HomeMy WebLinkAboutPCDC Resolution 2006-17 09/11/2006RESOLUTION NO. 2006-17 PETALUMA COMMUNITY DEVELOPMENT COMMISSION RESOLUTION ACCEPTING COMPLETION OF THE NORTH BAY CONSTRUCTION, INC. CONTRACT FOR THE WATER STREET PHASE II AT-GRADE SITE IMPROVEMENTS PROJECT # C200403 WHEREAS, Petaluma Community Development Commission (PCDC) in accordance with Public Contract Code, Section 20688.2 and other applicable law, the City of Petaluma solicited bids for the Water Street At Grade Site Improvements Phase 2 Project ("Project"); and, WHEREAS, bids for the Project were opened on March 9, 2005 in accordance with California Public Contract Code Section 4105.5 and other applicable law; and, WHEREAS, the lowest bid for the Project, determined by the sum of the base bid plus Alternatives Numbers 1, 2, 3 and 4 was the bid of North Bay Construction, Inc., for $3,506,403; and, WHEREAS, staff analysis of the bid resulted in the selection of the base bid plus alternatives Numbers 1, 2 and 4 for a total project cost of $2,485,51 1; and, WHEREAS, Council directed staff to execute a change order to reduce the contract price by $146,200.00 by using value engineering; and, WHEREAS, staff determined that North Bay Construction Inc., bid satisfied the bidding requirements for the Project; and, WHEREAS, by Resolution No. 2005-05 adopted April 18, 2005, by the Petaluma Community Development Commission (PCDC) found the bid of $3,506,403 (base bid plus all alternatives) for the Project to be the lowest responsive bid and awarded the Project to North Bay Construction Inc., in the amount of $2,485,51 1 (base bid plus alternatives 1, 2, & 4); and, WHEREAS, the final contract amount as amended including all change orders is $2,358,719.02; and, WHEREAS, North Bay Construction Inc. has completed the work to the satisfaction of the Director of Economic Development and Redevelopment and the Redevelopment inspection team; and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and, WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the Petaluma Community Development Commission (PCDC). NOW, THEREFORE, BE IT RESOLVED by the Petaluma Community Development Commission (PCDC) as follows: PCDC Resolution 2006-17 Page 1 The contract entitled Water Street At-Grade Site Improvements Phase 2, Project No. C200403 with a final contract amount of 2,358,719.02 is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law.
