HomeMy WebLinkAboutResolution 2010-131 N.C.S. 07/19/2010Resolution No. 2010-131 N.C.S. of the City of Petaluma, California AC'CEP'~'ING COIVIP~ETION OF TI~E WASTE AC'TIVATED SL,YIDGE Pi1MP ST'ATION IMPROVEIVI~N'I'S PROJEC'I' NiJ~VIBER C66401004 WI-IEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Sewer Outfall Replacement Project ("Project"); and, WI~EREAS, bids for the Project were opened on October 7, 2009 in accordance with California Public Contract Code Section 4104.5 and other applicable law; and, WI-IEREAS, the apparent low bid for the Project was the bid of Cats 4 U, Inc. in the amount of $139,992; and, WHEREAS, by Resolution No. 2009-179 N.C.S. adopted November 2, 2009, the City Council of the City of Petaluma found the bid of $139,992 for the Project to be the lowest responsive bid and awarded the Project to Cats 4 U, Inc. in the amount of $139,992 conditioned on Cats 4 U, Inc.'s timely executing the Project contract and submitting all required documents and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City so long as such amendments do not increase the original contract not- to-exceed amount by more than $25,000; and, WI~ER~AS, the following change orders (CO) affecting the Project amount have been approved: CO No. 1: Modifications to electrical panel and supports; add additional valves $ 5,620.13 CO No. 2: Modifications to piping, hose bib and magmeter $ 2,348.00 CO No. 3: Modifications to painting, gauges, rotometers and drains $16,736.96 Total Change Orders: $24,705.09; and, W~IER~AS, the final contract amount as amended ir~cluding all change orders is $164,697.09; and, WI~EREAS, City staff has inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and, W~IEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City. Page I NOW, T~-IE~FOIZE, BE IT RESOLVEI) by the City Council of the City of Petaluma as follows: The contract entitled WAS Pump Station Improvements, City Project Number C66401004 with a final contract amount of $164,697.09, is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3. Staff is hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law. Under the power and authority conferred upon this Council by the Charter of said City.
