County Cultural Arts Planning project. Susan Richter; coordinator

PROPOSED NON-PROFIT EDUCATIONAL FOUNDATION
Ruth Addison, Grants person for the Petaluma High School District,
addressed the Council requesting support for the Petaluma
Educational Foundation. The stated general purpose is to provide a
continuing organizat:ion,.outside the.public school system, which
will work to provide new and improved educational opporturrities.
The Foundation may employ its funds for such things as~,improved
facilities, new educational programs, permanent:collecta,ons,~
scholarships, and any other suitable and worthwhile purposes. It
was Council consensus that the.Mayor_wri,te a l.etter.i~n.support of
this Foundation. ._ .,

CABLE TELEVISION RATE SCHEDULE
Resolution No. 9437 N.C.S. approving revised rates for cable
television service, Viacom Incorporated. Introduced by Councilman
Bond; seconded by Couneilman Balshaw. These rates are consistent
with those recommended by the Council Committee on Cable
Television. The basic monthly service rate will be $8.65.
Secondary outlets (either television or FM radio) will be $2.85.

FRANCHISE PAYMENTS FOR COMMUNITY ANTENNA TELEVISION SYSTEMS
Introduced Ordinance No. 1515 N.C.S. amending Section 14.40.060 of
the Municipal Code providing for franchise payments for community
antenna television systems. This increases the franchise rate from
2% of monthly gross receipts to 3%. Introduced by Councilman Bond;

ST. JAMES MANOR (FETALUMA GARDfNS ELDERLY PROJECT)
Adopt Resolution No. 9438 N.C.S.,approving the re:vised development
plan for the Petaluma Gardens Elderly project (forme~rly ca.l.l.ed St.
James Manor) located at East Washington and Ely Blvd. The
referendum petition from 1977 regarding the St. James project has
been settled by a settlement agreement which provided that the
decision of the trial court permanentTy enjoining action has become
permanent and shall r.emain i.n full force and effect hereafter. The
parties of the agreement further stipulated that the zoning ac~tion
of the City Council by Ordi.nance No. 1263, adopted September 19,
1977, is permanent and in place as of November 18, 1981. Parties
to the agreement are developer - Goldrich, Kest and Associates,
Intevener - Paul Matzger, supporters of referendum - Petaluma

It was understood that staff would work with the Sonoma.County
Water Agency to redesign the creek improvements to sa~veithe poplar
trees and try to scale~down the extent of the required channel
widening. If the trees must be removed, a substantial tree row
will be re-established along the creek.
It was also understood~that East Washington is to be considered as
an 'arterial' frontage for purposes of design and to incorporate
the usual masonry wall into the site plan along this property
boundary.

COUNTRY CLUB ESTATES
Planning Director Freitas reviewed the development plan tentative
map, environmental documentation and ordinance for Country Club
Estates. At the request of the Planning staff the following
condition was added to the tentative map: 13. A mechanism will be
provided to assure funding for maintenance (acceptable to the City
Engi nee,r) and reconstruc,ti.on of the check dams and any. ~ area~s. i n the
project in the eventuali.ty of soil movement or dam failure; and to
maintain all project related sub-drains and drainage ways. (See
Council actions on this subdiv.ision~li:s,ted below). ,, .

park land and the cost of improvements thereon, pursuant to
Petaluma Municipal.Code Section 20.34.010 for the period commencing
on May 1, 1982. Fair market value for parkland is continued at
$28,000 per acre and the improvement costs for parkland
improvements located in streets and other rights of way is hereby

City Manager submitted the preliminary budget to the Council and
the Council established June 14 as the all day budget meeting,

WATER LEAK DETECTION PROGRAM
Resolution No. 9446 N.C.S. authorizing execution of a contract with
Boyl~e Engineering Company for conducting.a water leak.detecti~on
demonstration program in the~City of Petaluma to be.paid for~with
State grant monies. The condition of the contract is the City will
correct a maximum of 10: leaks as~a.result:of this investigation.
