HomeMy WebLinkAboutResolution 2001-181 N.C.S. 10/15/2001 _ ~ Resolution No. 2001 -181N ~ S of the City of Petaluma, California 2 3 a APPROVING A MITIGATED .NEGATIVE DECLARATION FORA 78-LOT RESIDENTIAL s SUBDIVISION LOCATED AT TIFIE SOUTHWEST CORNER OF SONOMA MOUNTAIN 6 PARKWAY AND 1VIARIA DRIVE ~ (APN 137-061-014 & A PORTION OF APN 137-061-01.8 ALSO KNOW AS PARCEL 1 ON s PARCEL MAP 333) 9 io WHEREAS, an Initial Study was prepared and the results of the study indicated that the proposed u "Traditions" Subdivision project, as mitigated, will not cause any significant adverse environmental ~2 impacts; and, 13 is WHEREAS, the Planning Commission of the City of Petaluma held a public hearing on July 24, 2001, is on the subject application, heard testimony and concluded that the findings and conditions as amended r6 were inadequate and recommended to the City Council denial of the proposed development; and i~ is WHEREAS, the City Council considered the Traditions Subdivision proposal on October 1, 2001 and i9 on October 15, 2001 and considered all written and verbal communications concerning potential zo environmental impacts resulting from the project before rendering a decision; zi zz NOW, THEREFORE BE IT RESOLVED that the City Council approves a Mitigated Negative zs Declaration subject to the following Findings and Mitigation Measures described in the Initial ..Study: 2a zs FINDINGS FOR APPROVAL OF A MITIGATED NEGATIVE DECLARATION: 26 z~ 1. That based upon the Initial Study, potential impacts resulting from the project have been identified. za Mitigation measures have been proposed and agreed to by the applicant as a condition of project a9 approval that will reduce potential impacts to less than significant. In addition, there is no 3o substantial evidence that supports a fair argument that the project, as conditioned and mitigated, 3i would have a significant effect on the environment. That all impacts to seasonal wetlands will be mitigated on site and hat the City Council has z reviewed and approved of this wetland mitigation, which will reduce impacts to less than 3 significant. a 3. That the project does not have the potential to affect wildlife resources as defined in the State Fish s and Game Code, either individually or cumulatively, and is exempt from Fish and Game filing fees 6 because it is proposed on existing undeveloped site surrounded by urban development. ~ 4. That the project is not located on a site listed on any Hazardous Waste Site List compiled by the s State pursuant to Section 65962.5 of the California Government Code. 9 5. That the Planning Commission and the City Council have reviewed the Initial Study and considered to public comments before making a recommendation on the project. 11 6. That a Mitigation Monitoring Program has been prepared to ensure compliance with the adopted lz mitigation measures. is 7.
