Summary Statement: Mardel LLC is developing the Rockridge Pointe subdivision comprised of 62 residential lots. A feature of the subdivision is a 1.9 -acre park. The developer has requested credits for constructing the park, with the credits to come from Park Development fees generated by the subdivision only. Following discussions with the City Manager, the developer has agreed to donate the land without cost to the City and request fee credits for the park improvements only. ExEcuuvE SUMMARY: 13 14 The Rockridge Pointe subdivision includes a 1.9 -acre park. The developer has requested fee credits 15 to go towards the construction of the park. Following a meeting with the City Manager, the 16 developer is donating the 1.9 -acres of land to the City, and is requesting fee reimbursement for the 17 park improvements only. The construction fees are to be credited against Park Development Fees 18 generated by the subdivision only. 19 20 21 2. BACKGROUND: 22 23 As part of the Rockridge Pointe (Varnhagen) Subdivision, a 1.9 -acre park was to be included. The 24 developer had intended for the park, which sits on a knoll with views to the West, to be native 25 grasses only. The Recreation, Music and Parks Commission, following staff's recommendation, 26 required a more formal park with sitting areas, some turf, a playground, pathways, a drinking 27 fountain, some formalized vegetation and native grasses. Staffs' experience, especially with 28 Landscape Assessment Districts, is that native grasses are viewed as weeds, and to have a park in the 29 middle of a new subdivision be comprised of such vegetation is unacceptable. 30 The developer has requested that he be able to recover his costs for the development of the park. 31 Following discussions with the City Manager, the developer has agrees to dedicate the land to the 32 City at no cost, and only request reimbursement for costs for development of the park. Park fees 33 generated by the Rockridge Pointe Subdivision are to be used for reimbursing the developer. If the 34 cost of the park is greater than the park fees generated, the additional costs are the responsibility of 35 the developer. 36 City Staff must verify all fees before credit will be authorized by the City Manager. 37 38 39 3. ALTERNATIVES: 40 41 a. Approve the proposed Resolution authorizing the fee credits for building the 1.9acre park. 42 b. Do not approve the recommended resolution, resulting in the park being downgraded to an open 43 field with native grasses only. 44 45 4. FINANCIAL IMPAcrs: 46 47 Costs for developing the park would be charged towards Park Development Fees generated by the 48 subdivision. Park fees to be generated by the 62 -unit subdivision would be $246,388. While the cost 49 estimate for the park has not been finalized, it will cost at least that amount. CONCLUSION: A public park is needed in the west quadrant of the City. The nearest park is in the Victoria Sub- division, and it is a private facility. The proposal before the City Council provides a nice amenity for the subdivision and the general public of the City. With the arrangement negotiated, development of the park will not cost the City any out of pocket expenses. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: The developer will construct the proposed 1.9 -acre park as approved by the Recreation, Music and Parks Commission. City staff will provide inspection during critical elements of the parks construction. Once the park is completed, staff will provide verification that bills submitted by the developer are substantiated prior to any fee credit authorization by the City Manager. 7. RECOMMENDATION: Recommend approval of the proposed resolution. g:/farms/2003 agenda hill APPROVING PARK FEE CREDITS FOR CONSTRUCTION OF A 1.9 -ACRE PARK AS PART OF THE ROCKRIDGE POINTE SUB -DIVISION Whereas, the Rockridge Pointe Subdivision is to have a 1.9 -acre park as an amenity of the subdivision; and Whereas, the proposed 1.9 -acre part: will have sufficient amenities to provide a public neighborhood park in an area deficient of public parks; and Whereas, the Developer, Mardell LLC has requested reimbursement from Park Development Fees for development of the park; and Whereas, Mardell LLC has agreed to dedicate the land for the park to the City without cost, and to request reimbursement for verified park improvements. Now, Therefore, Be It Resolved, that the City Council hereby authorizes Mardell LLC, the developer of a 1.9 -acre park in the Rockridge Pointe Subdivision, to receive reimbursement from Park Fees generated by the Rockridge Pointe Subdivision only, for development of park amenities in said park. The City Manager will approve such credit of Park fees only after receipts and invoices have been verified by City staff. SLtg i 4) Ila.
