HomeMy WebLinkAboutStaff Report 3.F 01/26/2015(i) DATE: January 26, 2015 Agenda Item #3a TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan St. John, RASCE — Director, Public Works & Utilities Larry Zimmer, P.E. — Deputy Director, Public Works & Utilities SUBJECT: Resolution Authorizing Award of Contract for the Marina Fueling System Upgrade Project (C64501401) and Approving the Revised Project Budget RECOMMENDATION It is recommended that the City Council approve the Resolution Authorizing Award of Contract for the Marina Fueling System Upgrade Project (064501401) and Approving a Revised Project Budget. The Petaluma Marina has historically provided gas fuel service at the transient dock next to the boat launch ramp. In 2012, a small leak was discovered in the existing fuel system and the system was properly shut down to prevent any contamination while a repair was planned. During that process, staff determined that due to updated codes it was more cost effective to replace the tank rather than attempt to repair the existing tank. This project will upgrade the Petaluma Marina's fuel system to meet current State and regional regulatory code requirements as well as future requirements expected to go into effect over the next couple of years. In addition the project will allow expanded services to provide diesel fuel along with gasoline to serve more users of the Marina and the Petaluma River. Currently, the marina is the only fueling option for boats in the water on the River. DISCUSSION This project includes design, construction, and permitting for the removal of an existing aboveground 1,000 gallon tank and fueling system and the installation of a new fueling system. The new fuel system will include an aboveground 2,000 gallon two compartment gasoline and diesel tank, tank top equipment, concrete slab, secondarily contained product and vapor recovery piping to and from the dispenser, two -product dual hose dispenser with contaimnent basin, security fencing, and repairs to existing bollards adjacent to the tank. The upgrading of the Marina Fueling System will make the facility compliant to current code. The Notice Inviting Bids was advertised on November 18, 2014; five bids were received as follows: Name of Bidder Bid Total Franzen Hill Corporation, Inc. $157,963.00 Lowest Responsible Bidder Gettler-Ryan, Inc. $166,440.00 Paradise Mechanical $186,432.00 West -Star, Inc. $202,659.00 Gems Environmental $303,844.17 Engineer's Estimate 1 $140,000.00 The lowest responsible bidder, Franzen -Hill Corporation, has performed a variety of similar projects for various cities in southern California. It is verified that Franzen -Hill Corporation possesses a valid Class A, B and D40 California Contractor's License, license number 304147, which expires on July 31, 2015, which qualifies Franzen -Hill Corporation to perfornl the work. Constriction is scheduled to begin in April and to be completed by July 2015. It is anticipated that constriction management and inspection services will be conducted by City staff with assistance by an outside consultant for geotechnical and material testing. The proposed action meets Council Goals: "Plan for and implement priority capital projects as funding permits." FINANCIAL IMPACTS This improvement will generate additional revenue from refueling the diesel vessels in the Marina and River. Location Map Attachment 1 RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE MARINA FUELING SYSTEM UPGRADE PROJECT C64501401 AND APPROVING A REVISED PROJECT BUDGET WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for the Project; and WHEREAS, the project was bid on November 18, 2014, and five (5) bids were received and opened on December 10, 2014 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Franzen -Hill Corporation from Tulare, CA for $157,963.00; and WHEREAS, the lowest bid amount of the for the Project was higher than the budgeted amount of $140,000 for Construction; and WHEREAS, it has been determined that the Contractor's bid satisfies the bidding requirements for the Project; and WHEREAS, it is verified that Franzen -Hill Corporation possesses a valid California Contractor's License, Class A, B and D40 California Contractor's License, license number 304147, that qualifies Franzen -Hill Corporation to perform the Project; and WHEREAS, the approved FY 14-15 CIP Budget is not sufficient to fund the project based on actual bid prices and cost of project management and design services; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ("CEQA") and Title 14, the California Code of Regulations ("CEQA Guidelines"), Section 15301, because the project would result in negligible or no expansion of use beyond what currently exists. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Approves the revised project budget, including the transfer of additional $20,000 from Marina Operating Funds to augment funding approved in the FY 14-15 CIP budget for the Project. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of Franzen -Hill Corporation for the Marina Fueling System Upgrade, Project No. C64501401, and finds the bid of $157,963 to be the lowest, responsive bid and further finds that Pullman is the lowest responsible bidder. 3. Awards the contract for the Marina Fueling System Upgrade, Project No. C64501401, to Franzen -Hill Corporation in the amount of $157,963, the amount of the lowest responsive bid, conditioned on Franzen -Hill Corporation's timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to Franzen -Hill Corporation. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Franzen -Hill Corporation of the signed project contract and all other required document, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
