SCE — Director, Public Works & Utilities Larry — Deputy Director, Public Works & Utilities SUBJECT: Resolution Accepting Completion of the Construction Contract for the Various Locations Rock Slope Protection Project RECOMMENDATION It is recommended that the City Council Adopt the Attached Resolution Accepting Completion of the Construction Contract for the Various Locations Rock Slope Protection Project. BACKGROUND During the storm event of December 2005 to January 2006, excessive rains caused high velocity flows in Petaluma River and other creeks. The incident scoured riprap under a 60"corrugated metal pipe to the Petaluma River at the Turning Basin that collects stonn drainage from the B Street neighborhood out fall; the embankment of the Old Redwood Highway Bridge abutment; the embankment of the Washington creek near Noriel Trail; and a portion of river bank near Copeland Pump Station. This contract work for the four project locations is described below: 1. B Street 60" CMP Outlet Rip Rap Erosion Repair- F00111806/PW1118: Excavation and placement of rock slope protection on bank of the Petaluma River around the outlet of a 60 -inch culvert. 2. Rip Rap Repair below Old Redwood Highway- F00127706/PW1277: Excavation and placement of rock slope protection on the abutment slopes under the Old Redwood Highway Bridge in the City of Petaluma. 3. Noriel Trail Embankment and Stonn Drain Outlet Repair - F00242006/PW2420: Excavation and placement of rock slope protection on the stream embankment at one location upstream of the Noriel Lane walk bridge and two culvert outlets on the downstream side of the bridge, together with miscellaneous permanent erosion control and riparian planting measures. 4. Rock Slope Protection at Copeland Sewer Pump - F00332906/PW3329: Excavation and placement of rock slope protection on bank of the Petaluma River and installation of a temporary cofferdam in the Petaluma River and temporary erosion control. The above projects were approved for Federal Emergency Management Agency (FEMA) funding to mitigate flood damage. DISCUSSION The final construction contract cost is $433,910, which includes all bid item work and there are no change orders for this project. All improvements were in place prior to the recent rains and functioned as intended. There are no disputed claims and the project was completed without any other significant incidents. FINANCIAL IMPACTS It is anticipated that the work for the Various Locations Rock Slope Protection Project will be reimbursed fully by FEMA through Cal/Office of Emergency Services for actual costs of design, construction management/inspection, and construction. The following table is a breakdown of estimated total project cost for Various Locations Rock Slope Protection Project: Phase Approved Project Budget Actual Total Project Cost *Planning / Environmental, Design & Salaries/Benefits $337,321.73 $377,832.18 Construction Contract (low bid) $433,910.00 $433,910.00 Construction Management (staff) $45,000.00 $43,000.00 Contingency $50,000.00 TOTAL: $866,231.73 $854,742.18 *This cost includes total amount spent to date for all four locations and for these phases. These projects have gone through multiple scope changes, time extensions, and staff changes since 2006, which is why the costs prior to construction are more than would typically be seen based on the construction value. After retention release, staff will seek reimbursement and project closeout with FEMA. Following the acceptance of the project, the City Clerk will file a Notice of Completion with the Sonoma County Recorder and the Finance Department will release the contract retention account to the contractor within 60 days. Location Map Attachment 1 RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE CONTRACT FOR THE VARIOUS LOCATIONS ROCK SLOPE PROTECTION PROJECT WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, the City of Petaluma solicited bids for the Rock Slope Protection Project, which included Rock Slope Protection at the following locations: B Street at the River, Noriel Creek, Riverbank at Copeland, and the Old Redwood Highway twin bridges; and WHEREAS, the Project was advertised on June 24 and July 3, 2014, and two (2) bids were received and opened on July 16, 2014 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Coastside Concrete from Santa Rosa, CA for $433,910.00; and WHEREAS, by Resolution 2014-130 N.C.S. , adopted on August 4, 2014, the City Council found the bid of $433,910 for the Project to be the lowest responsive bid, awarded the Project to Coastside Concrete, in the amount of $433,910 conditioned on Coastside Concrete, timely executing the Project contract and submitting all required documents and authorized and directed the City Manager to sign the Project contract on behalf of the City, upon such timely submission and to execute on behalf of the City any amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City; and WHEREAS, the final construction contract amount, as amended, including all change orders, is $433,910; and WHEREAS, the estimated total cost of the Project is $854,742.18, and is within the approved project budget; and WHEREAS, the Project was inspected and it was determined that the Project has been completed in accordance with the contract requirements, and the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, it is recommended that the Project be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: The contract entitled Various Locations Rock Slope Protection Project, City Project Nos. / FEMA Nos. 1700111806 / PWl 118, F00127706 / PW1277 F00242006 / PW2420, F00332906 / PW3329, with the final construction contract amount of $433,910 is accepted as complete, subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. The Public Works & Utilities Department & Finance Department is hereby authorized and directed to release all undisputed retention within 60 days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law. 4 Affachinent 2 VARIOUS LOCATION ROCK SLOPE PROTECTION PROJECT PROJECTNO.
