma Wayfinding Signs Project No. C200603 with a final contract amount of $189,468.26 is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3: Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law.
