Planning Commission appointments to PBAC and TAC The Commission appointed Commissioner Benedetti-Petnic to the Tree Advisory Committee and made nominations for PBAC and will vote at the next meeting. COMMISSION COMMENT A. Council Liaison Council Member Miller reported about the recent City Council meeting, where the EIR was certified for the Riverfront project. Council heard about staff update on the Lynch Creek Plaza project (Walgreens). Council voted to place a one cent tax measure on the ballot in November. Chair Wolpert City Council Member Miller B. Pedestrian and Bicycle Advisory Committee Commissioner Marzo absent. No report was made. C. Tree Advisory Committee Commissioner Benedetti-Petnic reported that at their last meeting the committee reviewed draft plans to rework Center Park. They also looked at a proposed project to enhance the Little League field by Safeway where they are reaching out to neighboring businesses to become involved and are trying to facilitate the neighborhood process. There was discussion of trees at public parks in the City that need to be maintained or replaced. There was also discussion about two existing Redwoods at Avila Ranch subdivision that a public member mentioned at the City Council hearing. Other Commission Comment 6. STAFF COMMENT A. Planning Manager's Report Planning Manager, Heather Hines, gave her manager's report. At the last Council meeting, the Avila project received its second reading of the ordinance and the Council introduced an ordinance for rezoning and approved the tentative subdivision map for the Riverfront project with conditions allowing a natural grass field surface and a donation to other ball fields in the City. A revised Lynch Creek project will be coming back to the Commission in September. The Addison Ranch rezone will go to Council in August before its SPAR review. The Public Art Committee is looking at a call for artists for a piece of art in the waterfront area. Mr. Flum stated that according to the County water agency, increased sedimentation and riparian growth is a natural evolution of a creek. Twenty years ago developers turned the creek into a drainage channel, and the creek is gone forever. The increasing sedimentation causes increasing amounts of stormwater on the streets. The County says that cutting reeds is ineffective and clearing sedimentation is risky, producing downstream blockages. Mr. Flum feels that this is a red flag and the same consequences are being experienced right now. Many people are extremely nervous about this proposal because it will destroy a 20 year old detention pond that they depend on. The Water Agency has been Planning Commission Meeting of July 22, 2014 Page 9 contacted and they say that a natural creek can't be cleaned up and maintained unless the developer puts up bonded funding. Mr. Flum believes that an onsite detention pond would not be sufficient because in a deluge, it would catch the water and slowly release it, which is not acceptable. The neighbors have seen water damage due to their homes being inundated with water. There are effective policies in place related to building in flood plains. He feels that this proposal is contrary to these policies. He feels that an approval would set a bad precedent and this developer becomes exempt from policy had it been within the city limits. He stated that there are predictions of 100 year floods and water temperature rising, but people live with these issues now and they all oppose this project. Steve Giraud, property owner at 1613 Andover Way. Mr. Giraud's main focus was on the issue of safety and he is very concerned about 354 additional car trips daily passing his driveway. He believes that if emergency vehicles come though, the width of the street will be reduced to 18 feet. He handed out a flyer that included an alternative rendition with a direct link to Corona instead of feeding 354 cars though his neighborhood. Laura Giraud, property owner at 1613 Andover Way, addressed the urban growth boundary. She stated that she is in favor of smart growth but has a real concern regarding annexing these properties. She believes that the boundary for this project is vitally important in terms of the annexation. She stated that the zoning and city limit maps are saying that UBG for Corona Road is on north side and staff is stating it is on the south side. She suggested that the developer include Corona Road in the annexation to allow access to Corona Road and not have traffic go through the neighborhoods. The County is in favor of the City annexing road. Corona Rd from No McDowell to the roundabout is already in the city limits. To signalize the intersection at Corona Road would allow for an ingress and egress to the development. She believes that traffic impacts are also an issue and stated that the current conditions at the Corona and Ely intersection is at a Level E and with this development it would go to Level F. She believes that this intersection needs to be reviewed for safety. Ms. Giraud suggests to put an assessment on new homeowners to pay for annexing Corona Road, for a signalized light onto Corona Road, and to maintain the greenbelt to keep the rural character of the exisitng neighborhoods. Chair Wolpert Seymour Blau, public member, is opposed to the proposed project. Mr. Blau stated that he lives across the street from the creek and is concerned because the creek has not been cleaned out in the 14 years he has lived there. There are trees growing in it and garbage that creates blockage. During the last EI Nino year, the creek flooded due lack of maintenance. He stated that the basin will retain more water to add additional water to flow into the creek. He stated that the former developers said they would never build on that area. He is afraid of this development. Chair Wolpert Dave Salaun, public member, stated that he read in the Argus that there were proposals for Planning Commission Meeting of July 22, 2014 Page 10 future development of 1,400 units in Petaluma. Mr. Salaun asked where the water will come from. Brian Clarke, public member, encouraged the developer to annex Corona Road. He heard about the Level F at Ely and is curious about the level at the roundabout area. There has been a recent influx of college students going though there and families going to school and is a very busy intersection. He suggested annexation of Corona Road with the project, add public utilities to provide sewer, and dispose of the water into the catch basin. Mr. Clarke