SUBJECT: Resolution.Rafifyirig the Contract for the Adobe Creek Emergency Sewer Main
Repair Project (066401105), Authorizing the Inclusion of the Necessary Budget
Adjustment in the 1St Quarterly Budget Adjustment Ordinance and Approving the
Project Budget
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution ratifying the contract. for
,,,,, , the Adobe Creek Emergency, Sewer Main Repair Project (066401:105), authorizing the inclusion
of the necessary budget adjustment in the 1St Quarterly Budget Adjustment Ordinance and
approving the project budget.
BACKGROUND
In 1978, in conjunction with the Casa de Arroyo Subdivision a 6" sanitary sewer main was
installed under Adobe Creek approximately 150' north of Lakeville Hwy between Rancho
Bonito Drive and Casa Verde Circle (see attached map). This section of pipe is approximately
140' in length.
During a recent routine cleaning, the. equipment became jammed and an investigation into the
reason was begun. Attempting to,linspect'the existing line via televised inspection proved to be a
problem due to the inflow of groundwater into the main. .
City Staff solicited bids from three local contractors to repair the sewer :main and to stop the
infiltration. A Minor Construction Agreement was. executed with J., F. Pacific Liners, Inc.; of
Vacaville; CA, to clean, :inspect and grout approximately 140 feet of 6" sewer pipe. During the
first day on the job, Pacific Liners' crew could not patch any of the. breaks in the line due to the
condition of"the pipe and had to pull offthe job. A$erreview of their inspection video, it
became obvious that the pipe condition was too deteriorated to repair.
Due to the location of the `pipe, under Adobe Creek, a decision to replace the pipe immediately
under an emergency contract was determined to be the most environmentally sound action.
Reduction of flow in the creek or'~the below surface groundwater could result in a flow of
untreated wastewater out of the severely corroded pipe.

DISCUSSION
The least intrusive option is to replace the existing sewer main using apipe-.bursting technique.
This method consists of pulling a cutter 'head and a new 6" pipe fo "burst" thru the existing main
while at the same time installing ~a;new "line. A pipe bursting .operation may not be physically
possible due to the curvilinear alignment of the pipe, `the possibility of`concrete encasement, and
an accumulation of significant gravel in the pipe section. A second' option is to lay a new 6"
main by conventional methods.
Option 1 does not involve in=creek work.. Option 2_ would require diverting creek flows with a
temporary dam structure and',pipe to allow excavation and replacement. Restoration of creek
area affected by the work would be .conducted immediately per regulatory permit conditions.
SWCA, DF&G and RWQCB gall are aware ofthese options; City staff will keep there updated on
the progress and will obtain any additional permits necessary for the emergency work.
City Staff met. with Team Ghilotti,~''Inc., (TGI); of Petaluma, CA to 'discuss replacement options.
TGI is local and large enough to complete'the job quickly and.effi~ently. The City negotiated a
time and materials contract with TGI to include both courses of ;action. If the pipe bursting
method is stopped due to the existing conditions, TGI'would immediately move to replace the
pipe using conventional methods The other local, large firm; North Bay Construction, is not
currently accepting new contract's pending purchase by Ghilotti Construction Co., in Santa Rosa,
California.
Team Ghilotti, Inc.. has performed ;similar projects for the City o f Petaluma. Staff verified that
Team Ghilotti, Inc. possesses a valid ,Class A California Contractor's 'License, license number
895384, which expires on 4/30/201:1, that qualifies Team Ghilotti; nc. to perform the work.
Due to.the serious nature of the event, a'contract was awarded. on an emergency basis for an
amount not to exceed $155,000. The action requested of Council i"s ratf cation of the contract

WHEREAS, a 6-inch sewer main running from Rancho Bonito Drive and Casa Verde Circle,
beneath Adobe Creek approximately 1,50' north, of Lakeville Hwy and serving 45 residences in
the Casa de Arroyo Subdivision has deteriorated and is experiencing severe groundwater
infiltration that poses a clear and imminent danger, requiring immediate action to prevent or
mitigate the loss or impairment of an essential public service; and qualifies as an "Emergency"
under Section 1102 of the Public Contract Code; and
WHEREAS, Article X, Section 68 of the City of Petaluma Charter provides that repair of all
public buildings and works requiring expenditures specified in the section;must be awarded to
the lowest responsible bidder pursuant to procedures established by ordinance adopted by the
City Council; and
WHEREAS, Section 4.04.050 of the.Petaluma Municipal Code provides that the bidding
procedures set forth'in Sections 404.080~~throug ~ 4.01' '1!00 ~oftle Code in accordance with the
City charter maybe dispensed with when an emergency requires that an order be placed with the
nearest. available source of Supply;, and
WHEREAS, the Water Resources and Conservation Department pursued the repair of the sewer
main until the work exceeded the capabilities of the equipment :and technology available to the
contractor contracted to repair the leaks; and
WHEREAS, the repair requires the assistance of a gerieral contractor experienced in the
replacement of public sewer mains. and deep trench excavation; and
WHEREAS, the Project is Statutorily exempt pursuant to California Environmental Quality Act
("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section
15269,. subparagraphs (b) and (c) since the project consists of emergency repairs to publicly or
privately owned facilities nec'essar'y ,to maintain°scrviee essential to the~publie health; safety or
welfare; specific actions necessary to prevent or mitigate an emergency.
WHEREAS, in the case of an emergency, Section 22050 of the Public- Contract Code authorizes
a public agency, pursuant to a four-fifths majority of its governing body, to repair the public
facility without giving notice'for'bids to let contracts; and

A. Pursuant to California Public Contract Code Section 22,168, the public interest
and necessity demand the 'immed'iate commencement of the above-described work at
Adobe Creek Sewer 1Vlain,and the expenditure ofpublic money for such work to
safeguard life, health and..property;
B. Pursuant to California Public Contract Code Section 22050; substantial evidence
as set forth in the staff~report prepared concerning this Resolution; and as set forth in this
Resolution, establishes thattlie emergency conditions at Adobe Creek Sewer Main would
not permit delay resulting ~from,competitive solicitation forbids for the work required as
described above, and such work is necessary to respond to the emergency conditions with
the Adobe Creek Sewer Main;
C. Competitive bidding ofthe emergency work required with the Adobe Creek
Sewer Main would jeopardize the public health; safety.and welfare; and risked further
damage to public and private; property; and resulted in ,the public incurring .additional
expense, including, but not limited to, additional expense due to delay and possible
environmental.impacts and regulatory fines, and therefore,competitive bidding of such
work would not produce an .advantage for the public;

exempt, from California Public Contract Code competitive bidding requirements pursuant
to California Public Contract Code Sections 20.168 and 22050 and the established
common-law doctrine-articulated in the case of Graydon v. Pasadena Redevelopment
Agency (1980.) 104 Ca1:App. 3d 631. As-well, award of contracts for the sewer main
repair work is exempt from competitive bidding requirements in the City of Petaluma
Charter and Municipal Code. in accordance with Section 4.04.050 of the Petaluma
Municipal Code.
5. The City Manager and/gr his designee is authorized, to-execute on behalf of the. City of
Petaluma a time and materials construction agreement with Team Ghilotti, Inc. for the
Adobe Creek .Emergency Sewer Main Repair for a not to exceed amount. of $155,000 for
the performance of the. emergency work described above and _on terms and conditions
that are appropriate: for such projects, as approved by•the City Attorney.
6. This resolution shall become effective immediately.
