HomeMy WebLinkAboutResolution 2001-180 N.C.S. 10/15/2001 IZeS®lutl®11 1~!®.2001 -1801r.C.~. of the City of Petaluma, California APPROVAL OF THE PLANNED UNIT DISTRICT DEVELOPMENT STANDARDS FOR THE DOUGLAS STREET PEP PROJECT WHICH WOULD ALLOW FOR DEVELOPMENT OF A 23 UNIT SENIOR AFFORDADLE APARTMENT COMPLEX, LOCATED AT 200 DOUGLAS STREET, A PORTION OF APN 008-161-014. WHEREAS, by Ordinance No.2122 N.C.S., A portion of Assessor's Parcel Number 008-161- 014 comprising of 0.84-acre, has been rezoned from Administrative and Professional Office (C- O) to Planned Unit District (PUD); and WHEREAS, by action taken on August 28, 2001, the Planning Commission considered the proposal and forwarded a recommendation to the City Council to approve the PUD Development Standards for Douglas Street PEP, to allow a 23 unit senior affordable apartment complex; and WHEREAS, the City Council finds that the requirements of the California Environmental Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and adoption of Resolution No0 1 _ 1 7 T.C.S., approving a Mitigated Negative Declaration to address the specific impacts of the Douglas Street PEP development; WHEREAS, the City Council has reviewed the proposed PUD Development standards, as set forth in the Attachment 2Sub-attachment 6, as revised or modified, and in accordance with the recommendation of the Planning Commission, finds: 1. That the PUD Development Standards will allow for residential uses that are compatible with the existing surroundings uses. The standards have been prepared to ensure that the proposed uses and structures are compatible with the surrounding uses. The proposal results in a more desirable use of the land than would be possible under any single zoning district or combination of zoning districts. The PUD would provide needed housing for very low and low-income seniors. 2. That the development standards for the proposed development presents a unified and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent or nearby properties, and that adequate landscaping and screening is included to ensure compatibility. The Site Plan and Architectural Review Committee (SPARC) will also review the project to ensure that the development standards that are compatible with neighboring developments. 3. That the proposed project has complied with the requirements of CEQA through the preparation and adoption of a Mitigated Negative Declaration prepared for this project. An Initial Study was prepared for the rezoning of the site from CO -Administrative and Resolution No. 2 0 01-1 $ 0 N.C.S. P a g e 1 o f 2 1 r Professional Office to PUD -Planned Unit District which made the determination that no significant environmental effects would result. 4. That adequate available public and private spaces are designated on the Planned Unit District Development Plan. The Development Plan and the Development Standards describe adequate building setbacks acid other project amenities. 5. That the development of the subject property project in the manner proposed by the applicant, and as conditioned, will not be detrimental to the public welfare, will be in the best interests of the City, will be in keeping with. the general intent and spirit of the zoning regulations of the City of Petaluma, and with the Petaluma General Plan, and complies with the applicable provisions of the Municipal Code and the General Plan. Both the Fire Marshal and the Engineering Section have prepared conditions of approval to address fire safety issues, and design criteria for the construction of the buildings. 6. The Douglas Street PEP proposal will help the City further the objectives, policies and programs of the Petaluma General Plan as follows: o Chapter 9, Objective (a): Provide a range of housing types. ® Chapter 9, Objective (b): Preserve and increase the existing supply of rental apartments. ® Chapter 9, Policy 4: The building of housing of underutilized land shall be encouraged. ® Chapter 9, Objective (d): Provide housing opportunities for persons of all economic levels. ® Chapter 9, Program 13: Continue to give priority processing to very low and low- income developments. ® Chapter 9, Program 23: Continue to develop units affordable by the very low- income elderly, using whatever subsidy programs maybe available. ® Chapter 3, Policy 16.2: Mixed-use development is encouraged, particularly within the central area of the City.