is concerned that there are currently no sidewalks. There is a new public health center at No McDowell and no sidewalks to access that facility. Currently, there are entire families walking in the middle of the road to get there. Mark Bisordi, public member, stated that there is indication that an engineer will review the detention basin on an annual basis and he wants to make sure there are funds available for this maintenance. He suggested to involve the neightborhood in planning the design features for the landscaping. He also pointed out that there might be a conflict with the Kennilworth and Corona Creek School hours and the detention pond construction traffic and it needs to be addressed. Chair Wolpert Elizabeth Borg, public member who lives on Stonehedge Road. She is concerned about traffic on Mauro Pietro, Stonehenge, and Monica Lane. She also stated that there have been flooding problems in her neighborhood and at times the rain has come down the street onto the sidewalk. If this project is built, Ms. Borg belives that there would be more flooding and is concerned about needing flood insurance that many people can't afford. She is also concerned about the value of the existing houses going down. Chair Wolpert Philip Broughton, public member, living on Mauro Pietro Drive. Mr. Broughton stated that he was involved in this proposed project seven years ago and the issues were the same. The City put up speed limit signs that do not keep people from speeding. He stated that if the streets are widened by adding red stripes, this will reduce the existing street parking which will result in nowhere for guests to park. He feels that it was a bad design and a mistake back then. Morgan Giraud, public member living at 1613 Andover Way. She stated that water has always been an issue on the first floor of her house. Over the past 8 years, moisture has continued to seep through the floor, spreading throughout the house. She stated that the houses along the perimeter of the 10 acres all have issues. By adding more homes, the problem will continue. Ms. Giraud presented an example of a similar situation. When the new Kenilworth School was constructed, they built a retention pond and it failed, and therefore, the gym floor at the school had to be reconstructed. Michael Likens, public member, stated that it looks like the proposed project is improving the drainage for the new development, but not addressing some existing flood concerns. He is concerned about the traffic on Mauro Pietro. To add more traffic doesn't make sense and the Planning Commission Meeting of July 22, 2014 Page 11 developer should annex the road. Laura Shaw Miller, homeowner on Andover Lane, is very concerned about water issues. She lives in one of the homes that backs up to the project. Her house has had water issues and tile floors had to be replaced. Ms. Miller is concerned about the proposed retention pond behind her house. Currently, when it rains there is a bee infestation and the cement remains wet. Many homes have siding issues from the moisture. She is also concerned that Corona Road will not be annexed. When she purchased her home, she was told that the houses on Monica Lane were zoned as two acre parcels and she bought her home under that stipulation. They should be annexing Corona Road because Monica Lane is so narrow. They want to add over 30 houses. Looks like someone threw a handful of lots on a piece of paper. She believes that Mauron Pietro would be a nightmare and is concerned that accidents will happen. Patrick Bentivegna, public member, has lived on Mauro Pietro for 17 years and has some concerns. Mr. Bentivegna stated that if Corona Road were to be annexed that about 80% of the people here would be happy. He believes that red striping the street would create a bigger problem because it clears the runway for speeders. Be believes that no one knows what Mello Roos bonds are and no one knows the answer. A bond to pays for the school. We are all paying for it. Superintendent does not know. Find out how the prop taxes can be lowered. Rich Walsh, property owner on Andover Way for 10 years. Mr. Walsh stated that purchasing this property was the biggest investment of his life and the decision was made based on what the government told him about the neighboring subdivision. He stated that he made this investment and now the value of his house will be lowered. He stated that the City says that flooding will not occur and that nobody will get hurt and traffic doesn't make a difference. Mr. Walsh stated that this is another example of greedy government going after taxpayer dollars. Justin Weeks, public member living close to the proposed detention basin. Mr. Weeks stated that he has read the Initial Study and Negative Declaration and has questions on the detention basin. The detention basin is subject to approval of the public improvement plan. What if is does not get approved by the improvement plan? There is a a mechanism to ensure levy funding for ongoing maintenance. What does this landscaping assessment district look like? What areas of Corona Creek will be maintained and under what circumstances? A statement in the document says to repair damaged streets and slurry seal damaged roads. The construction traffic will go onto Ely. Who is responsible for Ely as far as road maintenance from construction? Why are there no green space or parks in this subdivision? Jeremy Grenert, recent property owner on Corona Road. He believes that the proposed plan has a lot of gaps. He feels that traffic needs to be properly addressed. There will be a ton of cars going through the neighborhoods causing congestion and will be a safety issue for children. He stated that there are a lot of water problems on the floodplain area and there is water issues on his property. Mr. Grenert stated that the three houses outside of the proposed project share a well and he would like to see an agreement to make sure that everyone has access to that well water. He is also worried about an annexation to the City and hopes that a lot of thought goes into this because there are a lot of gaps. He is concerned about his children walking to school with the large construction semi -trucks and does not feel that is will be safe Planning Commission Meeting of July 22, 2014 Page 12 for the children. He also stated that if the creek is not maintained, flooding will be an issue. Chair Wolpert Wolpert received 23 copies of Corona Road "Neighborhood Reponses" to add to the public record.
