1 ORDERING THE TERMINATION OF A PORTION OF AN EXISTING
2 .IRREVOCABLE OFFER OF DEDICATION OF AN EASEMENT
3 LOCATED ADJACENT TO 616 AND 618 SUNNY SLOPE AVENUE

6 WHEREAS, by an "Irrevocable Offer of Dedication" recorded in the Official Records of
7 Sonoma County, California, on April 1, 1974 at Book 2850, page 1.92, and by "Parcel Map No.
8 4323" recorded on April 5, 1974 at Book 206 of Maps at page 37, Sonoma County Records,
9 Dorothy Y. Rogers made an irrevocable offer of dedication to the County of Sonoma of a 50-foot
10 easement for public road/right of way and public utility purposes adjacent to 616 and 618 Sunny
11 Slope Avenue; and

13 WHEREAS,-the County of Sonoma did not accept the offer of dedication; and
14
15 WHEREAS, the City of Petaluma ,succeeded to the rights of the County of Sonoma in
16 the Irrevocable Offer of Dedication when the subject lands were annexed to 'the City as part of
17 the Sunny Slope Assessment District and Annexation in 1991; and
18
19 WHEREAS, pursuant to California Government Code Sections 66477.2(c) and 7050, the
20 City Council may terminate all or any portion of the irrevocable offer of dedication pursuant to
21 the vacation procedures in California Streets and Highways Code, Division 9, Part 3, Chapter 4,
22 (sections 8330 et seq.); and

24 WHEREAS, the City Council, having duly received and considered evidence concerning
25 the termination of that portion of said irrevocable offer of dedication more particularly described
26 in Exhibit "A" attached hereto and incorporated herein:

28 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
29 Petaluma, pursuant to and in accordance with the authority contained in California Government
30 Code Sections 66477.2(c) and 7050 and Division 9, Part 3, Chapter 4 (sections 8330 et seq.) of

1 the California Streets and Highways Code, that the following irrevocable offer of dedication in
2 said City be, and the same is hereby ordered terminated and forever closed for public access
3 purposes, reserving therefrom the irrevocable offer of dedication of easements for public utilities
4 (including public water mains, public sanitary sewers, public storm drains and Sonoma County
5 Water Agency water transmission lines):

7 SEE EXHIBIT "A" INCORPORATED HEREIN BY REFERENCE

9 BE IT FURTHER RESOLVED that the City Clerk is directed to cause a certified copy
10 of this Resolution, attested by said Clerk under the seal of said City, to be recorded in the Office
11 of the Recorder of Sonoma County, California, and that from and after the date of recordation,
12 the irrevocable offer of dedication described in Exhibit "A" shall be terminated.

PORTION OF "IRREVOCABLE OFFER OF IDEDICATION" FROM 2850 OR 192 TO BE
REJECTED/ABANDONED BY THE CITY OF'PETALUMA
All that portion of that "Irrevocable. Dffer of Dedication" as said offer is described by deed
recorded in book 2850 of Official.Records at page 192, Sonoma County Records and as shown
on "Parcel Map No. 4323" recorded in book 2.06 of 1Vlaps, page 37, Sonoma County Records but
reserving from the herein rejectionlabandonment the right to construct, maintain, operate,
replace, remove, and. renew public-utilities including sanitary sewers,.. storm drains, water mains
and appurtenances, said portion being particularly described. as follows:
Beginning, at a :point on the northwesterly line of Lot 2 as shown on "Parcel Map No. 4323"
recorded in book 206 of Maps, page 37, Sonoma County Records, from which point the
northwesterly corner of said Lot 2 bears S 74°57'04" W, 50.09 feet [1.5.267 meters]; thence from
said. point of beginning and -along the are of a curve to the left, from a tangent that bears. S 18°OS'
56" E, with a radius of350.00 feet. [106:680 meters]; through a central angle of 23°18'30", an arc
length of 142:3.8 feet [43.398 meters], to a point on the southerly line of.said Lot 2, from which
point the southwesterly corner of said Lot 2 bears S 88°42'00" W, 62.70 feet [19.100 meters];
thence along the southerly, ne of'said Lot 2, S 8$°42'00" W, 62.70 feet [F9.100 meters] to said
southwesterly corner of Lot 2; thence along the westerly line of said Lot 2, along the arc of a
curve to the right,, from a tangent that bears N 35°36'42" W, with a radius of 400.00 feet
[121.920 meters], through a central angle of 17°54'11", an arc length of 124.99 feet [38:097
meters], to the point of beginning.
