HomeMy WebLinkAboutResolution 2001-185 N.C.S. 10/15/2001 Resolution No.2~p1-1~5N.C.S. of the City of Petaluma, California 2 DETERMINING THAT THE PREFERRED MEANS OF REDESIGNING THE 4 INTERSECTION OF SONOMA MOUNTAIN PARKWAY AND CORONA ROAD AS REQUIRED BI' POLICY 3 OF THE CIRCULATION ELEMENT OF THE CORONA/ELY 6 SPECIFIC PLAN SHALL BE A "ROUNDABOUT" AND SHALL BE TIED TO THE ~ "TRADITIONS" SUBDIVISION (APN 137-061-014 & PORTION OF APN 137-061-018 ALSO s KNOW AS PARCEL 1 ON PARCEL MAP 333) 9 10 i i WHEREAS, the Planning Commission held a public hearing on the deferral of the requirement to iz realign the intersection of Sonoma Mountain Parkway and Corona Road on July 24, 200.1, after giving 13 notice of said hearing, in the manner, for the period, and in the form required by Ordinance No. 1072 i4 N.C.S., as amended; and is i6 WHEREAS, at the end of the public hearing the Planning Commission voted unanimously to i~ recommend that the City Council deny a Mitigated Negative Declaration and the associated project; i s and i~ zo WHEREAS, the City Council held a public hearing on the proposed project on October 1, 2001 and zi October 15, 2001, after giving notice of said hearing, in the manner, for the period, and in the form zz required by Ordinance No. 1072 N.C.S., as amended, and subsequently approved the Mitigated z3 Negative Declaration and the project; and 24 z, WHEREAS, the City Council has reviewed the requirements of the Corona Ely Specific Plan, and z6 finds that: z~ zs 1. This application only includes a portion of the larger Brody Property (APN 137-061-0.18) z~ and it does not include the area subject to the road realignment. ~0 2. The traffic analysis for the proposed project concluded that the traffic levels on Sonoma i Mountain Parkway at Corona Road and those expected from this development are lower Resat~t~«~xo.2001-185x.c.s. Page 1 of 3 1 i than projected. and that the existing intersection is operating at an acceptable level and, z therefore, no modification to the intersection is needed at this time. 3 3. A fair and enforceable interpretation of Policy 3 of the Circulation Element of the 4 Corona/Ely Specific Plan would be to tie the intersection realignment to the development of the "Traditions" Subdivision (APN 137-061-014 & portion of APN 137-061-018 also know 6 as parcel #1 on parcel map #333) and subject to a General Plan/Corona-Ely Specifc Plan ~ amendment to be completed prior to the approval of a final subdivision map for the s "Traditions" (File TSM00005). 9 io NOW, THERFORE BE IT RESOLVED that the City Council of the City of Petaluma does hereby i ~ determine that the existing "future alignment" of the intersection of Sonoma Mountain Parkway and ~z Corona Road as described in Figure 2-4 page 20 of the Corona Ely Specific Plan (the so-called ~3 "swoop") shall be replaced with a "roundabout" prior to the- approval of the final subdivision map for i4 ``Traditions". Subject to the following conditions, which shall be applied as additional conditions of i ~ the tentative subdivision map: ib i ~ 1. The City shall complete a General Plan/Corona-Ely Specific Plan amendment replacing the i s existing "future alignment" of the intersection of Sonoma Mountain Parkway and Corona Road i 9 as described in Figure 2-4 page 20 of the Corona Ely Specific Plan (the so-called "swoop") with zo a "roundabout" prior to the approval of the final subdivision map for "Traditions'' (File i TSM00005). 22 Reso. 2001-185 NCS Page 2 of 3 2 i ~ 2. The applicant (Ryder Homes) shall be responsible for all costs of the "roundabout" at Sonoma 3 Mountain Parkway and Corona Road, including but not limited to all direct and indirect costs, a expenses and fees associated with construction of the "roundabout", as well as those associated s with the acquisition of property for the "roundabout". In the event the applicant has not ~ obtained sufficient title or interest. to permit such improvements prior to approval of the final ~ map, the City may proceed with negotiations and/or eminent domain proceedings to acquire s such title or interest as further set forth in Government Code Section 66462.5. Under the power and authority conferred upon this Council by the Charter of said Citv.
