MINUTES ~ The June 20 and July 5 minutes were approved as submitted. COMMITTEE/COMMIS5ION SEATS Mayor Mattei noted there are vacancies on the various committee and commissions . Applications will be accepted until July Z8 . Interviews will be held at the August 1 Council meeting. CONSENT CALENDAR The following items were approved by the adoption of a single motion which was introduced by Councilman Bond and seconded by Councilman Battaglia. RESOLUTION #9834 NCS KENILWORTH RECREATION CENTER Adopt Resolution No. 9834 NCS accepting completion of the reroofing project of Kenilworth Recreation Center which was awarded to B&B . Roofing of Santa Rosa. RESOLUTION #9835 NCS ADMINISTRATIVE SECRETARY ' Adopt Resolution No. 9835 NCS amending the job description of the Administrative Secretary. * * * * * * * * * * * * END OF CONSENT CALENDAR * * * * * * * * * July 18, 1983 PETITIONS AND COMMUNICATIONS 305 SONOMA COUNTY JUNIOR MISS ~ Patricia Fitzgerald, Chairman, - Sonoma County Junior Miss Association requested the Council's consideration of funding in the amount of $500. It was moved by Councilman Bond, seconded by Councilman Battaglia to participate in funding the Sonoma County Junior Miss Program for 1983/84 in the amount of $500.00 and to bring back a resolution August •1 to confirm this action. Mayor Mattei scheduled a discussion for August 1 regarding seating at the Veteran's Building. PUBLIC HEARINGS SONOMA HIGHLANDS ANNEXATION (aks LaCumbre) Planning Director ,Freitas reviewed the statutory steps taken to date on the proposed annexation. Leo Lane, owner of AP #19-120-32 and 19-120-33 brought in a letter of protest. There was a question about the amount of discretion available to the City Council in connection with this hearing . While the ~ City Attorney retired to ~ the Law Library to research the question, the Council considered the next agenda item. NEW AND UNFINISHED BUSINESS RESOLUTION #9837 NCS CONFIRMING WEED ABATEMENT COST Fire Marshal Glyde Thomas reported the 1983 Weed Abatement program went smoothly. Resolution No. 9837 NCS confirming report of cost of abatement of weeds existing in the City of Petaluma ordered abated by Resolution No. 9735 NCS and the copy of : said report . be turned over to the Assessor-Tax Collector and further proceedings be had under the Municipal Weed Abatement Law. ;.A special assessment again~st the respective parties referred to shall become a lien on their property.. AYES: Balshaw/Battaglia/Bond/Mayor' Mattei NOES.: None ABSENT: Perry/Cavanagh/Harberson RECEBS The Council recessed from 7~:30 to 7:40 p.m. SONOMA HIGHLANDS ANNEXATTON (aks LaCumbre) City Attorney Forest read applicable sections. of the Government Code and advised that~ i~f there is not a majo~ity protest the Council must order the annexation. The hearing was opened. Dr. Lane expressed his questions regarding the possibility of continuance of agricultural use on his 306 July 18, 1983 land and if additional costs would result from the annexation. He was assured the agricultural uses he deseribed could remain and the additional cost would be $.036 per $100 valuation for debt service of the City . Councilman Perry arrived. Rose Eiserich, 931 "B" ~Street, ~representing the Petaluma Area Gitizens League said there should be an EIR on the annexation and she questioned the legality of LAFCO's favorable action on this property. She said the previous EIR should be declared null and void and the specific plans .should be submitted for review. Dennis Milliken, 501 Western Avenue, said the Frates Ranch underwent weeks of review and the sewer system is dilapidated. Roger Burrows, 523 "B" Street asked when the people could protest the development. Mayor Mattei outlines the planning pro.cess steps whieh would bring any proposed development before the Planning Commission in the normal process of development review . The hearing was closed. It was noted there would be a focused EIR and addendum when a development is processed. The matter was continued to August 1 for~. appropriate legislation. ~ . INDUSTRIAL AVENUE SPECIAL ASSESSMENT DISTRICT 10 NC Resolution No. 9838 NCS amending Resolution No. 9127 NCS by changing the maximum interest rate from ten percent to twelve percent. Resolution No. 9842 NCS authorizing transfer of 32 single-family 1981 Construction Year Allotments from housing models previously rated for the Casa Del Oro Unit I single-family residential project to new models evaluated under the applicable allotment system (located at Sartori and Casa Grande) . The estimated construction cost is $221, 000 for a series of 3 ponds to store 25 acre feet of run-off . The design is compatible with future expansion to provide a~bypass storm channel parallel to the Petaluma River• utilizing future ~urban separator land. As part of the Clean Water Grant conditions, it is necessary •for the City to update the existing Wastewater Revenue Program for the wastewater system "prior to completion of the Wastewater T-reatmen~t Plant Upgrade and Effluent Irrigation :System-. projects.!' ; Metcalf and Eddy have the most bac'kground information to utilize in projecting revenue needs over the next 5-years. - Resolution No. 9848 NCS authorizing the Mayor .or City Manager to sign amendment No. 6 to the engineering contract with Metcalf ~and Eddy to update revenue program for the wastewater system.
