AGENDA CHANGES
The December 5 minutes were approved as submitted. Vice Mayor
Harberson announced the "slide presentation on housing density by
People for Open Space" and "continuation of the Capital Improvement
Program projects list" will be considered at the next Council meeting.

Inc.

surplus and authorizing the disposition thereof in accordance

Resolution #9982 N. C. S. accepting completion of the Urban
Separator Storm Water Detention Ponds Project No. 8600
which contract was awarded to Don Dowd Construction
Company.

PETITIONS AND COMMUNICATIONS
PETALUMA/SANTA ROSA RR
Southern Pacific Transportation Company has filed a request with the
Interstate Commerce Commission to abandon the entire Petaluma and
Santa Rosa Railroad in Sonoma County. Petaluma customers affected by
the abandonment are:
l. Hunt & Behrens 4. Diamond International
2. Nulaid Foods Corporation
3, Dairymen Food & Supply 5. Bar-Ale Feed
The City Manager recommended that prior to making a decision
regarding the proposed abandonment, a committee of the Council meet
with the railroad's customers to evaluate the impacts of abandonment
and alternative means of providing service, i. e. N. W. P. R. R. etc.
RAILROAD ABANDUNMENT AD HOC COMMITTEE
Vice Mayor Harberson appointed Councilman Balshaw, Bond and himself to
this Committee.
NEW AND UNFINISHED BUSINESS
ORDINANCE #1569 NCS
SALES AND USE TAX
Ordinance 15 9 amending Sections 4.16.090 and 4.16.130 and repealing
sections 4.16. 091, 4.16.131 and 4,16. 141 of the Municipal Code imposing
a sales and use tax. This change was a mandate of the State Board of
Equalization as a result of 1983 Legislative action.
In order for the State to collect our Sales Tax for us, our Municipal
Code must conform to the State law . Introduced by Councilman Bond
and seconded by Councilman Perry.

DISASTER COUNCIL
Fire Chief Les Lenz recommended the City Council confirm the Director
of Emergency Services appointment of Joseph W. Greely - Chairman,
South County Medical Support Zone; Douglas Arthur - Petaluma School
District; and Melvin Joe Meyers - Old Adobe Union School District to
the Disaster Council. A motion .was introduced by Councilman Battaglia
and seconded by Councilman Perry that the Council confirm these
appointments.

POLIGY REGARDING LOWEST RESPONSIBLE .BIDDER
Resolution #9984 N.C.S. establishing policy relative to the application of
the City's share of sales tax to the determination of the lowest
.respomsible. bidder for purchase of equipment, materials and supplies.

POLICE VEHICLES
Resolution 9985 N. C. S. awarding the purchase contract for fiv.e Police
vehicles to H. C. Ford at 13 Petaluma Boulevard South, Petaluma, for
$52, 979. 20. This takes sales tax revenues into .consideration in
determining lowest responsible bidder. Five sets of specifications were
distributed and three bids were returned. Western Motors - Petaluma
$54, 324, 45, H. C. Ford - Petaluma $52, 979. 20 and Sanderson Ford -
Healdsburg $52,837.69. Introduced by Councilman Battaglia and
seconded by Councilman Perry.

USED CAR - POLICE
Resolution 9986 N.C.S. awar.ding the purchase contract to Hertz
Corporation, 300 East Millbrae Ave, Millbrae, California, for a used
Ford Futura for $6,572.00, in accordance with the recommendation of
the Police Chief . Introduced by Councilman Cavanagh and seconded by
Councilman Perry .

RESOLUTION #9987 NCS
METCALF & EDDY CONTRACT
The Regional Water Quality Control Board has required a more stringent
monitoring 'program as a result of input received from various agencies
~and individual parties. The cost is $31,649 for addi~tional sampling and
$11,436.00 for specification revision. Resolution #9987 N.C.S.
approving Amendment 7 to the Metcalf & Eddy Sanitary Engineering
Contract. Introduced by Councilman Bond and seconded by Councilman
Battaglia.

RESOLUTION #9988 IVCS
DAM SAFETY WASTEWATER PONDS
Staff's recommendation was to adopt this resolution which would exempt
City sewer oxidation ponds from State Division of Dam Safety
jurisdiction. Resolution #9988 N.C.S. determining that the City is
responsible for the supervision and operation of all storage ponds as
required by Section 6025.5 of the State Water Code. Introduced by
Councilman Perry and seconded by Councilman Bond.

Resolution 9990 N. C. S. accepting completion of wastewater treatment
plant upgrade - Project No. 9106 which contract was awarded to

by Councilman Cavanagh.

SEWER LATERALS : LAKEVILLE & STANLEY _.
One project consists of installation of a 6" sewer main in Lakeville
Street from East "D" Street halfway to Jefferson Street in the one lane
between the railroad tracks and the private property to the west.

Portions of the existing 24" sewer main down-stream of this location
collapsed as a result of the January 4, 1982, flood. This project
abandons a portion of the 24" sewer main and installs a replacement 6"
line to service the fronting properties.
The other project consists of installation of a 6" main , in Stanley
Street from Upham half way to Post Street and reconnects the
fronting properties to this. ,main. This will a11ow abandonment of
an under-sized, backyar.d sewer line that causes maintenance
problems . Resolution #9991 N. C. S. approving ~ plans and
specifications and calling for bids for sanitary sewer lines in
Lakeville Street and Stanley Street Project No. 8598 to be opened
January 12, 1984. Introduced by Councilman Bat~aglia and

EQUIPMENT TRAILER
Resolution 9992 N. C. S. approving emergency purchase of a replacement
equipment trailer. The flatbed trailer that was used to haul the
backhoe has a broken axle, and the California Highway Patrol has
declared the trailer unsuitable for use. Introduced by Councilman
Perry and_seconded by Councilman Bond.

RESOLUTION #9993 NCS .
FAU FIVE YEAR PROGRAM
The Gouncil agreed to consider looking at Liberty Street completion
from Magnolia to Sixth Street and other possibilities after Magnolia has
been improved. Resolution #9993 N.C.S. approving 1984-89 Federal Aid
Urban (FAU) programs for Sonoma County which include: 1) Public
Transportation - Bus Shelters, 2) Magnolia Avenue and 3) Liberty
Street. Introduced by Councilman Bond and seconded by Councilman
Perry.

RESOLUTION #9994 NCS
STIP :FIVE YEAR PROGRAM ~
Resolution 9994 N.C.S. approving 1984-89 State Transportation
Improvement Program (STIP) for Sonoma County which includes Route
116-Widening and improvement in Petaluma from Route 101 to Frates
Road. The Board of Supervisors is also urged to continue to express
its support for fhe Highway ~101-Rainier Avenue .Interchange in
Petaluma. Introduced by Councilman Balshaw and seconded by
Councilman Perry. ~ .

VASCO BRAZIL
Vasco Brazil, 4551 Lakeville Highway was given a copy of Resolution
#9987 NCS. He asked if the City is assuming all responsibility for
construction, supervision and management of the wastewater ponds. He
also aslced what responsibility the City accepts and what it doesn't
accept.
ADJOURNMENT
At 8:15 p. m. , Vice Mayor Harberson adjourned the Council Meeting in
memory of all who have given their lives for this Country.
