BACKGROUND
On February 22, 20'10, the City Council considered the. Sunnyslope II project application for a
Mitigated Negative Declaration, PUD Amendment, and Vesting Tentative Map. After receiving
public comments, and following Council deliberation, the City Council continued the item to
Alpril 5, 2010 in order to allow for project revisions in response to the Council's direction.

On March 16t" the applicant submitted a request for continuance to the June 7, 2010 City Council
meeting to allow adequate time for revisions, additional neighborhood outreach, and staff review
and analysis. The City Council continued the item to June 7, 2010.
~On May 11`" the applicant submitted 'a subsequent request for continuance to a dateuncertain,
jciting disagreement. abouf the cost recovery balance. In the interest.. of meeting the Council's
expectation that this matter be processed expeditiously, staff recommended continuance of this
°~-item to a date certain. The City Council continued the item to August 2, 2010.
bn July 12, 2010 the applicant requested a further continuance to September 13, 2010 because of
!the applicant's family vacation.

DISCUSSION
Staff has maintained regular communication with the applicant's rcpt-esentafive to stay up to date
on proposed project-revisions. Most recently Staff met with the applicant on July 1,.2010 to
discuss tentative revisions to the project to address the Council's direction. The applicant has
agreed to hold a neighborhood meetingpriorto returning for Council review. Also, the City
Attorney has provided information and answered applicant' questions about cost.recoyery
charges. The applicant acknowledges the balance due and has agreed to pay°the outstanding
balance and bring the cost recovery deposit up to a level deemed sufficient by staff to allow
continued. processing. Continued processing also requires information not yet received from
applicant about the project revisions the applicant wishes to make in response to prior Council
comments.
However, in the absence of revised plans responsive :to the: Council's direction and payment of
the outstanding cost recovery balance, staff concurs that:. further continuance of the item is
necessary. Staff recommendsthat the project be continued to September 13, 2010 and has sent
the applicant associated deadlines to ensure continued progress. along this timeline.
FINANCIAL IMPACTS
The project is subject to cgstrecovery. Processing costs paid to date are approximately
$119,000. This account' currently has a negative balance of $36,5.48.3 8, An .additional deposit
has been requested to ensure that funds are available for remaining cost recovery work.
