OF ORDINANCE January 15, 2015 Introduced by Seconded by Teresa Barrett Kathy Miller AN ORDINANCE TO ESTABLISH RADAR ENFORCEABLE SPEED LIMITS ON CERTAIN STREETS WITHIN THE CITY OF PETALUMA 10 WHEREAS, in September and October of 2014, the City conducted Engineering and Traffic 11 Surveys in accordance with section 627 of the California Vehicle Code ("Survey") to establish radar 12 enforceable speed limits on each of the street segments identified in this ordinance and; 13 14 WHEREAS, California Vehicle Code sections 22357, 22358, 22358.3 and section 28.13 of 15 the California Manual on Unified Traffic Control Devices allows for the City to set a radar 16 enforceable speed limit on local roads; and 17 18 WHEREAS, the City desires to set radar enforceable speed limit on local roads consistent 19 with the Survey as set forth herein. 20 21 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS ONE 23 24 25 26 27 FOLLOWS: Section 1. The speed limits set in Section 1 supersede any previously adopted speed limits for the specific segments of road identified in Section 1. Section 3. Previously established radar enforceable speed limits not re-established or modified in this ordinance shall remain approved as previously adopted for the streets to which they apply. Section 4. If any section, subsection, sentence, clause or phrase or word of this Ordinance is for any reason held to be unconstitutional, unlawful or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this Ordinance and each and all provisions thereof, irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful or otherwise invalid. Section 5, The City Clerk is hereby directed to post this Ordinance for the period and in the manner required by the City Charter. Ordinance No. 2522 N.C.S.
