Bates, P.E. — City Engineer SUBJECT: Resolution Conditionally Authorizing a Water Connection Outside the Urban Growth Boundary for the Pacific Gas and Electric Substation Facility Located at 3600 Old Adobe Road, APN: 017-140-010 and Providing for Application to the Sonoma County Local Agency Formation Commission for Approval of an Outside Area Service Agreement. RECOMMENDATION It is recommended that the City Council adopt a Resolution Conditionally Authorizing a Water Connection Outside the Urban Growth Boundary for the Pacific Gas and Electric Substation Facility Located at 3600 Old Adobe Road, APN: 017-140-010 and Providing for Application to the Sonoma County Local Agency Formation Commission for Approval of an Outside Area Service Agreement. Pacific Gas and Electric Company (PG&E) has requested to connect one new water service to the City of Petaluma's public water system. The service is proposed to be a two-inch connection with a one -inch meter, and will be for domestic use only. The water service will provide potable water to the restrooms and small kitchen in the existing maintenance yard office and substation control buildings. There is an existing fire protection storage tank located on the PG&E site that is served by an existing well. On January 22, 1991, the City Council adopted Resolution No. 91-16 updating policies for extension of water service outside of City limits. Policy 1-P-30 of the City's General Plan 2025 also restates these policies. The policy allows connection to the City's system upon approval by the City Council for non-residential purposes including public and quasi -public uses existing as of July 20, 1998. Additionally, PG&E has provided a letter dated October 16, 2014 indicating that the existing on- site well does not meet current standards for public water systems and that the well is unacceptable as a public water source. The letter further states that water quality sampling for the well indicated exceedance of maximum contaminant levels for specific conductance and chloride. The outside water service policy limits connection size to three-quarter inches unless otherwise specifically approved by the City Council. PG&E has requested a two-inch connection with a one -inch meter in order to maintain sufficient water pressure at the site. PG&E's Civil Engineer has provided water pressure and flow calculations that demonstrate the need for the two-inch connection with one inch -meter. There is an existing City public water main in Old Adobe Road that PG&E could connect to. Approval by the Sonoma County Local Agency Formation Commission (LAFCO) would be required for the requested service connection outside City boundaries subsequent to City Council approval and prior to issuing construction permits to perform the work. The City is responsible for submitting an application to LAFCO upon Council approval. PG&E would be required to pay City water capacity fees and other connection and meter fees as required. PG&E will also be required to obtain an encroachment permit from both the City of Petaluma and County of Sonoma. In addition, the City requires that PG&E enter into an agreement that runs with the land, which commits PG&E and any future property owner to construct roadway frontage improvements and dedicate necessary right of way should the property be annexed into the City of Petaluma, among other requirements. FINANCIAL IMPACTS PG&E has submitted a development application and deposited the corresponding fees for this request. Staff time is fully recovered through the City's cost recovery system. PG&E is responsible for paying all construction document review and permitting fees, application fees for LAFCO, and water connection fees prior to the issuance of any permits. Letter dated October 16, 2014 from the California State Water Resources Control Board Attaclunent l RESOLUTION CONDITIONALLY AUTHORIZING A WATER CONNECTION OUTSIDE THE URBAN GROWTH BOUNDARY FOR THE PACIFIC GAS AND ELECTRIC SUBSTATION FACILITY LOCATED AT 3600 OLD ADOBE ROAD, APN: 017-140-010 AND PROVIDING FOR APPLICATION TO THE SONOMA COUNTY LOCAL AGENCY FORMATION COMMISSION FOR APPROVAL OF AN OUTSIDE AREA SERVICE AGREEMENT WHEREAS, Pacific Gas and Electric Company (PG&E) has requested an outside service connection to the City of Petaluma Public Water System; and WHEREAS, PG&E has provided documentation that the existing on-site well is unacceptable as a potable water source, does not meet well standards for public water systems and has provided documentation indicating that water quality sampling for the well indicated exceedance of maximum contaminant levels for specific conductance and chloride; and WHEREAS, this action has been determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Section 15301 (existing facilities); and WHEREAS, Pursuant to Resolution No. 91-16 and General Plan 2025 Policy 1-P-30(5), City of Petaluma policy allows extending water service connections outside City boundaries for non-residential proposes including public and quasi -public uses existing as of July 20, 1998, upon approval by the Petaluma City Council, and WHEREAS, Sonoma County Local Agency Formation Commission ("LAFCO") policies, as well as Government Code section 56133 permit approval of agreements for extension of city utility services outside city corporate boundaries where certain specified requirements are met, including extension of such services within a city's sphere of influence in anticipation of a later change of organization or in response to an existing or impending threat to public health or safety, including such threats in the form of an impacted water supply; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Determines that this request is consistent with City outside water service policies concerning non-residential/public and quasi -public users, and the General Plan 2025, including Policy 1-P-30(5). 2. Conditionally approves one two-inch water service connection to the existing water main within Old Adobe Road, with a one -inch meter, for the purposes of providing City domestic potable water service to the existing PG&E maintenance yard office and substation control buildings located at 3600 Old Adobe Road, APN: 017-140-010, subject to required approval of Sonoma County LAFCO. 3. Directs the City Engineer and Planning Manager to submit an application to the Sonoma County LAFCO for approval of an Outside Area Service Agreement ("OSA") between the City and PG&E in a form approved by the City Attorney and City Manager, and to file a Notice of Exemption with the Sonoma County Clerk's Office and to issue the necessary construction permits upon confirmation of LAFCO approval of the OSA and subject to full reimbursement by PG&E for all costs incurred by the City arising from the proposed extension of City services . 4 aul Yc H. ]�C el IO�- 0 O NGn 34 n pC! A request was made for a water supply permit application to be sent as this facility is serving 25 or more of the same persons for more than six months a year which classifies it as a nontransient -noncommunity public water system. A water supply permit application was mailed to you on July 2, 2014. PG&E (System) was able to locate the well drillers log for the well serving this facility. A review of the driller's log showed this well was drilled in 1957 by cable tool method and the "proposed use" noted on the log was "other". The well has no annular sea] and to the question "Were any strata sealed against pollution?", the well driller checked "no" This well is unacceptable as a potable water source as it does not meet well standards for public water systems. Water quality results from an October 16, 2009 sample indicate that the Specific Conductance and Chloride concentrations exceeded the respective Maximum Contaminant Levels. The Division sent a letter to PG&E on July 21, 2014 stating support for the consolidation of small water systems with larger ones. In light of deficiencies of the well, efforts to connect to a nearby municipal supply are encouraged. Please note that the original permit application had a deadline of August 8, 2014. Either a full, complete permit application including an acceptable water source that meets all drinking water standards or a secured water supply connection to a nearby municipal water supply must be completed by December 1, 2014.
