IBC®MIVIENDATION Introduce an ordinance establishing radar enforceable speed limits, on certain streets within the City of Petaluma. BACKGROUND Engineering 'and traffic surveys must be conducted prior. to establishing speeds limits on an existing street. Traffic conditions may change as a result ,of street improvements, development, or changes in traffic and/or pedestrian use, which. necessitate. establishing radar enforceable speed limits for the safety of the traveling public and pedestrians. Existing speed zones will not change if there is no significant change to existing traffic conditions. I)ISCIJSSLON The Traffic Engineering pvision of the Public Works Department has conducted updated studies to amend or re-establish the speed .limit on thirteen City street segments for the safety of the traveling public. These.sections are in addition to the segments updated in December of 2009, with the exception. of Weaverly Drive. Subsequent to adoption of the December 2009 ordinance, Public Works staff discovered a typographical error on the Weaverly Drive survey. Based on this, Weaverly Drive has been adjusted accordingly in this agenda bill to accurately reflect the speed survey data. - The California Vehicle Code (CVC) and California Manual on Uniform Traffic Control Devices (MUTCD) require that an engineering aril traffic survey be performed to determine and establish prevailing speeds. Agencies are required by the CVC and MUTCD to set posted limits at the 8S`" percentile speeds; obtained during the speed survey,, There are four street segments, shown in bold letters on the table below, in which speed limits are. .required to be increased by 5 MPH. The 85`h percentile speed for each of these four segments was 9-10 MPH above the current posted limit. In these cases, the engineer of record ,has. the authority and discretion to Agenda Review Dept. Director City Attorney finance Director ~ City Mana recommend dropping the new limit by 5 MPH for reasons such as higher than expected collisions, road width, curvature, grade and other alignment conditions. The speed limit does not change for the other nine segments, but the surveys are still required to revalidate existing posted speed limits. Individual street segments for the speed surveys are available for review upon request. Updating the surveys allows the Police Department patrol officers to issue citations for speeding violations, which promotes increased safety on public streets. Additionally, if the City did not update its speed surveys, a loss of revenue would occur, due to the inability of the Police Department to issue citations for vehicular speeding in unenforceable speed zones. Seconded by AN ORDINANCE TO ESTABLISH RADAR ENFORCEABLE SPEED LIMITS ON CERTAIN STREETS WITHIN THE CITY OF PETALUMA BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The City Council of the City of Petaluma hereby declares that it would have passed and 'adopted. this Ordinance and each and all provisions fhereof, irrespective of f he fact that any one or 'more of said provisions be declared unconstitutional, unlawful or otherwise invalid., Section 4.
