HomeMy WebLinkAboutStaff Report 3.E 01/26/2015Agenda Item #3.E a0 X85$ Civ DATE: January 26, 2015 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan St. John, F.ASCE — Director, Public Works & Utilities Joe Rye — Transit Manager SUBJECT: Resolution Authorizing the City of Petaluma to Enter into a Caltrans Standard Agreement to Receive FTA Section 5339 Funding, and Authorizing the City Manager to Execute Such Agreements RECOMMENDATION It is recommended that the City Council adopt a Resolution Authorizing the City of Petaluma to Enter into a Caltrans Standard Agreement to Receive FTA Section 5339 Funding, and Authorizing the City Manager to Execute Such Agreements. BACKGROUND Since 2012, the Metropolitan Transportation Commission (MTC) has added FTA Section 5339 (5339) Funding into the regional Transit Capital Priorities (TCP) Program. The TCP program distributes the region's FTA (Federal Transit Administration) 5307 (5307) and 5339 funds to transit agencies based upon a priority process. The addition of 5339 was a new development and not anticipated for the 2012 MTC TCP process, and thus, when the City Council approved the City's application for TCP projects on December 3, 2012, there was no mention of the 5339 program in the authorizing resolution. Effective with the recent MTC call for projects for fiscal years 2014-15 and 2015-16 (FY15 and FY16), approved by City Council on November 17, 2014, the authorizing resolution was modified to include 5339 in addition to the traditional FTA Section 5307 funds. FTA 5307 and 5339 funds are allocated by formula to different Urbanized Areas (UA) within the region. Along with Golden Gate Transit and Sonoma County Transit, the City of Petaluma is eligible to compete for finds within the Petaluma UA. To facilitate the distribution of funds within the region, MTC has developed the Transit Capital Priorities (TCP) program for allocating funds to the individual transit operators within the region. Replacement vehicles, including projects directly involving revenue vehicles, such as AVL Systems, radios, and fareboxes, are the highest scoring proposals. hi most years, the region receives only enough funds to cover these needs. DISCUSSION Since 2008, Petaluma Transit has obtained 5307 funding to replace buses and paratransit vans, and to support preventative maintenance. The MTC application requires a resolution of support, including a commitment by the City to provide the required local match and to complete the project. The Council -approved resolution of support from the December 3, 2012 meeting did not include reference to approving 5339 funding. At that time, and prior to that date, Petaluma had not been awarded 5339 funding nor was 5339 fimding part of the TCP process. Due to changes at the federal level that occurred at that time, MTC added 5339 funding into the funding mix that is distributed to transit operators through the TCP program. The City's TCP application from December 2012 was successful for funding of two replacement paratransit vans, which have been ordered and will arrive soon. The Transit Advisory Committee approved the City's TCP application at its meeting on October 11, 2012. After thorough discussions, Caltrans has been selected by the FTA to manage the FTA 5339 funding that is distributed to small urbanized areas, such as Petaluma, within the State of California. Caltrans requires that Petaluma execute a Caltrans Standard Agreement to receive the funding. The pending agreement, which will be authorized by this resolution, is for FYI 5339 funds, covering roughly 85% of the purchase of two paratransit vans, with the remainder made up by matching Public Transportation Modernization Improvement Service Enhancement Account funds (PTMISEA). We anticipate that Caltrans will release a call for FY14 5339 funds in the near future, which would result in the award of funds to Petaluma for the purchase of two more paratransit vehicles. The attached resolution meets the requirement by Caltrans for the City to authorize acceptance of FTA 5339 funds through Caltrans. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits". FINANCIAL IMPACTS Matching funds for the projects will come from an existing Prop IB PTMISEA award. The local match of $18,975 is included in Petaluma Transit's capital budget for FY 15. The local match for the FY 14 vans will be included in the FY 16 capital budget. ATTACHMENTS 1. Resolution Attachment 1 RESOLUTION AUTHORIZING THE CITY OF PETALUMA TO ENTER INTO CALIFORNIA DEPARTMENT OF TRANSPORTATION'S STANDARD AGREEMENT TO RECEIVE FEDERAL TRANSIT ADMINISTRATION SECTION 5339 FUNDING, AND AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH AGREEMENTS WHEREAS, the U. S. Department of Transportation is authorized to make grants to states through the Federal Transit Administration to support capital projects for non -urbanized public transportation systems under Section 5339 of the Federal Transit Administration (FTA Circular 9300.113); and WHEREAS, the California Department of Transportation (Department) has been designated by the Governor of the State of California to administer Section 5339 grants for transportation projects for bus and bus facilities; and WHEREAS, the City of Petaluma desires to apply for said financial assistance to permit purchase of capital equipment/vehicle replacement/operating assistance projects in Petaluma; and WHEREAS, the City of Petaluma has, to the maximum extent feasible, coordinated with other transportation providers and users in the region (including social service agencies). NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma that: 1. The City Manager or designated representative is authorized to file and execute applications on behalf of the City of Petaluma with the Department to aid in the financing of capital and operating assistance projects pursuant to Section 5339 of the Federal Transit Administration (FTA Circular 9300.1B); as amended. 2. The City Manager or designated representative is authorized to execute and File all certification of assurances, contracts or agreements or any other document required by the Department to receive funding assistance for the capital or operating assistance project. 3. The City Manager or designated representative is authorized to provide additional information as the Department may require in connection with the application for the Section 5339 projects. 4. The City Manager or designated representative is authorized to submit and approve request for reimbursement of funds from the Department for the capital or operating assistance project.
